R-95- 8 0 authorizing the City Manager and the City Clerk to execute a Quit Claim Deed to release a sewer easement across Barge - Lincoln Elementary School, property owned by Yakima School District #7 WHEREAS, the City of Yakima has acquired an easement (referred to subse- quently as the "Suhect Easement") by deed, recorded under the Yakima County Audi- tor's File Number 1197563, for the purpose of installing and maintaining water and sewer lines across the Barge -Lincoln Elementary School property owned by Yakima School District #7, and WHEREAS, the water and sewer line easements in question run under the ex- isting school building, and WHEREAS, it is undesirable for City Wastewater Division maintenance respon- sibility that the existing public sewer line lies under the existing and under the pro- posed new school building in, and WHEREAS, the City Water and Wastewater Divisions have indicated that the Subject Easement does not and is not needed to serve any other properties, and WHEREAS, the property owner has requested that the City release the Subject Easement so that the underlying sewer line will become a private "side sewer" con- nection to the Barge -Lincoln School, and WHEREAS, the City Council deems it to be in the best interest of the City that the Subject Easement be released, because no public interest is served by retaining it, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and the City Clerk are hereby authorized and directed to re- lease the Subject Easement by executing a "Quit Claim Deed," a copy of which is at- tached hereto and by reference made a part hereof ADOPTED BY THE CITY COUNCIL this tai day of , 1995 ATTEST City Clerk Mayor WHEN RECORDED RETURN TO: Name Adktes, City, State, Zip QUIT CLAIM DEED THE GRANTOR, CITY OF YAKIMA, a Washington municipal corporation, for and in consideration of Ten Dollars ($10.00) and other good and valuable consideration, conveys and quit claims to Yakima School District #7, GRANTEE all right title and interest in the following -described real estate, situated in the County of Yakima, State of Washington, to wit: A strip of land 16 feet wide the center line of which is described as follows: Beginning at a point of the north line of North Avenue 132.5 feet west of the east line of the West Half of Lot 2 Park Addition, according to the official plat thereof now on file and of record the office of the Auditor of Yakima, County, Washington; thence northwesterly 317 feet to the point which is 150 feet west of said east line; thence north parallel with said east line to the north line of said subdivision; By this instrument, GRANTOR intends to extinguish and release those easements upon the above described real property granted to the City of Yakima for utility purposes by deed dated: December 31, 1947, recorded on February 6, 1948, under Yakima County Auditor's File No. 1197563 in Volume 451 of Deeds, Records of Yakima County, Washington.
