A RESOLUTION approving, subject to several conditions, the final plat of the
Yakima Gateway Center for 10 commercial lots in the
northwest quadrant of the area divided by Interstate 82 and
Yakima Avenue, submitted by First Western Development
Services, Inc. on behalf of Gary D. Lukehart and Mary M.
Lukehart; and authorizing the Mayor to sign the final plat for
the Yakima Gateway Center
WHEREAS, this Council has previously reviewed and, subject to certain
conditions, generally approved the Mater Application for the proposed Yakima
Gateway Center by Resolution R-94-109 approving the preliminary plat for the
Yakima Gateway Center and generally approving the release of easements
benefiting the City of Yakima within the boundaries of the proposed Yakima
Gateway Center, and by Ordinance No. 94-43 vacating existing dedicated right of
way and streets within the boundaries of proposed Yakima Gateway Center, and
WHEREAS, the proposed Yakima Gateway Center lies adjacent to and is in
many respects integrally related to the Yakima Gateway Interchange project
being conducted by the City and the Washington Department of Transportation
which will construct extensive improvements to Interstate 82 and will develop
and extend Fair Avenue on a new alignment; and
WHEREAS, the City has, in conjunction with the Washington State
Department of Transportation, devoted substantial resources to planning and
preparation for construction of the Yakima Gateway Interchange project for
improvements to Interstate 82 in the immediate vicinity of the proposed Gateway
Center, and the Gateway Center plans have been incorporated in and are integral
to planning for the Gateway Interchange project; and
WHEREAS, First Western Development Services, Inc , on behalf of Gary D.
Lukehart and Mary M. Lukehart (hereinafter referred to as "Applicant") has
submitted for review a proposed final plat of the Yakima Gateway Center,
consisting of 2 sheets dated September 2, 1994, showing 10 commercial lots zoned
CBDS in the northwest quadrant of the area divided by Interstate 82 and Yakima
Avenue, and
WHEREAS, this Council finds, based on reports of the Planning Division of
the Department of Community and Economic Development, the City Engineer and
the City Attorney, and other statements and information which have properly
been presented to Council, that the proposed final plat of the Yakima Gateway

Center complies with the terms and conditions of Resolution No. R-94-109, and is
consistent with the goals, objective and intent of the Yakima Urban Area
Comprehensive Plan and the standards of the Urban Area Zoning Ordinance, and
with other applicable land use controls; and
WHEREAS, the Applicant has promised to dedicate the property shown as
Tract A on the proposed final plat to the City of Yakima and the State of
Washington Department of Transportation for right of way in conjunction with
the Gateway Interchange Project, and
WHEREAS, pursuant to RCW 58.17 130 and YMC 14 25 140 the Applicant has
posted a satisfactory bond in favor of the City of Yakima to ensure proper
completion of public improvements, and
WHEREAS, at its public meeting on August 23, 1994, each Council member
declared that he or she had had no contact with either the applicant or opponents
of the preliminary plat, and as this final plat comes before Council for review
each member declares that he or she has had no contact with either the applicant
or opponents of the final plat, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA.
The proposed final plat for Yakima Gateway Center, consisting of 2 sheets
dated September 2, 1994, showing 10 commercial lots zoned CBDS in the northwest
quadrant of the area divided by Interstate 82 and Yakima Avenue, is hereby
approved and the Mayor is hereby authorized to sign the final plat. The final plat
for Yakima Gateway Center shall be filed for record immediately, or as soon as
possible, by the Applicant in the Yakima County Auditor's Office, and the
Applicant shall be responsible for all filing fees.
