APRIL 23, 1973
The City Council met in regular session at 1:30 P.M. on this date in the Conference Room
at Yakima City Hall.
Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Howard C. Cole, Betty
L. Edmondson, Ralph Holbrook, Don Schussler and Bill Whitaker. Also present were City
Manager, City Attorney, Fred Andrews; and City Clerk, Jack Daniel.
City Manager McMicken reported on his and Mayor Broad's trip to Olympia to participate in
the Governor's Conference on Community Development. He reviewed the subject which was
discussed, the "Better Communities Act."
At 1:50 P.M. the Council toured the site of the recently completed Yakima Avenue Railroad
Crossing and the Community Bond Center.
At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the
meeting, Mayor Broad presiding, Councilmen Brown, Cole, Edmondson, Holbrook, Schussler
and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call.
The Invocation was given by Councilman Wray Brown.
The minutes of the regular meeting of April 16, 1973, having been duly certified accurate
by two Councilmen,. and no one present wishing to have said minutes read publicly, Mayor
Broad declared said minutes approved as recorded.
This being the time set for the Hearing on the Rezone Application filed by the Yakima
Tennis Club, requesting rezone of property located between 40th Avenue and the existing
tennis club facilities, Planning Director, Jay Otto, reviewed the Staff Report on this
subject dated March 27, 1973, and the Planning Commission Minutes dated April 3, 1973. He
explained the plans for landscaping, parking, maintenance and sight screening and further
stated a desire to have any future lighting directed away from the adjoining properties.
Mr. Otto recommended approval of this application to Planned Development zoning for the
seven additional tennis courts intended for this site, subject to the following provisions:
1. Parking area and driveway should be hard surfaced.
2. If tennis courts are to be lighted, such lighting is to be submitted to the
Planning Staff for approval.

Present in the audience and speaking to the matter of paving for the access road was Mr.
Jess Chisum. After due discussion, it was MOVED by Brown, seconded by Edmondson that
Ordinance No. 1514, accepting the recommendation of the Planning Commission and zoning
said property, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook and Whitaker
voting aye on roll call; Schussler abstaining on roll call.
ORDINANCE NO. 1514, AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property situated between North 40th Avenue and existing Yakima Tennis
Club facilities in the City of Yakima, Washington, from R -1, Single Family Zone, to
Planned Development Zone.
This being the time set for the Hearing on the Rezone Application filed by George Corbett,
requesting the rezone of property located at 202 -216 North Fourth Avenue from R -3, Multiple
Family Zone to B -3, General Business Zone, Planning Director, Jay Otto, reviewed the Plan-
ning Staff Report on this subject dated March 22, 1973 and the Planning Commission Minutes
dated April 3, 1973. . Mr. Otto reported that this area is intended for the development of
a Safeway store•on the entire block. He further stated that this area is indicated as a
part of the Central. Business District Support Area. After due discussion, it was MOVED by
Whitaker, seconded by Cole that Ordinance No. 1515, accepting the recommendation of the
Planning Commission and zoning said property, be passed: carried, Broad, Cole, Edmondson,
Holbrook, Schussler and Whitaker voting aye on roll call; Brown abstaining on roll call.
Present in the audience and speaking to this matter was Mr. Bud Applegate.
ORDINANCE NO. 1515, AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property situated at 202 -216 North 4th Avenue in the City of Yakima,
Washington, from R -3, Multiple Family Zone, to B -3, General Business Zone, and declaring
an emergency.
This being the time set for the Hearing on the Rezone Application filed by George Corbett,

Avenue, from B Street to Lincoln Avenue, th•i`s Hearing having been continued from April
9, 1973, Planning Director, Jay Otto, reviewed the Planning•Commission Minutes on this
subject dated April 3, 1973. He stated that the vacation•of this alley is in connection
with the development of the Safeway store on Fourth Avenue. Mr. Otto referred to those
utilities located along the length of the alley, which serve customers to the north and
south and reported that the Planning Staff recommends the approval of this vacation, with
the following additional recommendations:
1. A 20 -foot wide utility easement is retained for maintenance of existing utilities
or;
2. All existing utilities are relocated at the expense of the developer to the total
satisfaction of all concerned.
3. An occupancy permit is not issued by the City Building Inspection Department until
the developer complies with one of the above requirements.
Present in the audience and asking questions in regard to moving the existing easements
was Mr. Bud Applegate. City Attorney, Fred Andrews, briefly explained the procedure that
would need to be followed in relocating the existing utility easements. After due discus-
sion, it was MOVED by Cole, seconded by Schussler that Ordinance No. 1516, providing for
the vacation of said alley, be passed: carried, Broad, Cole, Edmondson, Holbrook,
Schussler and Whitaker voting aye on roll call.

A Damage Claim having been filed with the City Clerk on April 17; 1973, by Gary and Linda
Birch, in the amount of $25.67, for water damage to their kitchen, it was MOVED by
Schussler, seconded by Brown that said Damage Claim be referred to the City Manager and
Staff for study and recommendation: carried, Broad, Brown, Cole, Edmondson, Holbrook,
Schussler and Whitaker voting aye by voice vote. .. • .
Parks Director, Bill Hutsinpiller, being present, reviewed the Parks and Recreation Commis
sion Minutes dated April 10, 1973, and the Priority Projects list and memo.on this subject
dated. April 12 and 16, 1973. There was considerable discussion,by the Council on projects
which might be added to the list in the future. After due discussion, it was MOVED by
Whitaker, seconded by Schussler that the Parks and Recreation Commission report regarding
priority park projects be referred to the City Manager for study._ After further discus -.
sion and a request by Councilman Cole that the matter of beautification to the. areas at
16th and Tieton Drive and 16th and Nob Hill be also referred, it was MOVED by Whitaker,
seconded by Cole that the motion be amended to include the beautification of those areas
used by the Y.V.T. at 16th and Tieton and 16th and Nob Hill: carried, Broad, Brown, Cole,
Edmondson, Holbrook and Schussler voting aye by voice vote; Whitaker voting nay by voice
vote. Mayor Broad then called for the vote on the original motion: .carried, Broad,
Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote.

It was MOVED by Cole, seconded by Brown that Resolution No. D -2048, authorizing the sale
of surplus city vehicles at an auction, be passed: carried, Broad, Brown, Cole, Edmondson,
Holbrook, Schussler and Whitaker voting aye on roll call. City Manager McMicken explained
that five vehicles had been removed from the auction sale list which are to be used by the
Parks and Recreation Department in their summer recreation program.
RESOLUTION NO. D -2048, A RESOLUTION authorizing the sale at public auction of surplus
personal property owned by the City. .
City Manager McMicken referred the matter of the food program for the summer day camps to
Parks Director, Bill Hutsinpiller, who briefly explained the food program procedures.
III After due discussion, it was MOVED by Schussler, seconded by Edmondson that Resolution No. -
D -2049, authorizing application to the federal government for funding of said program, be
passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting
aye on roll call. -

RESOLUTION NO. D -2049, A RESOLUTION authorizing the City Manager of the City of Yakima to
apply to the United States Department of Agriculture for a summer camp program.
City Manager McMicken referred the matter of Security Fencing at the Yakima Air Terminal
to Director of Services, Jack Daniel, who reported that a grant offer had been received
from FAA on this date and that,the bid opened on April 17 -, 1973 was approved by FAA.
After due discussion, it was MOVED by Brown, seconded by Schussler that Resolution No.
D -2050, authorizing the acceptance of the grant offer, be passed: carried, Broad, Brown,
Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call.
RESOLUTION NO. D -2050, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute acceptance of a grant offer by the Department of
Transportation, Federal Aviation Administration, for Yakima Air Terminal development.
City Manager McMicken reported that one bid only was received and considered the bid
board on April 17, 1973, for the Yakima Air Terminal Security Fencing Project, as follows:
San Jose Steel Company, Seattle $11,866.05
Director of Services, Jack Daniel, recommending that the bid be awarded to the San Jose
Steel Company, who submitted the only bid, which was well below the Engineer's estimate, •
it was MOVED by Schussler, seconded by Cole that the bid be awarded to the San Jose Steel
Company in the amount of $11,866.05 and that the City Manager be authorized to enter into
contract with said contractor upon the filing of the proper bond and insurance: carried,
Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote.
City Manager McMicken referring to the certification by the City Engineer of the completio
of work and recommendation that the work be accepted and final payment made on the South
First Street & Mead Avenue & Others Sanitary Sewer, it was MOVED by Schussler, seconded by
Holbrook that the Report of the City Engineer dated April 18, 1973, with respect to the
completion of the work on said Public Works Contract be approved, the work be accepted and
payment of the final.,estimate therein set forth is hereby authorized: carried, Broad,
Brown, Cole, Edmondson, Holbrook, Schussler a.nd Whitaker voting aye by voice vote.
Mayor Broad requesting approval for out -of -state travel to San Francisco, California, to
attend the U. S. Conference of Mayors, June 16, 1973 - June 20, 1973, it was MOVED by
Cole, seconded by Whitaker that said travel be approved and expenses paid: carried, Brown,
Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. Broad
abstaining.. -
There being no further business to come before the Council, it was MOVED by Cole, seconded
by Holbrook that this meeting be adjourned to Friday, April 27, 1973, at the hour of 12:00
Noon, to then meet at the Flight Deck Restaurant in the Yakima. Air Terminal: carried,
Broad, Brown, Cole, Edmondson', Holbrook, Schussler and Whitaker voting aye by voice vote.
