RESOLUTION NO. R-94- 27
A RESOLUTION declaring an emergency and authorizing the purchase of a
boiler for Lions Pool without calling for bids.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and Chapter
1 80 of the City of Yakima Municipal Code require the purchase of equipment
costing more than $25,000 00 to be accomplished by a call for bid, and
WHEREAS, said Charter provision allows the City Council to declare an
emergency thereby dispensing with the necessity for bids; and
WHEREAS, the City Council finds and declares an emergency exists because
of the following factors.
• A March 14, 1994 inspection on the Lions Pool boiler revealed
that an excessive number of sta) bolts were cracked and broken,
• The Lions Pool boiler stay bolts are critical to ensure that the
boiler does not come apart from internal pressures that are
generating when the boiler is operating and heating 215,000
gallons of pool water;
• There is a high risk that the boiler will suffer a catastrophic
failure in its present state,
• Operation of the existing boiler presents a significant threat to
public health and safety and must be replaced immediately, and
WHEREAS, the City Council finds it to be in the best interest of the City of
Yakima to declare an emergency to exist under the aforementioned Charter
terms, nov%, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to purchase from
Central Heating and Plumbing a new boiler for the Lions Pool for the purchase
price of $55,000 00 plus applicable taxes and to take all necessary and prudent
actions to cause this new boiler to be installed as soon as possible.
