A RESOLUTION accepting and approving the Quarterly Insurance Claims
Report.

WHEREAS, the City self insures as to claims, and
WHEREAS, the attached Quarterly Insurance Claims Report contains
information on the various claims submitted to the City along with the disposition
thereof, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAXIMA:
The attached and incorporated Quarterly Insurance Claims Report, together
with all payments and disbursements disclosed therein, is hereby accepted,
approved, affirmed, and ratified.

ITEM TITLE: Consideration of Motion adopting Claims Settlement Policy and Form
Resolution for approving Quarterly Insurance Claims Reports.

SUMMARY EXPLANATION: Attached is a proposed Motion, Claims Settlement Policy,
and Form Resolution approving Quarterly Insurance Claims Reports. This Claims
Settlement Policy has been drafted to memorialize and clarify the procedures used by
the City Council in considering proposed settlements of claims litigation. The attached
Claims Settlement Policy would be the procedure used by the City Council, pending
future revision and modification as new case law/statutory amendments occur.

CLAThiS SETTLEMENT POLICY
1. The Yakima City Council recognizes that settlement of litigation is
a very sensitive matter. Disclosure of information regarding such negotiations,
particularly during the performance of those agreements, could work to the city's
financial disadvantage. The Council must attempt to balance the public's right to
know against the public's right to insist upon prudent settlement of claims to the
greatest financial advantage of city tax payers.
2. The Council will meet in executive session for the purpose of
discussing with its attorney any anticipated or pending litigation. The substance of
those conversations will be held in confidence as attorney-client privileged
communication.
3. The Council may authorize its attorney, during executive session, to
make specific offers to settle pending claims. The minutes of the executive session
should reflect the fact of authorization but not the details of the specific offer.
4. If the Council authorizes an offer of settlement which is accepted 'by
the other party, the final agreement between the parties may be reduced to writing.
If so, the writing itself will be disclosed by the City Council at such time as that can
be done without financial or legal disadvantage to the City of Yakima
5. The Council intends to affirm, approve or ratify and to disclose the
terms of settlement of pending disputes in open public meeting; except, such
disclosure may be delayed to a time when such disclosure can occur without the
danger of financial disadvantage to the city. This information will normally be
contained within the quarterly insurance claims report; however, if appropriate, a
specific resolution for this purpose may be adopted.
