A RESOLUTION granting a Shoreline Substantial Development permit to
the Yakima Greenway Foundation.
WHEREAS, The Yakima Greenway Foundation has applied to the city of Yakima
for a Shoreline Substantial Development for the construction of a 3.5 mile asphalt
bike/pedestrian pathway, a 47 space parking lot at 16th Avenue and a 37 space
parking lot at Myron Lake; and
WHEREAS, after due and proper notice a public hearing was held before the
Yakima Hearing Examiner on May 26, 1994 for the purpose of reviewing the
aforementioned application under the terms of the Washington State Shoreline
Management Act and the Yakima County Shoreline Master Program; and
WHEREAS, each participating council member declared on the record that he or
she had no prehearing exparte contacts with any proponent or opponent of the
application, and;
WHEREAS, the City Council has considered the proposal and the Hearing
Examiner's Decision in relation to the Washington State Shoreline Management
Act, and the Yakima County Shoreline Master Program, and;
WHEREAS, the City Council has determined, based on the Hearing Examiner's
Decision determined that the proposal satisfies the above-mentioned Shoreline
standards and policies, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The findings, conclusions and conditions found the attached and incorporated
Hearing Examiner Decision are hereby adopted and the Director of Community
and Economic Development is hereby authorized and directed to issue the
Shoreline Substantial Development Permit which is subject to review by the
Department of Ecology and the Attorney General.
Adopted by the City Council this 19th day of July, 1994.
