A RESOLUTION concerning the application submitted by Robert J. Harrison,
d/b/a Messina Construction, for a twelve lot subdivision
between North 37th and North 34th Avenues and between
Englewood Avenue and Fairbanks Avenue, City No. UAZO
Preliminary Plat #7-94: approving the preliminary long plat,
subject to certain conditions.
WHEREAS, on January 12, 1995, the Hearing Examiner held a public hearing
to consider the application for a twelve lot subdivision between North 37th and
North 34th Avenues and between Englewood Avenue and Fairbanks Avenue,
submitted by Robert J. Harrison, d/b/a Messina Construction, City Number UAZO
Preliminary Plat #7-94; and
WHEREAS, on January 19, 1995 the Hearing Examiner issued his Examiner's
Recommendation (Examiner's No. I95-4-4), recommending approval of the
proposed subdivision subject to several conditions; and
WHEREAS, the proposed subdivision conforms with the City of Yakima
Zoning Title, YMC 14.25.110, and other applicable land use controls; and
WHEREAS, at its public meeting on February 7, 1995, the City Council
determined by motion that the Recommendation of the Hearing Examiner,
modified by deletion of the requirement of a sidewalk on the south side of
Fairbanks Avenue, should be affirmed and adopted, and each Council member
declares that he or she had no contact with either the applicant or opponents of
this preliminary plat, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
With the exception of recommended condition number 6 appearing on page
9 of the Hearing Examiner's Recommendation, the Yakima City Council hereby
affirms and adopts the Findings and Conclusions and recommended conditions of
the Hearing Examiner's Recommendation, Examiner's No. I95-4-4, a true copy of
which Examiner's Recommendation is attached hereto as "Exhibit A" and is
incorporated herein by reference. City Council finds formally that, as a matter of
fact, the application for a twelve lot subdivision between North 37th and North
34th Avenues and between Englewood Avenue and Fairbanks Avenue, submitted
by Robert J. Harrison, d/b/a Messina Construction, City No. Preliminary Plat #7-
94, conforms with the City of Yakima Zoning Title, YMC 14.25.110, and other
applicable land use controls. All approvals and findings of compliance expressed
by this resolution are specifically conditioned on the pertinent matters included

among the Findings and Conclusions and recommended conditions numbers 1 - 6
and 8 - 11 of the Hearing Examiner's Recommendation. No sidewalk is required on
the south side of Fairbanks Avenue. Subject to conditions stated herein,
preliminary plat approval of a twelve lot subdivision between North 37th and
North 34th Avenues and between Englewood Avenue and Fairbanks Avenue,
submitted by Robert J. Harrison, d/b/a Messina Construction, City No. Preliminary
Plat #7-94, as represented by the Grading, Drainage and Utilities Plan drawing
(also identified as sheet C1), prepared by Barbara Staake, P.E., dated November 18,
1994, is granted.
