A RESOLUTION: Adopting and approving the Hearing Examiner's decision regarding
Yakima School District No. 7's application for Class 3 review of its
proposal to construct a new two-story, 85,000 -square -foot building to
replace the existing Washington Middle School at 501 South 7th Street,
Yakima, Washington.
WHEREAS, on January 26 and 27, 1995, the Hearing Examiner con-
ducted a public hearing regarding an application for Class 3 review submitted by
Yakima School District No. 7 to construct a new two-story, 85,000 -square -foot
building to replace the existing Washington Middle School at 501 South 7th
Street, Yakima, Washington; and
WHEREAS, the Hearing Examiner on February 3, 1995, approved the
application subject to certain conditions; and
WHEREAS, the Hearing Examiner's Findings, Conclusions, and Decision
were appealed to the City Council; and
WHEREAS, on March 21, 1995, the City Council held a public meeting to
consider the appeal of the Hearing Examiner's Findings, Conclusions, and
Decision; and
WHEREAS, the City Council considered the parties' statements and public
comment at the hearing, the Examiner's decision, the evidence presented to the
Examiner, a video and audio recording of the hearing before the Examiner, and
the written argument and written memorandum of authority received from the
parties; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The Findings of Fact, Conclusions of Law, and Decision of the Hearing
Examiner regarding Yakima School District No. 7's application for Class 3 review
for Washington Middle School is hereby adopted and approved.
ADOPTED BY THE CITY COUNCIL on March 21, 1995.
