HomeMy WebLinkAbout05/07/1973 Business Meeting 568 MAY 7, 1973 The City Council met in regular session at 1:30 P.M. on this date in the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Howard C. Cole, Betty L. Edmondson, Ralph Holbrook, Don Schussler and Bill Whitaker. Also present were City Manager, Craig McMicken; City Attorney, Fred Andrews; Director of Services, Jack Daniel; Finance Director, Leonard Crose; and Jim Bowers, representing the press. City Manager McMicken briefed Council members on Initiative 276 as it relates to the Com- munity Center Bond Issue. There are 25,851 registered voters in Yakima, hence only $2,585 may be spent in the election campaign. He informed the Council that any campaign approach should not give evidence of an attempt to circumvent Initiative 276. Councilman Wray Brown informed the Council that the Community Center brochure would be handed out to each residence by May 9, 1973. Director of Services, Jack Daniel, briefed the Council on the status of the application for a grant from FAA /EAA. A total of $243,155 has been requested including $60,000 for lighting, $45,000 for avigation easements, and $122,930 for overlay of Runway 4 -22. Also requested is $15,225 for a Fire and Rescue truck. Finance Director, Leonard Crose, reviewed procedures used in the investment of idle funds. He stated that investments try to at least offset interest paid on Bond payments and that the city has been quite successful at this. City Manager McMicken reviewed the Englewood Reservoir Landscaping Project. In a letter from Mrs. Plath, she objects'to the city plan for landscaping and is not willing to accept any of the camouflage materials submitted for her approval. Her attorney advises that if the city does not do something soon, Mrs. Plath will introduce proceedings to cause removal or alterations of the reservoir. At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by Councilman Betty L. Edmondson. The minutes of the adjourned regular meeting of April 27, 1973, and the regular meeting of April 30, 1973, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. A Damage Claim having been filed with the City Clerk on April 27, 1973, by Ronald D. Wilson police officer, in the amount of $85, for loss of his wristwatch in line of duty, it was MOVED by Whitaker, seconded by Holbrook that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. An Ordinance appropriating $30,000.to_ the County Health District for Southeast Yakima Health District for Southeast Yakima Health Clinic, having been ... read by title only at this meeting, was laid on the table for one week, or until May 14, 1973. City Manager McMicken referred to the Health Service Agreement between the Health District and the Yakima Com- munity At Work organization, stating that this agreement would be executed before the Ordi- nance is passed. He further explained that the amount being transferred and appropriated by this Ordinance is for the period of April, 1973 through December, 1973 and is part of the total amount' of Federal Revenue Sharing money earmarked for this purpose. .There was discussion and questions by the Council members regarding the language of the proposed agreement in reference to salaries and fees paid to the Health Clinic personnel. City Attorney Andrews explained the reasons for the language used and indicated that a minor change may need to be made.;. An Ordinance appropriating $8,738 for airport expenditures, having been read by title only at this meeting, was laid on the table for one week, or until May 14, 1973. City Manager McMicken explained that this Ordinance covers the costs of transportation in connection with airport security and the security fencing. City Manager McMicken referred to the proposed Ordinance establishing a parking meter zone on South Second Street between Spruce Street and Pine Street, stating that there is a problem noted by the Lynch Motor Company with customers parking on a strip between the sidewalk and curb adjacent to the Company. He stated that there is a request for a four - hour, five cents per hour, nickel -dime parking meter zone in this area. After due discus- sion, it was MOVED by Schussler, seconded by Cole that Ordinance No. 1519, designating said parking meter zone, be passed: carried, Broad, Brown', Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1519, AN ORDINANCE relating to traffic control; designating parking meter zones; and amending Subsection 9.75.030 (b) of the City of Yakima Municipal Code. City Attorney Andrews referred to his Memo dated May 4, 1973 concerning the proposed Ordi- nances regarding penalties for violations of the City Municipal Code and reviewed the pre- sent provisions which allow for jury trials for minor violations of city ordinances. Mr. Andrews explained that the great number of jury trials requested have involved additional time on the part of the court, Assistant Attorney and Secretary, when many of these trials have involved petty offenses. He further explained the amendments of the two proposed Ordinances for the penal and traffic code penalties and reported that the rights of the accused persons for a jury trial in certain types of cases would not be jeopardized. After due discussion, it was MOVED by Schussler, seconded by Brown that Ordinance No. 1520, pro- viding penalties for traffic violations, be passed: carried, Broad, Brown, Cole, Edmondson Holbrook, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1520, AN ORDINANCE relating to traffic control; providing penalties for vio- lation of Title 9 of the City of Yakima Municipal Code; amending Section 9.80.010 and re- pealing Section 9.32.050, both of the City of Yakima Municipal Code; and declaring an emergency. ' MAY 7, 1973 It was MOVED by Schussler; seconded by Edmondson that Ordinance No. 1521, providing penal- ties for certain sections of the Public. Safety and Morals Code, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. ORDINANCE NO. 1521, AN ORDINANCE relating to public safety and morals; providing penalty for violation of certain sections of Title 6 of the City of "Yakima Municipal Code; amend- ing Sections 6.02.010 and 6.02.050"of the City of Yakima Municipal, Code; and declaring an emergency. • The following additional New Careers trainees were introduced at this time by Mr. Juan Arambul of the City Manager's Department: Margie Gallegos, Planning Department; Thelma Trimble, Parks 'and Recreation; Lloyd James, Personnel Department; John Garcia, Fire Depart- ment; and Gilbert Rodriguez, Fire Department. . City Manager McMicken reported that bids were received and considered by the bid board on May 2, 1973, for the Old Police Station, as follows: R. L. After due discussion, it was MOVED by Schussler, seconded by Cole that the matter of this bid award be referred back to the City Manager for further discus- sions with H & R Block: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Mr. Larry Keeler, being present, suggested that the. city keep the station for purposes of a Police Museum:• Reports having been received from the Planning Commission on the following: a. Rezone Application filed by Mrs. Barbara Tunes, requesting rezone of property located at 114 East I Street. . . b. Planned Development request filed by John Marshall Construction, for property located at the northwest corner of Nob Hill Boulevard and Cornell Avenue. • c. Planned Development.request filed by Home Federal Savings & Loan, for property located at 3030 West Nob Hill Boulevard. d. Planned Development request filed by United Mutual Savings Bank, for property located on the northeast corner at 56th and Summitview Avenues, , . it was MOVED by Schussler,.seconded by Cole that Tuesday, May 29, 1973, be set as the time for Hearings on the above listed requests: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. . Planning Director, Jay Otto, reviewed his letter to the Council concerning fire protection to the Central Washington Fairgrounds dated May 3, 1973, which contained a recommendation from the Planning Commission stating that though the Central Washington Fairground pro- " • perty is unique and possibly deserving of special services, the'utility extension policy of the city should not be waived in providing fire protection on a contractural basis to this area., After due discussion, it was MOVED by Whitaker, seconded by Cole that Fire Chief Matt Young be requested to come and speak to the Council concerning- contracted ser- vices vs. mutual aid services. It was MOVED by Schussler, seconded by Whitaker that Resolution No. D -2055, authorizing payment of $25.67 to Gary and Linda Birch for water damages to their kitchen floor, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker.voting aye on roll call. . RESOLUTION,NO. D -2055, A RESOLUTION authorizing payment of a claim for damages filed by Gary R. and Linda D. Birch. City Manager McMicken referred to the Outside Utility Request filed by Wes Wilson for a Planned Development on Mead Avenue. He reported that the city.is requiring that this perty be developed according to city code requirements with a view for future annexation of this site to the city and suggested that the Council schedule a date for Hearing on this matter. After due discussion„ it was MOVED by Schussler, seconded by Cole that Tuesday, May 29, 1973; be set as the time for a non -legal hearing on this request.: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Mr. McMicken reviewed the Milroy Park Parking Lot Development Plan, reporting a difference in the previous Bond Issue estimated cost of $6,000 and a present estimate of $11,900 which includes paving, lighting, fencing gate installation, landscaping and striping." City Attorney, Fred Andrews, indicated that arrangements need to be made concerning the right of way for the Bower greenhouse property and that an agreement is now in preparation for this. After due discussion, it was MOVED by Cole, seconded by Edmondson that the site plan be adopted and that the necessary'contracts for bidding be prepared .and bids be called for: carried; Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. City Manager McMicken reviewed his Report #176 concerning the Yakima Air Terminal Air - conditioning. He briefly reviewed the various alternatives presented by Bouillon, Christofferson & Schairer, Consulting Engineers, in their letter dated April 23, 1973. Mr. Jim Eakin, Airport Manager, that he would recommend Scheme ##1 - Modified, as found in the City Manager's Report. After due discussion, it was MOVED by Schussler, seconded by Edmondson that Scheme #1 - Modified, for air - conditioning to the Yakima Air Terminal, as presented in City Manager Report #176, be adopted: carried, Broad, Edmondson, Holbrook and Schussler voting aye by voice vote; Brown, Cole and Whitaker voting nay by voice vote. City Manager McMicken referred the matter of the city's street tree policy to Planning Director, Jay Otto, who reviewed his Meto-dated May 4, 1973, concerning the County widen- 570 MAY 7, 1973 ing project on Summitview Avenue. He emphasized the difference between the amount of right of way included by the city and county and noted a problem with the lesser amount used by the county'for this major arterial. Mr. Otto further stated the desire for tree plantings and landscaping along this project and reviewed the various measurements to be used by the county for this. Mr. McMicken reviewed the various alternative methods for planting the street trees as contained in his Report #148 dated April 6, 1972. After due discussion, it was MOVED by Cole, seconded by Whitaker that a letter be sent to the County Engineers along with supporting materials concerning the desire on the part of the city for trees and tree wells along the Summitview widening project: carried, Broad, Brown, Cole, Edmond- son, Holbrook, Schussler and Whitaker voting aye by voice vote. After due discussion, it was MOVED by Whitaker, seconded by Cole that Mr. Wes Wilson be employed as a negotiator for the city: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. There being no further business to come before the Council, it was MOVED by Holbrook, seconded by Cole that this meeting be adjourned at 5 :30 P.M. to Friday, M 11, 1973, at the hour of 9:00 A.M., to then meet at the El Cid Restaurant, Yakima: carried, Broad, - Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote.
