RESOLUTION NO. R-94-54
A RESOLUTION authorizing and directing the City Manager and the City
Clerk of Yakima to execute an agreement with the
Department of Housing and Urban Development for
funding for the Home Entitlement Program
WHEREAS,the United States Department of Housing and Urban
Development has funds available to Yakima in the amount of $416,000 to
assist its citizens to preserve and improve the existing housing stock and
provide affordable housing, and
WHEREAS,the City Council of the City of Yakima deems it to be in
the best interests of the City that it enter into an agreement for funding
for the purpose mentioned above, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager and City Clerk of the City of Yakima are hereby
authorized and directed to execute the agreement with the United States
Department of Housing and Urban Development for funding in the amount of
$416,000 for the Home Entitlement Program

A RESOLUTION authorizing and directing the City Manager of the City of
Yakima to file an application with the United States
Department of Housing and Urban Development for funding
of the 1994 HOME Entitlement Grant
WHEREAS, the City of Yakima contemplates a Rental
Rehabilitation Program for which federal funding is available from the United
States Department of Housing and Urban Development, and
WHEREAS, the City Council of the City of Yakima deems it to be
in the best interest of the City that an application be filed for funding for the
purpose mentioned above, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
R.A. Zais, City Manager of the City of Yakima, is hereby authorized and
directed to execute and file the attached application documents, including all
understandings and assurances contained therein, with the United States
Department of Housing and Urban Development for funding for the purpose
mentioned above; and he further is hereby designated as the official
representative of the City to act in connection with that grant request and to
provide such additional information as may be required.

Dear Mr. Zais:
The 1994 HOME Program Description submitted by the city of Yakima
has been reviewed by our staff and approved. Consequently, I: am pleased
to transmit to you the 1994 HOME Investment Partnership Agreement in the
amount of $416,000.
We have added to the city's original submissions your updated
certifications which relate specifically to the HOME program.
Enclosed is the Partnership Agreement which constitutes the
contract between the Department of Housing and Urban Development and
Yakima. You should note particularly any special conditions included i
Item 11 of the Agreement. Failure to execute and return two copies of
the Agreement within 60 days of the transmittal date may be deemed to
constitute rejection of the agreement and cause for HUD to determine
that the funds are available for reallocation to other participating
jurisdictions.
Allocations for the HOME Program will be managed through a Cash and
Management Information System (HOME C/MIS). The HOME C/MIS will
disburse program funds as well as collect homeowner and tenant data to
monitor- compliance with many of the statutory and regulatory HOME
Program requirements.
In order to establish a Line of Credit for the Fiscal Year 1994
grant, it will be necessary for you to execute and return two copies of
the Grant Agreement. In. addition, if there is a need to delete or add
individuals authorized to access the Voice Response System (VRS), a VRS
Security Access Authorization Form (HUD -27054) must be prepared,
notarized, and returned to the address on the form. A separate HUD -
27054 should be completed for each individual you wish to authorize to
request payments through the Voice Response System. You should have at
least two persons authorized to access the system and -request funds.
The HUD -27054s should be returned. to the address on the form,.
Also, if there is a need to establish or change the depository
account to which these grant fundis are to be wired, a Direct Deposit
Sign -Up Form (SF -1199A) must be completed by you and your financial
institution and mailed to the following address:

Upon receipt of the SF -1199A, the HUD -27054s and the Agreement
executed by you, HUD will establish a Line of Credit in your name and
transmit to you the assigned Voice Response project number for this
Agreement.
Please note that the HOME C/MIS will automatically recapture
(deobligate) HOME funds in the HOME Investment Trust Fund Treasury
Account by the amount of:

2. Any funds not expended within five years after the last day of
the month in which the funds were obligated; and
3. Any penalties assessed by HUD under Section 92.551.
The date of obligation is the date HUD executed the HOME Investment
Partnership Agreement.
Also, certain activities are subject to the provisions of 24 CFR
Part 58 (Environmental Review Procedures for HUD programs). Funds for
such activities may not be obligated or expended unless the release of
funds has been approved in writing by HUD. A request for the release of
funds must be accompanied by an environmental certification.

Executive Summary
For the past eighteen years, the Office of Housing and Neighborhood
Conservation (OHNC) has successfully implemented a housing program for the
City of Yakima, Washington with entitlement block grant funds.
Participation by the City of Yakima in the HOME program will enable OHNC to
expand, as well as complement existing housing programs offered to community
residents.
Because the City of Yakima has been designated as a fiscally distressed area, a
50% reduction in match requirement funds of the HOME program will be
implemented. This is exhibited in the program's design and proposed activities.
These programs are demonstrative of the CHAS programs and efforts in both the
Annual and Five Year Plan.
A federal allocation of $416,000, the city's UDAG repayment funds of $42,000
and the State of Washington's Home funds of $42,000 will make up the total
budget of $500,000. The budget will disburse 10% of funds for administration,
15% for certified Community Housing Development Organization (CHDO) and
75% for other programs such as the purchase of a nonprofit elderly association
and the continuation of the city's rental rehabilitation program. All projects
specified benefit individuals at or below 80% of the median income.
The City of Yakima is enthused about obtaining entitlement status in the HOME
program and will be looking forward to a successful program in the coming
years.

Activity: Program administration funds will be used to pay for
staffing and operational costs of HOME program
activities.

(f) Administrative and Planning Costs; a participating
jurisdiction may expend for its HOME
administration and planning cost an amount of
HOME funds that is not more than ten percent.

Activity: Distribution of funds to certified CHDO"s for
implementation of affordable housing programs and
projects.
CHDO will be required to submit program design and
benefits derived from the requested funds. This will be
reviewed prior to program allocation.
Eligibility: 24 CFR Pare 92 Subpart G-Cornmunity Housing
Development Organizations
92.300 Set-aside for community housing development
organizations (CHDOs).
(a) For a period of 24 months after the allocation
(including, for a state, funds reallocated under
92.451(c)(2)(i) and, for a unit of general local
government, an allocation transferred from a state
under 92.102(b) is made available to a
participating jurisdiction, the participating
jurisdiction must reserve not less than 15 percent
of these funds for investment only in housing to be
developed, sponsored, or owned by community
housing development organizations.
Benefit: Development of low/moderate income family housing
units.
Description of Major Activities:
Type of Activity: Chestnut Manor Association
Funding Amount: $325,000
Matching Amount: $325,000 State Housing Trust Fund
Total $650,000
Activity: HOME program funds will be provided to the Chestnut
Manor Association for the purchase of the building
located at 27 South 4th Street, Yakima, Washington.
This purchase will assure long-term affordable rental
units to 46 elderly families.
Eligibility:

92.252 Qualification as affordable housing and income
targeting: Rental housing.
(a) Rent Limitation. A rental housing project
(including the non -owner -occupied units in
housing purchased with HOME funds in
accordance with 92.254) qualifies as affordable
housing under this part.
Benefit: Low/moderate, elderly family rental units.

Description of Mir Activities:
Type of Activity: Rental Rehabilitation
Funding Amount: $50,000
Matching Amount: $12,000 (Rental Rehabilitation Repayment Funds)
Total $62,000
Activity: HOME program funds will provide the matching monies
for the rehabilitation of privately owned rental units
occupied by low and moderate income community
residents. These funds will be repaid after the lender
loan is repaid for reuse in the program for future years.
Eligibility:
24 CFR Part 92 Subpart F -Project Requirements
92.251 Property standards.
(a) Housing that is assisted with HOME funds, at a
minimum, must meet the housing quality standard;
in 882.109 of this title. In addition, housing that is
newly constructed or substantially rehabilitated
with HOME funds must meet all applicable local
codes, rehabilitation standards, ordinances and
zoning ordinances.
92.252 Qualification as affordable housing and income
targeting: Rental housing.

housing purchased with HOME funds in
accordance with 92.254) qualifies as affordable
housing under this part.
