R-95-93 A RESOLUTION authorizing the City Manager and the City Clerk to execute a Quit Claim Deed to release a sewer easement across property owned by West Valley Nursing Homes, Inc , d/b/a Living Care Centers, and abandoning the public sewer line now located within the Subject Easement. WHEREAS, as a consequence of the establishment of Local Improvement District 798 by the adoption of Ordinance B-1658 on February 14, 1955, the City of Yakima acquired an easement (hereafter the "Subject Easement") over, under, and across property now owned by the Applicant, West Valley Nursing Homes, Inc., d/b/a Living Care Centers, namely Lots 1, 2, 3, 4, and 5 of Mallett's addition within the City (hereafter the "Subject Property"), for construction and maintenance of public sanitary sewer, and WHEREAS, the Subject Easement is part of a greater easement which was acquired by the City as a consequence of the establishment of Local Improvement District 798, and WHEREAS, the City duly constructed and has maintained public sanitary sewer within Local Improvement District 798 including within the Subject Easement, and WHEREAS, the Applicant intends to develop a new apartment building and associated improvements on the Subject Property and over the Subject Easement and over the public sewer located in the Subject Easement, and WHEREAS, the Applicant intends to establish and maintain private sewer lines to serve the parcels now served by public sewer located within in the Subject Easement, and WHEREAS, the Applicant has requested that the City release the Subject Easement and abandon the public sewer therein, and WHEREAS, the City Engineering and Wastewater Divisions have indicated the public sewer located within the Subject Easement does not serve and is not needed to serve any other properties, and may be abandoned without adversely affecting the City's wastewater collection system, so long as the Applicant first installs a new man hole at west end of the sewer line which shall remain public after release of the Subject Easement and abandonment of the public sewer therein, and WHEREAS, no public interest is served by retaining the Subject Easement or the public sewer therein, and lap/land use/easement releases/living care res 7/6/95 4:56 PM LIVING CARE CENTERS - RESOLUTION AUTHORIZING EASEMENT RELEASE AND ABANDONING SEWER -- Page 1 WHEREAS, the City Council deems it to be in the best interest of the City that the Subject Easement be released and the public sewer located therein be abandoned on the condition that Applicant first installs a new man hole at west end of the sewer line remaining public after the release of the Subject Easement and abandonment of the public sewer therein, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Upon the determination by the City Engineer that a new man hole has been properly installed at west end of the sewer line which shall remain public, the City Manager and the City Clerk are hereby authorized and directed to execute the Quit Claim Deed releasing the Subject Easement, a copy of which is attached hereto and by reference made a part hereof, and the public sewer line located within the Subject Easement shall then be abandoned ADOPTED BY THE CITY COUNCIL this \\\`\1\- day of 1995 ATTEST J� j1 Z City Clerk lap/land use/easement releases/living care res 7/6/95 4:56 PM LIVING CARE CENTERS - RESOLUTION AUTHORIZING EASEMENT RELEASE AND ABANDONING SEWER -- Page 2 • • WHEN RECORDED RETURN TO: Name Addre3s City, State, Zip QUIT CLAIM DEED THE GRANTOR, CITY OF YAKIMA, a Washington municipal corporation, for and in consideration of Ten Dollars ($10.00) and other good and valuable consideration, conveys and quit claims to West Valley Nursing Homes, Inc., d/b/a Living Care Centers, GRANTEE, aII right title and interest in the following -described real estate, situated in the County of Yakima, State of Washington, to wit: That portion of an easement for public utilities and sanitary sewer, over, under and across the north 10 feet of Lots 1 through 5 inclusive, of Mallett's Addition, according to the Plat thereof recorded in Volume "G' of plats, page 2, records of Yakima County, Washington. By this instrument, GRANTOR intends to extinguish and release the easement upon the above described real property acquired by the City of Yakima for sanitary sewer purposes as a consequence of the formation of Local Improvement District 798 under City of Yakima Ordinance B - 1658, adopted February 14, 1955.
