R-94 -153 A RESOLUTION authonzmg an Interfund Loan from the 551 - Equipment Rental Fund, to the 333 -Law & Justice Capital Fund, and providing for repayment. WHEREAS, the Equipment Rental Fund has sufficient resources available for investment to make the Interfund Loan authorized by this Resolution, and WHEREAS, funds must be loaned to the 333 -Law & Justice Capital Fund in order to provide for cash flow requirements on the construction of the Police/Legal Center; now, therefore, BE E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: A loan of up to $1,050,000 may be borrowed m whole or in part only at such time as it becomes necessary to complete the project. The interest rate shall be the Current Maturing Three-year Treasury Note at the time of each draw, and each draw on the loan shall be repaid with principal and interest within three years from the borrowing date. Repayment shall be made from the Law and Justice Capital and General Funds. RE: Police Station / Legal Center Yakima, Washington Architecture • Associates • A.I.A. / P.S. has contacted the reference sources submitted to our firm by Cree Construction Co., Inc. including their bonding company, project owners, project managers and subcontractors who have worked with them on recent construction projects. The responses received were very similar and present a consistent profile of the type of construction firm that they represent. The references contacted indicated that Cree Construction is a quality firm that provides a good, finished product. The on-site administration varies in quality based on the individual superintendent employed by the firm. Cree Construction does a good job of coordinating their subcontractors and material suppliers, but is often lax about staying on top of the construction schedule and submitting updated schedules that accurately represent the progress of the work. Cree Construction Co., Inc., by their approach to administration of the construction project, demands a significant amount of time to respond to clarifications of the documents, requests of changes in the work, change orders and items of minor significance. The five construction projects referenced by Cree Construction did not meet the original construction schedule for Owner occupancy and were extended two to four months beyond the original time lines. The reasons for extensions varied from weather delays to problems associated with unknown site conditions. In every case, the extensions were justified according to the references contacted. Liens were filed on two of the projects. Cree Construction Co., Inc. is presently in a lawsuit with a subcontractor on another project. In all cases, the Owners have verified that the responsibility has been the subcontractor's failure to perform or provide labor and materials as drawn and specified by the Contract Documents and that Cree Construction has acted properly on the Owner's behalf. To date, the Owners have not been involved legally with either the subcontractors or Cree Construction over any disputes arising from any of the referenced construction projects. Ron B Cullen, A.I.A. November 18, 1994 Mr. Zais City of Yakima Page 2 The bonding company, Bush, Cotton, Thompson & Scott, Inc. representing Cree Construction for the past twenty years, indicates that they are a well respected construction company and have a bonding capacity of $10 million for individual projects and $30 million for aggregate projects. The bonding company has indicated that, to the best of their knowledge, there are no pending lawsuits to be filed against Cree Construction Co., Inc. by any Owner for whom their company has been the General Contractor. Based on the information obtained from the reference sources, Architecture • Associates • A.I.A. / P.S. recommends that the City of Yakima proceed with entering into an agreement with Cree Construction Co., Inc. of Lynnwood, Washington, to construct the new Police Station / Legal Center.
