The City Council met in session at 1:30 P.M. on this date in the Conference Room at Yakima
City Hall. -
Councilmen present at the meeting we're Mayor Bert Broad, Wray Brown, Howard C. Cole, Betty
L. Edmondson, Ralph Holbrook and Don Schussler. Also present were City Manager, Craig -
McMicken; Personnel Director, Bob Hilsmann; City Clerk, Jack Daniel; and Jim Bowers, repre-
senting the press. .
City Manager McMicken informed the Council that he would have a paper ready on Friday,
May 4, 1973, relating to the next meeting on regional planning. He discussed the possible
future Mead Avenue Annexation to Union Gap and the fact that the Planning Department is
preparing,a recommended City position on this issue which will be reviewed on Friday,
May 4, 1973. .
City Clerk, Jack Daniel, reviewed the CH2M and Battelle proposals to conduct an economic
feasibility study relating to the potential for an air cargo capability in Yakima. The
Council concurred in the recommendation that the Battelle study referred to the Avia-
tion Committee for its review and comment and that it be suggested to the Aviation Commit-
tee that the petitioners and the County share in the cost of the..study. •
The City Manager and Personnel Director briefed the Council on the status of EEA funding.
It was pointed out that funding would continue through June 1974 on a steadily decreasing
basis and that an additional had been made available which could be used to estab-
lish a short -run special employment program. Mr. .Hilsmann recommended that the funds be
used to automate the park irrigation system. ' •
At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the
meeting, Mayor Broad presiding7,,Councilmen Brown, Cole, Edmondson, Holbrook and Schussler,
City Manager McMicken and City Attorney Andrews present on roll call. Councilman Whitaker
being absent on roll call, it was MOVED by Brown, seconded by Schussler that Councilman
Whitaker be excused: carried, Broad, Brown, Cole, Edmondson, Holbrook and Schussler voting
aye by voice vote. .
The Invocation was given by Councilman Ralph Holbrook. .
The minutes of the adjourned regular meeting of April 20, 1973, and the regular meeting of
April 23, 1973, having been duly certified accurate by two Councilmen, and no one present -
wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as
recorded.
Resolution No. D -2051, commending Mr. Eugene Shields services performed during his
term on the Planning Commission, being read in full at this meeting, it was MOVED by
Schussler, seconded by Brown that said Resolution be passed: carried, Broad, Brown, Cole,
Edmondson, Holbrook and Schussler voting aye on roll call. •Whitaker absent. Mr. Shields
was presented with this Resolution by Mayor Broad. Mr. Ellis Cummins, Planning Commission,
being present, expressed appreciation for Mr. Shield's services on behalf of the Planning
Commission.
RESOLUTION NO. D -2051, A RESOLUTION of appreciation and commendation for the services per-
formed by Eugene L. Shields during tenure member and chairman of the City
Planning Commission, 1962 - 1972; - -
Eugene L. Shields has served as a member of the Planning Commission since August 1962 and,
at all times during his tenure of office, has accepted his responsibilities and performed
his duties conscientiously and in a highly commendable manner; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Council of the City of Yakima, acting on behalf of all citizens of the City,
does hereby express its sincere appreciation to Eugene L. Shields and commends him for his
conscientious service to the City of Yakima during his tenure as . a member and chairman of
the Yakima City Planning Commission.
This being the time set for the Hearing' on the Hotel /Apartment Safety- Ordinance.,
Chief Building Inspector, Newell Pock, reported that this Ordinance would cover those.
existing apartment houses and hotels having two or more stories and with four or more units.
He showed slides of buildings in Yakima which presently not in compliance with the
provisions of the proposed Ordinance on number of exits, stairways; corridors,. fire alarm
systems, doorways, openings and ventilation. City Fire Marshall, Ed Lexa, reported on the
earlier meeting with owners of apartments and hotels on March 7, 1973, and referred to the
changes in the Ordinance which were suggested at that time,. Mr. Fred Velikanje, Attorney
representing Mr. Ted Mellotte and other owners of apartments and reported that
some owners will have to close their buildings, since they would not be able to pay the
costs necessary to meet the proposed requirements. He emphasized the fact that rents will
need to be raised in many buildings where some persons are not able to pay more than $50
per month. Mr. Velikanje requested that the Council take time to see how these require-
ments will work out practically. Mr. Ted Mellotte, being present, stated that he felt the
proposed Ordinance requirements would involve too much expense to older buildings needing
to come up 'to minimum standards and expressed his opposition to the structural changes
which would be necessary. Others present and speaking to the matters of the cost involved,
units covered by the Ordinance and increased rents were Mr. Gordon Spencer, Gaylord Newby,
Norman Goll, and Bill Cahoon. Councilmen Schussler, Cole., Brown and Edmondson expressed
their approval of this Ordinance in light of the two previous hearings held for public
input on this matter and the safety of everyone living in these buildings being the prime
concern. After due discussion,'it was MOVED by Schussler, seconded by Brown that Ordinance
No. 1517, adopting the proposed safety standards for hotels, apartments and motels, be
passed: carried, Broad, Brown, Cole, Edmondson, Holbrook and Schussler voting aye on roll
call. Whitaker absent.
ORDINANCE NO. 1517, AN ORDINANCE relating to building code requirements; adopting regula-
tions applicable to existing apartment houses, hotels and motels and requiring alterations
to existing non conforming buildings; providing a penalty for violations; adopting Chapter
11.13, "Apartment House and Hotel Safety Code ", consisting of Sections 11.13.010,

11.13.015, 11.13.020, 11.13.030, 11.13.040, 11.13.050, 11.13.060,11.13.070, 11.13.080,
11.13.090, 11.13.100, 11.13.110, 11.13.120, 11.13.130, 11.13.140, 11.13.150 and 11.13.160,
and repealing Sections 10.24.010, 10.24.020, 10.24.030, 10.24.040, 10.24.050, 10.24.060,
10.24.070, 10.24.080, 10.24.090 and 10.24.100, all of the City of Yakima Municipal Code.
A Damage Claim having been filed with the City Clerk on April 20, by the Webb Tractor
Company, in the'amount of $1,402.52, for water damages from a broken pipe, it was MOVED by
Schussler, seconded by Cole that said Damage Claim be referred to the City Manager and -
Staff for study and recommendation: carried, Broad, Brown, Cole, Edmondson, Holbrook and
Schussler voting aye by voice vote. Whitaker absent. -
It was MOVED by Schussler, seconded by Cole that Ordinance No. 1518, fixing the time of
delinquency and providing for the payment of the unpaid portion of L.I.D. No. 985, 1972
Street and Alley Paving District, be passed: carried, Broad, Brown, Cole, Edmondson,
Holbrook and Schussler voting aye on roll call. Whitaker absent.
ORDINANCE NO. 1518, AN ORDINANCE fixing the time of delinquency of installments of assess-
ments levied for the payment of the cost of the improvement in Local Improvement District
No. 985, and providing for the issuance of bonds with coupons attached for the payment of
the unpaid portion thereof.
Mrs. Robert Pearson, being present, related an incident in connection with her water billing
whereby a payment became lost in the mail and was not received. She stated that the water
was turned off before she had sufficient time to find out what had happened to the payment
which was mailed and that an extra charge of $5 was made. Mrs. Pearson asked for a policy
which would allow for situations in which a person is unaware that a payment was never
received and could be .given more time before the water is shut off. After due discussion,
it was suggested that Mrs. Pearson pay the $5 charge and file a damage claim in the same
amount, which she agreed to do.
It was MOVED by Schussler, seconded by Brown that Resolution No. D -2052, authorizin a

ment of $4.32 to Jeanne R. Crawford for damages to a hop basket, be passed: carried,
Broad, Brown, Cole, Holbrook and Schussler voting aye on roll call. Edmondson voting nay
on roll call. Whitaker absent. . .
RESOLUTION NO. D -2052, A RESOLUTION authorizing payment of a claim for damages filed by
Jeanne R. Crawford. ..
It was MOVED by Schussler, seconded by Brown that Resolution No. D -2053, authorizing pay -
ment of $55.95 to Raymond A. Turner, Yakima Police Officer, for damges to wristwatch, eye
glasses and handcuffs, be passed: - carried, Broad, Brown, Cole, Edmondson, Holbrook and
Schussler voting aye on roll call. Whitaker absent.
RESOLUTION NO. D-2053, A RESOLUTION authorizing payment of a claim for damages filed by
Raymond A. Turner, Yakima police officer. .
City Manager McMicken referred to the matter of selling surplus swimming pool' bags to the
City of Ellensburg, stating that these bags are no longer used due to a change in the
locker system. After due discussion, it was MOVED by Cole, seconded by Schussler that
Resolution No. D -2054, authorizing the sale of said bags, be passed: carried, Broad, Brown,
Cole, Edmondson, Holbrook and. Schussler voting aye on roll call. Whitaker absent.
RESOLUTION NO. D- 2054, A RESOLUTION declaring swimming pool bags owned by the City to be
surplus property, and authorizing their sale to the City of Ellensburg,'Washington.
City Manager McMicken referred to an off - the - agenda item concerning a letter agreement with
the County for the construction of a sanitary sewer to serve the property north of Summit -
view and east of 56th Avenue. He stated that the County would construct the sewer as part
of a Summitview widening project at a cost to the City of $10,000 to be paid from the
Water -Sewer Fund. After due discussion, it was MOVED by Schussler, seconded by Brown that
the letter agreement for this project be approved: carried, Broad, Brown, Cole, Edmondson,
Holbrook and Schussler voting aye by voice vote. Whitaker absent. .
City Manager McMicken requesting authorization for out -of -state travel for Glen Pleasant
and Hal Kensler, Traffic Division, to travel to Vancouver, B.C. to attend the Northwest
Section meeting of the International Municipal Signal Association,' May 4, 1973 - May 6,
1973, it was MOVED by Cole, seconded by Holbrook that said travel be approved and expenses
paid: carried, Broad, Brown, Cole, Edmondson, Holbrook and Schussler voting aye by voice
vote. Whitaker absent.
There being no further business to come before the. Council', it was MOVED by Holbrook,
seconded by Cole that this meeting be adjourned to Friday, May 4, 1973, at the hour of
12:00 Noon, to then meet at the Flight Deck Restaurant in the Yakima Air Terminal: carried,
Broad, Brown, Cole, Edmondson, Holbrook and Schussler voting aye by voice vote. Whitaker
absent.
