HomeMy WebLinkAboutR-1995-002 D.A.R.E. ProgramRESOLUTION NO. R-95- 2 A RESOLUTION authorizing the City Manager to execute the D.A.R.E. Program Agreement with the Toppenish School District. WHEREAS, the City of Yakima desires to contract with the Toppenish School District for the performance of certain Drug Abuse Resistance Education (D.A.R.E.) Program services by the City of Yakima Police Department; and WHEREAS, the City has the resources and is willing to render such services on the terms and conditions hereinafter set forth; and WHEREAS, the City Council deems it to be in the best interest of the citizens of Yakima to enter into the attached D.A.R.E. Program Agreement, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized and directed to execute the attached contract entitled "D.A.R.E. PROGRAM INTERLOCAL COOPERATION AGREEMENT WHEREAS Toppenish School District No. 202 desires to continue providing Drug Abuse Resistance Education (D.A.R.E.) to its students, and WHEREAS the City of Toppenish has no personnel available for this purpose, but has arranged to provide qualified personnel through the Police Department of the City of Yakima, Washington according to the proposal attached hereto, marked as Exhibit "A", and WHEREAS the Toppenish School District, the City of Toppenish and the City of Yakima intend to render to each other the maximum cooperation possible to accomplish the purposes set forth above, and wish to interchange mutual aid for these purposes. NOW THEREFORE, on condition that said grant application is funded, it is agreed as follows: Section 1. The Yakima Police Department shall provide a qualified duly commissioned police officer for a minimum of sixteen (16) hours per week of class time, at the Toppenish School District, in such classrooms as shall be designated by the School District, for 17 weeks commencing in January 1995. The officer, to be known as the D.A.R.E. officer, shall exercise his best efforts to educate the students he is assigned to in the recognized methods of resisting drug abuse. Section 2. The Toppenish School District and the City of Toppenish shall provide all training materials required for the students enrolled in the program to be presented by the D.A.R.E. officer. Section 3. The City of Toppenish shall compensate the City of Yakima for providing an officer as above stated by paying the sum of $9,136.00, except that any additional time requested by the School District and approved by the Toppenish Police Department will be paid by the School District to the City of Toppenish and reimbursed to the City of Yakima at the rate of $27.00 per hour and $10.00 per travel day. Section 4. It is understood that unless adopted plans or agreements dictate otherwise, all services and/or resources provided under the terms of this Agreement are furnished and supplied voluntarily and at the discretion of the furnishing agency. The furnishing agency shall have the primary interest of protecting the welfare of its own constituency and does not assume any responsibilities or liabilities in not providing resources and/or services to other parties of this Agreement. Each party to this Agreement waives all claims against the other party or parties for compensation for any loss, damage, personal injury, or death occurring in consequence of the performance of this Agreement. Section 6. Mutual Aid extended pursuant to this Agreement shall be furnished in accordance with the provisions of Chapter 38.52 RCW, as well as other provisions of law. Section 7. This Agreement shall be effective as to each party when the governing body of each such party has approved the same. The term of this Agreement shall be from the date effective, as to each party until the completion of the D.A.R.E. program, but in any event shall terminate on June 15, 1995. Program Services SUBMITTED BY: Pleas Green, Chief of Police Ray Paolella, City Attorney CONTACT PERSON/TELEPHONE: Pleas Green, Chief of Police 575-6061 SUMMARY EXPLANATION: The Toppenish Police Department has offerred the Drug Abuse Resistance Education (D.A.R.E.) program in the Toppenish school system for several years. Recently, their only trained D.A.R.E. instructor left their employment. In order to fill the gap during the 1994-95 school year, until a new instructor can be trained, Toppenish has requested the assistance of the Yakima Police Department. The attached contract provides an agreement between the City of Yakima and the Toppenish Police Department and School District to provide trained instructors to teach the Drug Abuse Resistence Education (D.A.R.E.) curriculum to Toppenish elementary school students during this interim period. This temporary mutual aid can be provided without impacting local service levels, and the actual cost of this service (time and materials) will be reimbursed to the City of Yakima by the Toppenish School District.
