R-95-' 7 A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute a Memorandum of Understanding between the City of Yakima and the Yakima Fire Department Battalion Chiefs. WHEREAS, the Yakima Fire Department Battalion Chiefs certified as a bargaining unit with the Public Employment Relations Commission (PERC) in 1993; and WHEREAS, the City and the Fire Battalion Chiefs have been negotiating for many months on a proposed bargaining unit agreement; and WHEREAS, the Fire Battalion Chiefs desire to be included within the management, supervisory, and union -exempt personnel group of the City of Yakima; and WHEREAS, the Fire Battalion Chiefs are willing to decertify their bargaining unit with PERC or disclaim interest in exercising their right to bargain about wages, hours, and working conditions for one year from the effective date of April 16, 1995 in accordance with the terms of the attached Memorandum of Understanding; and WHEREAS, the City Council has determined that it is in the best interest of the City to enter into said Memorandum of Understanding with the Yakima Fire Department Battalion Chiefs so that they may be included within the management, supervisory, and union -exempt personnel group of the City of Yakima, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and City Clerk are hereby authorized and directed to execute the attached and incorporated Memorandum of Understanding with the Yakima Fire Department Battalion Chiefs. ATTEST: Mayor City Clerk fls)res/bettnlion chief s.pm MEMORANDUM OF UNDERSTANDING This memorandum of understanding acknowledges and confirms the agreement between the City of Yakima and Battalion Chiefs David R. Bachmann, Gary L. Vance, Michael A. Meyer and Richard J. Andring (hereinafter referred to as Battalion Chiefs) regarding compensation and specific employment matters for Battalion Chiefs. The parties agree to the following points having been addressed and clarified regarding issues not addressed in the Management Compensation Plan. 1. The Battalion Chiefs agree that they shall become a part of the Management Compensation Plan adopted in Ordinance No. 94-83 effective April 16, 1995. 2. The Battalion Chiefs agree to decertify their bargaining unit with P.E.R.C. or disclaim interest in exercising their rights to bargain about wages, hours and working conditions for one year from the effective April 16, 1995. The Battalion Chiefs agree to execute a corresponding decertification document or disclaimer of interest document. Said document will be filed with the P.E.R.C. (reference Case 10671-E-93-1762) if necessary. 3. (a) The base monthly salary in effect March 14, 1995 shall be increased by 3.63% effective April 16, 1995. (b) The 52 hour work week for "shift" Battalion Chief shall be adjusted to 51.38 hours effective May 1, 1995. (c) The base monthly salary in effect June 30, 1995 shall be increased by 4.41% effective July 1, 1995. (d) Eligible for an additional longevity step after 24 years of service at 8.0% effective July 1, 1995. 4. Promotional standards for the Battalion Chief classification will be implemented based on prior discussions with the Battalion Chiefs after one (1) year if Chief Chronister's efforts to establish professional standards in the department are not successful. In the event that promotional standards are not established within the specified period of time, the City and Battalion Chiefs agree to negotiate promotional standards including educational and training standards and examination procedures. 5. Battalion Chiefs assigned to Operations will be awarded Kelly Days and Holiday time consistent with Department practice. 6. Complete physical exams will be provided at the City's expense at ages 40, 45 and bi- annually after age 45 until retirement. March 10, 1995 7. The 1995 emergency differential pay management goal is to reduce the amount which was expended in 1994. The parties agree that the City's estimated expenditure for 1995 of $10 - $14 thousand dollars will be achieved as long as there are no disabilities and long term personnel shortages. Disability, personnel shortages, and emergencies directly affect the amount of overtime regarding the Operations Division. This is difficult to project and it would affect the Operations Battalion Chiefs as well as the Firefighters Local. The parties mutually agree that every effort will be made to minimize emergency differential pay expenditures. The Battalion Chiefs would have first option to work back when a hiring situation occurs (with the option of working 10 or 24 hours.) If staffing allows then a Captain would be moved into the car in an acting capacity and additional actors would be assigned as needed to provide leadership coverage for the shift. Another option would be for the Training B.C. to fill in for the 10 -hour day portion of a shift, move a Captain into the command car as an actor for the night portion of the shift and hire at the lowest level to satisfy minimum staffing requirements. These are examples of ways the B.C.'s have agreed to assist in reducing emergency differential pay costs and by responsible management and working with the Chief to achieve the goal. The parties understand that Fourteen Thousand Dollars ($14,000.00) has been budgeted for this line item. 8. Only for the purposes of emergency call-back and cash outs of vacation and/ or sick leave time at the time of retirement or termination of service to the department, Battalion Chiefs will receive compensation based on their then applicable salary divided by 173.33 hours. Bachmann Mi Gael A. eyer -m Gary IL Vance BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT Item No. 1 -1 For Meeting Of 3/ 14/95 ITEM TITLE: Consideration of Legislation for the Inclusion of Battalion Chiefs in the Management Group SUBMI1'1 ED BY: Dick Zais, City Manager CONTACT PERSON/TELEPHONE: Dick Zais, x6040 Sheryl Smith, Deputy Personnel Officer SUMMARY EXPLANATION: The legislation attached initiates the process for decertification/ disclaimer of interest of the Battalion Chief bargaining unit and incorporates the Battalion Chiefs within the City's Management Group. •Ordinance A includes the Battalion Chiefs in the Management Compensation Plan and allows eligibility for the top step of the longevity plan at 24 years of services. •Ordinance B amends the Classification and Compensation Plan to adjust the Battalion Chief compensation twice in 1995, the first on April 16 and a mid -year adjustment to off -set compression. According to the City's calculations, the annualized impact of this agreement is estimated to be 5.78% or $14,739. This ordinance also adjusts the scheduled hours of work for shift Battalion Chiefs consistent with Fire Department practice. •The resolution authorizes the City Manager to enter into a Memorandum of Understanding with the Battalion Chiefs regarding employment matters not contained within the Management Compensation Plan.
