R-95- 81 A RESOLUTION approving the final plat of Englewood Square Number 1, an eight residential lot common wall subdivision west of North 34th Avenue between Englewood Avenue and Fairbanks Avenue, and authorizing the Mayor to sign the final plat of Englewood Square Number 1. WHEREAS, this Council has previously reviewed and, subject to certain conditions, by Resolution R-95-28 generally approved the application (City No. Preliminary Plat #6-94) submitted by Bob McLean on behalf of Englewood Square Associates, Inc , for an eight residential lot common wall subdivision west of North 34th Avenue between Englewood Avenue and Fairbanks Avenue, and WHEREAS, the Applicant has completed construction of all public improvements required as conditions of approval of the preliminary plat, and the City Engineer has inspected, approved and accepted all such required public improvements, and WHEREAS, at its public meeting on February 24, 1995, each Council member declared that he or she had had no contact with either the applicant or opponents of the preliminary plat, and as this final plat comes before Council for review each member declares that he or she has had no contact with either the applicant or opponents of the final plat, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The proposed final plat for Englewood Square Number 1, consisting of 1 sheet dated May 2, 1995, showing an eight residential lot common wall subdivision west of North 34th Avenue between Englewood Avenue and Fairbanks Avenue, is hereby approved and the Mayor is hereby authorized to sign the final plat. The final plat for Englewood Square Number 1 shall be filed for record by the Applicant in the Yakima County Auditor's Office immediately, or as soon as possible, and the Applicant shall be responsible for all filing fees. R-95- 28 A RESOLUTION concerning the application submitted by Bob McLean on behalf of Englewood Square Associates, Inc. for an eight lot subdivision west of North 34th Avenue between Englewood Avenue and Fairbanks Avenue, City No. UAZO Preliminary Plat #6-94: approving the preliminary long plat, subject to certain conditions. WHEREAS, on October 13, 1994, the Hearing Examiner held a public hearing to consider the application for an eight residential lot subdivision west of North 34th Avenue between Englewood Avenue and Fairbanks Avenue, submitted by Bob McLean on behalf of Englewood Square Associates, Inc., City No. Preliminary Plat #6-94; and WHEREAS, on December 12, 1994 the Hearing Examiner issued his Examiner's Recommendation (Examiner's No. I94-4-45), recommending approval of the application subject to several conditions; and WHEREAS, the proposed subdivision conforms with the City of Yakima Zoning Title, YMC 14.25.110, and other applicable land use controls; and WHEREAS, at its public meeting on January 24, 1995, each Council member declared that or she had no contact with either the applicant or opponents of this preliminary plat, and the City Council determined that, subject to minor modification, the Recommendation of the Hearing Examiner should be adopted, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: With the exception of Conclusion 3.A.6. appearing on page 9 of the Hearing Examiner's Recommendation, the Yakima City Council hereby adopts the Findings and Conclusions of the Hearing Examiner's Recommendation, Examiner's No. 194- 4-45, a true copy of which Examiner's Recommendation is attached hereto as "Exhibit A" and is incorporated herein by reference. City Council finds formally that, as a matter of fact, the application for an eight residential lot subdivision west of North 34th Avenue between Englewood Avenue and Fairbanks Avenue, submitted by Bob McLean on behalf of Englewood Square Associates, Inc., City No. Preliminary Plat #6-94, conforms with the City of Yakima Zoning Title, YMC 14.25.110, and other applicable land use controls. All approvals and findings of compliance expressed by this resolution are specifically conditioned on the pertinent provisions included among Conclusions 3.A.1.-5., 7., and 8. of the Hearing Examiner's Recommendation, and on the further condition that a lap/land use/subdivLsion/piatting/englewood square/prelim plat res 2/9/95 1:54 PM ENGLEWOOD SQUARE ASSOCIATES — UAZO PREL LONG PLAT NO 6-1994 RESOLUTION APPROVING PRELIMINARY PLAT — Page 1 sidewalk designed to city specifications shall be installed on the west side of North 34th Avenue along the eastern side of the property between Fairbanks Avenue and Englewood Avenue. Preliminary plat approval of an ei.ght residential lot subdivision west of North 34th Avenue between Englewood Avenue and Fairbanks, Avenue, submitted by Bob McLean on behalf of Englewood Square Associates, Inc.;, City No. Preliminary Plat #6-94, as represented by the plan dated July 29, 1994, as revised August 30, 1994, is granted.
