Councilmen present at meeting were' Mayor Bert Broad, Wray. Brown., C. Cole, Betty L. Edmondson, and::Ralpfir:,Holbrook. Also present were City Manager, Craig McMicken'; cCity Attorney, Fred Andrews, Public Services Director, Jack Daniel; Public Works Director, Dave Vargas; Police Chief, Jack LaRue;. Captain Richard Clark of the Police Department; Acting • City Clerk, Iris Litzenberger; Administrative Assistant Dick Zais and Jim Bowers, repre- senting the press. . • . The proposed Gambling Ordinance for Yakima County was'discussed. City Attorney Andrews reviewed -the Sate Law on gambling, the proposed County Ordinance and the possible actions by the' City regarding . gamb -ling. Police Chief LaRue : arid..Captain Clark spoke to the matter regarding.enforcement. Council members indicated that they are not in.favor of punch boards and pull tabs and it was suggested that the County be requested to eliminate these two items in considering their proposed Ordinance. Af -ter due discussion, it was the concensus of the Council members that they would like to be uniform with the County and support the proposed Ordinance, but that they will wait until after the County Hearing on Tuesday to make a final decision as to suggested City legislation on gambling. Public Services Director, Jack Daniel, reviewed the airport development financing in detail and pointed out the next steps to be taken if the Council approved the proposed plans. After due discussion, it was MOVED by Edmondson, seconded by Cole that the Staff be directed to proceed as recommended by Public Services Director Jack Daniel and that a pre- sentation should be made to the, County Commissioners requesting financial aid in this project: carried, Broad, Brown, Cole, Edmondson and Holbrook voting aye by voice vote. Schussler, and Whitaker absent. It was informally agreed that Councilmen Mayor Broad, Edmondson and Holbrook, along with City Manager McMicken and Public Services Director Jack Daniel will meet with the County Commissioners to ,make a presentation and request financial assistance on the proposed airport improvements. At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Cole, Edmondson and Holbrook, City Manager McMicken and City Attorney Andrews present on roll call. Councilmen Schussler and Whitaker absent on roll call. Councilman Whitaker having been excused at a previous meet- ing, it was MOVED by Brown, seconded by Edmondson that Councilman Schussler be excused from this meeting: carried, Broad, Brown, Cole,•Edmondson and Holbrook voting aye by voice vote. _ Invocation was given by Councilman Betty L. Edmondson. The minutes of the previous regular meeting of July 2, 1973, and the adjourned regular meeting :,of July 6, 1973, having been duly certified accurate by two Councilmen, and no one pr-esentwishing to. have said minutes read publicly, Mayor Broad declared said minutes approved recorded. • This being the time !set for..the Hearing on the Arterial Street Six -Year Program, Public Works Director, Dave Vargas, reviewed the status of each project on the list passed to Councilmen. He further reviewed the method of financing . for each project.. After due dis- .cussion,.it was MOVED by Cole, seconded by Holbrook that- the Attorney be. instructed to prepare, the'.necessary legislation for the adoption of the six -year plan as presented: carriedBroad, Brown, Cole, Edmondson and Holbrook voting aye by voice vote. Schussler and Whitaker absent. Present` and speaking„ to the matter - of the parking and sidewalks on both sides of South Third Street was Mrs. Reed. Present and speaking to the matter of improvements on South First Street was Mr. John DeGrasse. • Damage Claims having been filed with the City Clerk on: a. July 3, 1973, by Raymond A. Turner, Yakima Police Officer, 4404 Maple • Avenue, Terrace Heights, in the amount of $250,000 for damages incurred . in a motorcycle accident while on duty; b. July 5, 1973, by David E. Carr, 4 10th Street, Toppenish, in the .amount of $10.45 for replacement of stolen clothing; • c. July 6, 1973, by Mrs. Wayne A. Baldwin, 3602 Richey Road, in the amount of $6.50 for damages to . a hop basket; it was MOVED by Brown, seconded by Edmondson that said Damage Claims be referred to the City, Manager and Staff for study and recommendation: carried, Broad, Brown, Cole, Edmondson, and Holbrook voting aye by voice vote. Schussler and Whitaker absent. Mr. Dean Starr, representing the Parent- Teacher Association of Davis High School, 'submitted to the City Clerk a petitionsigned'-._:by registered Yakima voters requesting the .construc- tion of six tennis-courts at?'Davis High School and Lions Park Recreation Complex. Mr. Starr reported that because. of the need for these facilities in the central and eastern area of Yakima, the Association is requesting that this project be placed high on the list of priorities for the Parks and Recreation Commission. Parks Director, Bill Hutsinpiller, explained that the Commission .has not placed this ahead of other priority projects because funding is not available now for this large project. After due discussion, it was infor- mally agreed by Councilmen that this matter be taken under advisement with a report back as soon as possible concerning the architect's proposal for Lions' Park. Also present and cspe:aklrig ;tp , tha,S lm_atter were Mr. Bob McLaughlin and Mr. Glynn Moore. ' • City Manager McMicken referred to the letters received from Yakima Ambulance Service dated June 28, 1973, and the Department of Social and Health Services dated July 3, 1973, respec- tively, stating that they request a limit on the number of private competing ambulance services for Yakima. Mr. Cockrill, Attorney, briefly explained the history of Sun Valley Ambulance and stated that there is not enough money available for Yakima to operate more than private service. There was discussion on the need to look into standards for fees and wages. After due discussion, it was MOVED by Cole, seconded by Edmondson that this matter be referred to the Staff for study and recommendation: carried, Broad, Brown, Cole, Edmondson and Holbrook voting aye by voice vote. ' JULY 9e 1973 • A report having been received from the Planning CommissionCon the Planned Development request filed by Bank of Yakima, for property located at the Southeast corner of Spruce Avenue and llth Avenue, it was MOVED by Brown, seconded by Holbrook that Monday, July 23, 1973, be the date set for a Hearing on this matter: carried, Broad; brown, Cole,:' Edmondson and Holbrook voting aye by voice vote. Schussler and Whitaker absent.. A report having been received from the Planning Commission on the Rezone Application filed II by Drs. Reihl, Swainson and Shirey, requesting rezone of property located . at the Northwest corner of 40th Avenue and Nob. Hill Boulevard, it was MOVED by Brown, seconded by Holbrook that Monday, July 23, 1973, be set as the date for Hearing on this matter: carried, Broad, Brown, -Cole, Edmondson and Holbrook voting aye by voice vote.- Schussler and Whitaker absent. • City Manager McMicken referred to the matter of authorization to pay Knobel Electric, Inc., for the electrical work performed at the Airport Control Tower without calling' for, bids and explained that this work was done on an emergency :basis. It was MOVED : -by .Browri ' seconded by Cole that Resolution No. D -2075, authorizing said payment of $2;167.17, be passed: carried, Broad, Brown, Cole, Edmondson, and Holbrook voting aye-'on roll call. Schussler and Whitaker absent. . RESOLUTION NO. D -2075, A RESOLUTION ratifying an agreement with Knobel Electric, Inc.,' and authorizing payment for work, labor and materials related to Airport Tower construction, all without calling for bids. . City Manager McMicken reviewed the items of surplus equipment existing in the - Transit Department, including two City buses which are no longer needed.; It was'MOVED by; Edmondson, seconded by Holbrook that Resolution No. D -2076, authorizing the sale of said - equipment, be passed: carried, Broad, Cole; Edmondson and Holbrook voting•aye'ontoll call.
