HomeMy WebLinkAbout05/29/1973 Business Meeting &77 MAY 29, 1973 The City Council met in session at 1:30 P.M. on this date in-the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Howard C: Cole, Betty L. Edmondson Ralph Holbrook, Don Schussler and Bill Whitaker. Also present were City Manager, Craig McMicken; Personnel Director, Bob Hilsmann; Deputy City Clerk, Iris Litzenberger; and Jim Bowers, 'representing the press. City Manager McMicken referred to the Regionalization Study material which had been given to the Council members for their information. No action was taken on this matter. City Manager McMicken reviewed the proposed'plans Toward the Direction of Reorganization, explaining that the reasons for the suggested reorganization is to get more people involved in management of city government. He stated that he is preparing a report for considera- tion by the City Council at the next Council meeting to implement the staff changes on a 60 - 90 -day trial basis. There was discussion on the matter of Cable TV and the supporting of Educational No formal action was taken at this time. • At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Cole, Edmondson, Holbrook, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Brown absent on roll call, having -been excused at a previous meeting. The Invocation was given by City-Attorney Andrews.' The minutes of the adjourned regular meeting of May 18, 1973, the regular meeting of May 21, 1973, and the adjourned regular meeting of May 25, 1973, having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as - recorded.' This being the time set for the Hearing on the Rezone Application filed by Mrs. Barbara, Tunes, requesting rezone of property located at 114 East "I" Street, Assistant Planner, Glen Rice, reviewed the Staff Report on this subject dated April 23, 1973. He stated that the site, now split in half with zoning of both R -3 and B -2 is requested to be zoned all B -2 for uses- -in connection with a motel, restaurant' and business complex. -Mr. Rice also - reported that the Planning-Staff recommends approval of this request for the•follow- ing reasons: •• . . • , • 1. The proposed rezone is in conformance with the General Plan. 2. The granting of this rezone will rectify and render useful a parcel of:. land that currently is unusable in either zone. 3. The rezoning of the''remainder of -thi's lot will not have a negative effect on surrounding residential areas. After due discussion, it was MOVED by Schussler, seconded by Whitaker that Ordinance No. 1524, accepting the recommendation of the Planning Commission and zoning said property, be passed: carried,- Broad, Cole, - Edmondson," Holbrook,'Schussler'and Whitaker :voting aye on roll call. ORDINANCE NO. 1524, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 114 East :Lo=7BUslrrilen%=17,- Iof Yma, Washington, fom R -3 , Multiple FamilyVZone, and B -2 to B -2, Local Business Zone. This being the time set for the Hearing on the Planned Development request filed by John Marshall Construction, for property located at the northwest corner of Nob Hill Boulevard and Cornell Avenue, Principal Planner Dick Hill, •reviewed the•Planning Commission Minutes on this subject dated May 1, 1973, and the Staff Reports df March 26 and April 23, 1973, respectively. He reported that this request is for a Reeseman's Drive -In Dairy and a • twenty -unit multiple family complex of apartments. Mr. Hill further reviewed the plans for a swimming pool, off - street parking and landscaping for this area. He stated that the eight conditions of the Planning Commission's preliminary approval of -April 3 1973'have been met, and stated that the Staff "recommends•approval' for this Planned" Development pro= vided: f , 1: That landscaping and . irrigation plans be submitted-to-and approved by • . the-Department-of-Planning-and Community Development prior to the issuance' of any building permits !. 2. That sign size, design and location be submitted to and approved by the Department of-Planning and Community Development-prior to the issuance of building permits: 3. That , development conforms to - Exhibit "A• ". ‚ -• After due discussion, it was MOVED by Edmondson, seconded by Cole that Ordinance No. 1525, accepting the recommendation of the Planning Commission and zoning said property, be passed: carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. -Brown absent; - • ORDINANCE NO. 1525, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at the northwest corner of Cornell Avenue and Nob Hill. Boulevard in the City of Yakima, Washington, from R -2, Two to Planned Development. Zone. - This being the time set for the Hearing on the Planned. Development Request filed by Hallie Rightmire and Bernice Wetzel, for property located at 3030 West Nob Hill Boulevard, Assis- tant Planner, Glen Rice, reviewed the Staff Reports on this-subject dated March 26 and April 23, 1973, respectively. He reported that this site will be turned over to Home 578 . MAY 29, 1973 • Federal Savings and Loan, if approved, for construction of a branch office. Mr. Rice also reviewed plans for the removal of the present house occupying this site and for all vehi- cular'access off of 31st Avenue. He further covered plans for landscaping, pedestrian access,., parking, fencing, lighting and signing. He indicated that all conditions of the preliminary approval the Planning Commission on April 3, 1973, have been met and stated that the Staff recommends approval of this request with the inclusion of the following: 1. Construct a 5 -foot sidewalk along South 31st Avenue 6n the eastern five feet of the proposed right-of-way and use-the remaining . four feet to the arb as a grassed planting strip. 2. Street trees be provided along South 31st Avenue to be located in the grassed parking strip, of a•variety recommended by the Street Tree Committee. • 3. Both signs as indicated on the revised site plan be ground signs illumi- nated only with exterior lighting. In addition, the small sign proposed for South 31st Avenue be extinguished daily after the normal hours of operation to reduce unnecessary light within the adjacent residential • areas. 4. The staff further recommends that prior to receiving a building permit, •a detailed sign plan indicating placement, elevations, dimensions be presented to and approved by the Planning Staff. After due discussion, it was MOVED by Cole, seconded by Edmondson. that Ordinance No. 1526, accepting the recommendation of the Planning Commission and zoning said property, be passed: carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. Brown absent. Present and speaking to this matter was Bernice Wetzel. - ORDINANCE NO. 1526, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 3030 Nob Hill Boulevard in the City of Yakima, Washington, from R -2, Two Family Zone, to Planned Development Zone. This being the time set for the Hearing on a Planned Development Request filed by United Mutual & Loan Bank, for property located on the northeast corner of 56th and Summitview. Avenues, Principal Planner, Dick Hill, reviewed the Staff Reports on this subject dated •March 2.6:.and -April 23; 1973; respectively. With the use of a design drawing, Mr. Hill briefly reviewed the plans "for access, off - street parking, landscaping and traffic circulation patterns in connection with entrances and exits. Councilman Edmondson asked questions and expressed concern regarding left turns into the bank from Summitview. Mr. Hill stated that the conditions for the preliminary approval by the Planning Commission given April 3, 1973, have been met and that the Staff recommends approval of this request provided: 1. That landscaping and irrigation plans be submitted to and - approved by the Department of Planning and Community Development prior to issuance of any building permits. 2. That sign design and location be submitted to and . •approved by the Depart- ment of Planning and Community Development prior to issuance of any building permits. 3. That the development conforms to exhibit "A ". After due discussion,, it was MOVED by Whitaker, seconded by Schussler that Ordinance No. 1527, accepting'the' recommendation of the Planning Commission and zoning said property, be-passed: carried, Broad, Cole, Holbrook, Schussler and Whitaker voting aye on roll call; Edmondson voting nay on roll call. Brown absent. ORDINANCE NO. 1527, AN•ORDINANCE accepting the recommendation of the Planning Commission to modify the Planned Development Zone applicable to certain property situated near the northeast corner of Summitview Avenue and North 56th Avenue in the City of Yakima, Washington. This being the time set for the Hearing on the Outside Utility Request filed by Wes Wilson for property located near 1310 West Mead Avenue, Assistant Planner, Glen Rice, reviewed the Staff Reports on this subject dated March',21 and April 23, 1973, respectively. He stated that this request for city water and sewer connections are in conjunction with the multiple family Planned Development at this site. He further reported on the desire of the owner to annex when possible and stated that the conditions of the .Planning Commission's prelimi- nary approval of April 3, 1973 have been met. Mr. Hill indicated that the Staff recommends approval of this request subject to the following conditions: 1. That all recommendations listed in the preliminary approval be required as a condition for final approval. However, the construction of curbs, sidewalks, paving and street trees should not be completed along Mead Avenue until the City Engineer has formulated design and street construc- tion criteria for that section of Mead Avenue from llth Avenue to 16th Avenue. 2. That although, not indicated on the final plan, the staff recommends a 9 -foot planter strip be provided between the proposed fence and required curb along King Street with street trees located within the planting - strip. • 3. That redrafted final plans be submitted to and approved by the Department of Planning and Community Development prior to issuance of any permits. After due discussion, it was MOVED by Schussler, seconded by Whitaker that the Planned Development and Outside Utility Request made by Mr. Wilson be approved, subject to the abov conditions indicated by the Planning Staff: carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker- voting aye by voice vote. Brown absent. Mr. Wilson, being present, indicated that street trees will be placed in the development area, but that 'it is first 579 MAY 29, 1973 necessary to place the water and sewer lines before this is done. • A Damage Claim having been - filed with the City Clerk on May 21, 1973, by A. Lindley, in the amount of $5, for damages in connection with his water billing, it was MOVED by Schussler, seconded by Holbrook that said Damage Claim be referred to the City Manager and Staff for study and recommendation:. carried, Broad, Cole,.. Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Brown absent. An Ordinance appropriating the amount of $136 to pay the city's obligation to the Yakima County Clean Air Authority, having been read by title at the previous meeting of May 21, 1973, and being read again by title at this meeting, it was MOVED by Whitaker, seconded by Cole that Ordinance No. 1528, providing for said appropriation, be passed: carried, Broad, Cole, Edmondson,_ Holbrook, Schussler and Whitaker voting aye on roll call. Brown absent. • ORDINANCE NO. 1528,.AN ORDINANCE appropriating the amount of $136 from unappropriated-money in 134 -Clean Air Fund to Account 535.60.41 of the 1973 appropriation for 134 -Clean Air Fund. - An Ordinance appropriating $369,401 for various park•improvements, having :been read by title only at the previous meeting of May 21, 1973, and being read again by title at this meeting, it was MOVED by Cole, seconded by Edmondson that Ordinance No. 1529, providing for said appropriation,.be'passed:, carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1529, AN ORDINANCE appropriating the amount of $369,401 from unappropriated money in 331 -Parks and Recreation Capital Fund to Account 331- 533 -20 -65 of the 1973 appro- priation for 331 -Parks and Recreation Capital Fund. An Ordinance transferring and appropriating money for Southeast Community Center and ex ce tending due date of temporary loans, having been read by title only at the previous meeting of May 21, 1973, and being read again by title at this meeting, it was MOVED by Holbrook, seconded by Edmondson that Ordinance No. 1530, providing for said appropriation, be passed: carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. Brown absent. • ORDINANCE NO. 1530, AN ORDINANCE appropriating the amount of $37,843 from unappropriated money in 000-General Fund for transfer to 391 - Southeast Community Center Fund; transferring $37,843 from 000- General Fund to 391 - Southeast Community Center•Fund and.appropria.ting that amount within such fund; and extending loans previously made to 391 ,-.Southeast Community Center Fund from 473 - Water -Sewer Fund. An Ordinance appropriating and transferring $10,000 in the General Fund to pay for tourist promotion and expenses of the Convention Center Bond Issue, having been read by title only at this meeting, was laid on the table for one week, or until June 4, 1973. City Manager McMicken explained that this amount is to cover costs in connection with the Visitors and Convention Bureau, Convention brochure, Foster and Marshall for financial services and Thorgrimson for legal services. It was MOVED by Schussler, seconded by Whitaker that Ordinance No. 1531, implementing Phase I of the contemplated Pierce Avenue project, be passed: carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. Brown absent. 7 ORDINANCE NO. 1531, AN ORDINANCE relating to traffic control; designating a portion of B Street as a one way street; prohibiting parking on a portion of Pierce Avenue; and amending Subsection 9.75.020 (o) and Section 9.75.040 of the City of Yakima Municipal Code. City Manager McMicken referred to the matter of approval for the requested furnishings for the new Fire Stations #1 and #5. He reviewed the financial statement for the Fire Bond Issue dated May 22, 1973 and the accompanying list of furniture needed for these two sta- tionS. He further reported on the plans for selling the old training center to the Parks Department and after a brief review of the revised cost estimates, requested Council approval for Bond Issue Funds for the purchase of furniture and equipment in the total amount of $13,368.41 for these two stations. After due discussion, it was MOVED by Schussler, seconded by Whitaker that the purchase of furniture for Fire Stations No.' 1 and • No. 5 be authorized: carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Brown absent. City Manager McMicken referred to the matter of vending machine concessions at the Yakima Air Terminal, stating that he had received a recommendation from the Airport Manager and Director of Services to reject all bids for vending machine operations and instead, go ahead with an agreement with Mr. Leland Davis, operator of the Gift Shop in the Terminal to provide the concessions. Mr. McMicken reported that Mr. Davis has agreed to perform part -time custodian duties in the Air Terminal Lobby in connection with his handling of the vending operations. He stated that it is further recommended that the city discontinue its present informal arrangement for vending concessions with Automat Company. After due dis- cussion, it was MOVED by Whitaker, seconded by Holbrook that the recommendation for Mr. Leland Davis to handle vending machine operations and part -time custodial duties at the Yakima Air Terminal, be accepted: carried; Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by vote. Brown absent. City Manager McMicken referred the 1972 Industrial Sewer Billing dated May 17, 1973, to Finance Director, Leonard Crose, who explained the rates - shown to be generally in line with those in the past and briefly explained some changes noted for 1972. City Manager McMicken reported on the proposed amended agreement with the Washington State Office of Economic Opportunity, explaining that the previous agreement was in error as to funding, since the city did not start with the program until March, 1973. He briefly reviewed the differences in the two agreements, stating that the city will not be reim- bursed for the salaries paid to the New Careers Trainees until the new agreement is fully executed. After due discussion, it was MOVED by Cole, seconded by Whitaker that Resolu- tion No. D- 2060, authorizing the execution of said amended agreement, be passed: carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. Brown absent. MAY 29, 1973 JUNE 1, 1973 RESOLUTION NO. D -2060, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an amended agreement with the Washington State • Office of Economic Opportunity. • . . • City McMicken reported that bids were received.and considered by the bid -board on May 24, 1973, for the - construction of tennis courts at Franklin Park, as follows: Superior Asphalt & Concrete Company $28,000.00 Yakima Asphalt Paving.Company. _ .. 46,450.00 -. . He reported that the total of $30,150 will be made up from Contingency Funds within the Park Bond Issue. City Manager McMicken recommending that the bid be awarded to Superior Asphalt & Concrete Company, who submitted the lowest and best bid, it was MOVED by Whitaker, seconded by Edmondson that the.bid.be,awarded to Superior Asphalt & Concrete Company in the amount of $28,000 and that the City Manager be authorized to enter into contract with said contractor upon the filing of the proper bond and insurance, and that the total funds necessary be made up from the Contingency Funds: carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye.by voice vote.. Also present were City Manager McMicken and Jim Bowers, representing the press. The Council discussed of the Aviation Committee regarding the Air Cargo Study. No action was taken. , There being no further business, to come before the Council, it was MOVED by Schussler, seconded by Cole that we do now adjourn at the hour of -1:20 P.M.: carried, Broad, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote.
