R-2022-122 authorizing a helicopter landing at a portion of property at 1007 River Road, as provided in Yakima Municipal Code 6.32.040, Establishing landing or flying fields -Permit. WHEREAS, any landing place or flying field established within the city limits shall be subject to local regulations; WHEREAS, no flying field or landing place for aircraft, including helicopters, shall be established or maintained within the limits of the city of Yakima without a permit therefor first having been granted by resolution of the city council, pursuant to YMC 6.32.040; WHEREAS, the applicant, Dan Plath, applied for a Modification to Existing or Approved Uses or Development (Exhibit 1 — Application), which was processed pursuant to YMC Ch. 15.17, and Aircraft Operation pursuant to Chapter 6.32; WHEREAS, the Request for Modification (MOD#010-22) was approved, subject to conditions, by the Planning Division on August 4, 2022 (Exhibit 2 — Findings of Fact, Conclusions and Decision); WHEREAS, the City Council of the City of Yakima is dedicated to safeguarding the airspace within the city limits of Yakima; and WHEREAS, the City Council of the City of Yakima considers it in the best public interest to allow a portion of the property at 1007 River Road to be used by applicant for a helicopter landing, and it will promote the general health, safety and welfare; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1. The City Council is authorized to grant a permit to establish a landing place for helicopters at 1007 River Road; 2. The landing area shall not be operational prior to City Council approval; 3. Helicopters shall depart and arrive only on the landing area denoted on the site plan (Exhibit 3 — Site plan); and 4. Helicopters flying to and from the authorized landing area shall contact air traffic control at the Yakima Air Terminal prior to departure and arrival. Yakima Municipal Code 6.32.040 authorizes City Council to grant a permit for a flying field or landing place for aircraft, including helicopters.
