A RESOLUTION authorizing the execution of a Mutual Aid Agreement with
certain Fire Protection Districts and Cities located in Yakima
Coiinty.
WHEREAS, the City of Yakima has previously entered into a Mutual Aid
Agreement with certain Yakima County Fire Protection Districts and Cities to
render to each other the maximum cooperation possible and the sharing of
personnel, equipment, and other resources, in order to provide emergency
medical and fire suppression services; and
WHEREAS, the City Council deems it to be in the best interest of the City of
Yakima to enter into the attached Mutual Aid Agreement, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and the City Clerk of the City of Yakima are hereby
authorized and directed to execute the attached Mutual Aid Agreement with
certain Yakima County Fire Protection Districts and Cities.

MUTUAL AID AGREEMENT
THIS AGREEMENT is entered into under the authority of RCW 52.12.031,
35.30.010, 35.22.280, and RCW Chapter 39.34; and
WHhREAS, each of the parties listed below owns and maintains equipment
for the suppression of fires and for emergency medical services; and
WHEREAS, each of the parties also retains personnel who are trained to
provide various levels of emergency medical services and fire suppression; and
WHEREAS, it is the intent of the parties to this Agreement to provide the
maximum possible protection for the lives and property of the citizens resident
within respective boundaries of the parties; and
WHEREAS, the parties intend to render to each other the maximum
cooperation possible in the sharing of personnel, equipment, and other
resources, in order to provide emergency medical and fire suppression services;
now, therefore,
The parties mutually agree as follows:
1. PARTIES. This Agreement is entered into between Yakima County
Fire Protection Districts 1, 2, 3, 4, 5, 6, 9, 11, 12, and 14, and Cities of Naches, Selah,
Tieton, Union Gap, Wapato, Granger, Toppenish, Sunnyside, Zillah, Grandview,
Mabton, and Yakima, municipal corporations of the State of Washington. This
Agreement shall commence on September 1, 1992.
2. REQUEST FOR ASSISTANCE. The Incident Commander of any party at
the scene of the emergency may request from other parties to this Agreement
fire fighting, emergency medical, and hazardous waste equipment and/or
personnel in excess of that immediately available to the Incident Commander
from his or her entity. Provided that, in his or her judgment, there is need for
such equipment or personnel.
3. RESPONSE TO REQUEST. Upon receipt of such a request, (mentioned in
paragraph 2) each party will endeavor to provide available personnel and
equipment subject to the following conditions:
A. Such assistance does not jeopardize or reduce the level of
protection necessary to carry out the entity's fire and emergency medical
protection responsibilities. No party to this Agreement shall be required to
make equipment or personnel available to any other party where by doing
so an unreasonable danger to the lives or property of that party's
community is likely to result.
B. Dispatch of available personnel and equipment shall be in
accordance with the operating plans and procedures established by the
Mutual Aid Response Plan, insofar as practical, a copy of which is on file in
the Administrative Office of Fire Station #1 of the City of Yakima. Said plan
may be amended from time to time by vote of the Joint Command Council
created in paragraph 10 herein.

G In the event the needed equipment and personnel are not
available, the responding entity shall immediately advise the requesting
party's dispatch center.
4. COMMAND RESPONSIBILITY AT EMERGENCY SCENE. The Incident
Commander shall be in command of the emergency and all equipment and
personnel sent to assist him or her regardless of origin.
5. TERMINATION OF SERVICE. The equipment and personnel of the
responding party shall be released from service and returned to the responding
Fire District or City by the Incident Commander when in his or her opinion,
conditions warrant.
6. INDEMNIFICATION. Each party hereto agree to be responsible and
assume liability in the performance of this Agreement for its own wrongful
and/or negligent acts or omissions, and those of its officers, agents, or employees
to the fullest extent allowed by law. Each party agrees to save, indemnify, defend
and hold all other parties harmless from any such liability.
7. INSURANCE. Each party agrees to maintain adequate insurance
coverage, or self-insurance in a minimum amount of one million dollars liability,
for its own equipment and personnel.
8. COMPENSATION. The parties agree that the added protection provided
to their citizens through pooled resource provided in this Agreement constitutes
adequate consideration for any costs or expenditure of equipment, personnel and
other resources incurred by the contracting parties. Except as otherwise
provided herein, no party shall be liable to another party, or parties, for any
expense of operation incurred in the performance of this Agreement.
9. NON-EXCLUSIVE AGREEMENT. The parties to this Agreement shall not
be precluded from entering into similar agreements for automatic first response
for emergency services with the other municipal corporations or fire districts.
10. ADMINISTRATION. There is hereby created a Joint Command Council
which shall be made up of one representative of each party to this Agreement.
The Council shall meet at the request of the President of the Yakima County Fire
Commissioners Association or by request of the President of the Yakima County
Fire Chiefs Association. The Joint Command Council shall administer the terms
and conditions of this Agreement, by majority vote of a quorum of the Council.
The President of the Commissioners Association and the President of the Fire
Chiefs Association shall jointly chair the Joint Command Council and abide by
"Robert's Rules of Order."
11. TERMINATION. This Agreement may be terminated by any party
giving to all other parties a thirty (30) day written notice of termination at the
addresses listed below. Termination by any party shall not affect the operation of
this Agreement as between the other parties.
12. INVALIDATION. In the event any portion of this Agreement is ruled
invalid by a court of competent jurisdiction, it is the intent of the parties that the
remainder of this Agreement remain in effect.

13. RESOLUTION OF DISPUTES. In the event a dispute or disagreement
arises among parties to this Agreement, an involved party may request a
mediation meeting by notifying one of the Presidents.
The mediators shall be the Presidents of the Fire Commissioners Association
and Fire Chiefs Association and one person at large selected by the two Presidents.
They will notify the parties involved and set the meeting date(s).
Should mediation fail, the Presidents will call a hearing of the Joint
Command Council, which as arbitrators will hear testimony regarding the dispute
and render a final binding decision by majority vote of Council members having
heard all sides to the controversy.
Entities refusing to abide by the Joint Command Council's final decision will
be removed from the Mutual Aid Agreement.
14. WHOLE AGREEMENT. This writing constitutes the entire agreement
between the parties.

FIRE COMMUNICATIONS SERVICES CONTRACT
PARTIES: CITY OF YAKIMA, hereinafter called "Yakima," and the CITY OF
UNION GAP, the CITY OF SELAH, hereinafter called "Cities," and
YAKIMA COUNTY FIRE PROTECTION DISTRICTS NO. 1, 2, 3, 4, 6,
9, 11, 12, and 14, hereinafter called "Districts."
RECITALS:
The City of Yakima has heretofore provided alarm services to the
Districts and Cities for the handling and processing of fire, alarm, and
emergency calls. The parties desire to enter into a contract for the continuation
of such services, now, therefore. for and in consideration of the covenants and
conditions hereinafter contained.
THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1. FIRE DISPATCH CENTER. Yakima shall continue to operate a central
facility to be known as the Fire Dispatch Center within the City of Yakima and
shall use the same for the purpose of receiving fire and emergency service calls
from the respective areas served by all of the parties hereto, and shall dispatch
fire apparatus of the appropriate party in answer to any such fire or emergency
calls and for the purpose of receiving and transmitting mutual aid calls among
the various parties hereto and for other related business.
2. AUTHORITY OF DISPATCH CENTER. It is agreed that the duty of
operating the Fire Dispatch Center and the complete management thereof is
vested in Yakima and that Yakima shall have the full, complete, and exclusive
authority to operate and manage such Fire Dispatch Center, including, but not
limited to, the authority to hire and fire employees and operators for such office.
3. EXPENSE OF MAINTENANCE AND OPERATION. The expense of
continued maintenance and operation of the Fire Dispatch Center, including
the expense of operating all telephone lines terminating at the Fire Dispatch
Center, and including the maintenance of equipment located within the Fire
Dispatch Center belonging to the Districts and/or Cities shall be borne by
Yakima.
4. TERM. This Contract is for a term of three (3) calendar years
commencing January 1, 1994. It shall terminate on December 31, 1996 at
midnight.
5. COST OF SERVICE. Yakima shall maintain a record of all the Districts'
and Cities' alarm calls, and each District and each of the Cities of Union Gap
and Selah shall be charged by Yakima for each call as stated herein. During
the calendar year 1994, the cost per alarm call shall be TWENTY DOLLARS
AND EIGHTEEN CENTS ($20.18). The cost per alarm call for 1995 and 1996
shall be adjusted effective January 1 of each year of the contract term to an

amount equal to the 1994 cost per alarm multiplied by a fraction, the
numerator of which shall be the Consumer Price Index published by the Bureau
of Labor Statistics of the U.S. Department of Labor for All Urban Consumers
(CPI -U) U.S. City Average for All Items, with a reference base period of 1982-
84=100 (Index) for the most recent month available immediately preceding the
January 1 adjustment, and the denominator of which shall be the same Index
published for the same month in 1993. If the U.S. Government ceases to
publish the Index on a 1982-84=100 reference base, the Index shall be
converted to the currently published standard reference base period in
accordance with the conversation factor published by the United States
Department of Labor, Bureau of Labor Statistics. If the Index is discontinued or
revised during the term, such other governmental index or computation with
which it is replaced shall be used in order to obtain substantially the same
result as would be obtained if the Index had not been discontinued or revised.
If a correction is made to previously published Index data, the corrected data
shall be used prospectively.
Each District and each of the Cities of Union Gap and Selah shall be
billed in January of each year for alarm service during that calendar year based
on the number of alarm calls handled by Yakima for each District and the Cities
of Union Gap and Selah during the previous calendar year times the cost per
alarm call rate applicable for the respective year.
6. PAYMENT FOR ALARM CALLS. Each District and each of the Cities of
Union Gap and Selah shall pay for each year's billing for alarm services within
ninety (90) days after billing by Yakima. Payment shall be made to Yakima
Director of Finance and Budget, City Hall, 129 North 2nd Street, Yakima,
Washington.
7. DEFINITION OF ALARM CALLS. A call to be charged for under the
terms of this Agreement is defined as follows:
A. An alarm call is defined as a call requiring the dispatch of
equipment from Districts or the Cities. Any number of vehicles from the
responsible Districts or Cities may answer any such alarm call. All
communications dealing with such alarm call shall be deemed one (1)
alarm call.
B. Mutual Aid. In the event an individual District or Union Gap or
Selah requests mutual aid, it shall pay for each additional alarm call it
requests.
8. EARLY TERMINATION OF CONTRACT. The parties to this Contract
agree this Contract will be terminated if a combined communications center is
placed into operation as a result of implementing a 911 System, which replaces
the existing Fire Dispatch Center. Such termination shall be effected by giving
at least sixty (60) days written notice to each of the parties to this Contract. A
combined communication center is defined as a central receiving point and
dispatching center for all police, fire, emergency medical services, and related
emergencies. If the combined communications center is placed into operation
at a time other than the end of the calendar year, the Cities and Districts will be
responsible for payments for that calendar year only through the time the
services provided by the City of Yakima are terminated. If payment for the

entire calendar year has been paid. a pro -rata refund through the date of
service provided will be made.
9. BOLD HARMLESS. The Districts and the Cities shall protect, defend,
indemnify, and hold harmless Yakima, its agents, officers, and employees from
any and all claims, demands, lawsuits. and liability arising out of or related to
the performance of this Contract.
10. SIGNATURE. It is agreed that this Contract may be signed by each
District separately and the signatures of all Districts need not be placed on a
single document.

FIRE COMMUNICATIONS SERVICES CONTRACT
PARTIES: CITY OF YAKIMA, hereinafter called "Yakima," and the CITY OF
UNION GAP, the CITY OF SELAH, hereinafter called "Cities," and
YAKIMA COUNTY FIRE PROTECTION DISTRICTS NO. 1, 2, 3, 4, 6,
9, 11, 12, and 14, hereinafter called "Districts."
RECITALS:
The City of Yakima has heretofore provided alarm services to the
Districts and Cities for the handling and processing of fire, alarm, and
emergency calls. The parties desire to enter into a contract for the continuation
of such services, now, therefore, for and in consideration of the covenants and
conditions hereinafter contained,
THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1. FIRE DISPATCH CENTER. Yakima shall continue to operate a central
facility to be known as the Fire Dispatch Center within the City of Yakima and
shall use the same for the purpose of receiving fire and emergency service calls
from the respective areas served by all of the parties hereto, and shall dispatch
fire apparatus of the appropriate party in answer to any such fire or emergency
calls and for the purpose of receiving and transmitting mutual aid calls among
the various parties hereto and for other related business.
2. AUTHORITY OF DISPATCH CENTER. It is agreed that the duty of
operating the Fire Dispatch Center and the complete management thereof is
vested in Yakima and that Yakima shall have the full, complete, and exclusive
authority to operate and manage such Fire Dispatch Center, including, but not
limited to, the authority to hire and fire employees and operators for such office.
3. EXPENSE OF MAINTENANCE AND OPERATION. The expense of
continued maintenance and operation of the Fire Dispatch Center, including
the expense of operating all telephone lines terminating at the Fire Dispatch
Center, and including the maintenance of equipment located within the Fire
Dispatch Center belonging to the Districts and/or Cities shall be borne by
Yakima.
4. TERM. This Contract is for a term of three (3) calendar years
commencing January 1, 1994. It shall terminate on December 31, 1996 at
midnight.
5. COST OF SERVICE. Yakima shall maintain a record of all the Districts'
and Cities' alarm calls, and each District and each of the Cities of Union Gap
and Selah shall be charged by Yakima for each call as stated herein. During
the calendar year 1994, the cost per alarm call shall be TWENTY DOLLARS
AND EIGHTEEN CENTS ($20.18). The cost per alarm call for 1995 and 1996
shall be adjusted effective January 1 of each year of the contract term to an

84=100 (Index) for the most recent month available immediately preceding the
January 1 adjustment, and the denominator of which shall be the same Index
published for the same month in 1993. If the U.S. Government ceases to
publish the Index on a 1982-84=100 reference base, the Index shall be
converted to the currently published standard reference base period in
accordance with the conversation factor published by the United States
Department of Labor, Bureau of Labor Statistics. If the Index is discontinued or
revised during the term, such other governmental index or computation with
which it is replaced shall be used in order to obtain substantially the same
result as would be obtained if the Index had not been discontinued or revised.
If a cor; ection is made to previously published Index data. the corrected data
shall be used prospectively.
Each District and each of the Cities of Union Gap and Selah shall be
billed in January of each year for alarm service during that calendar year based
on the number of alarm calls handled by Yakima for each District and the Cities
of Union Gap and Selah during the previous calendar year times the cost per
alarm call rate applicable for the respective year.

responsible Districts or Cities may answer any such alarm call. All
communications dealing with such alarm call shall be deemed one (1)
alarm call.
B. Mutual Aid. In the event an individual District or Union Gap or
Selah requests mutual aid, it shall pay for each additional alarm call it
requests.
8. EARLY TERMINATION OF CONTRACT. The parties to this Contract

FIRE COMMUNICATIONS SERVICES CONTRACT
PARTIES: CITY OF YAKIMA, hereinafter called "Yakima," and the CITY OF
UNION GAP, the CITY OF SELAH, hereinafter called "Cities," and
YAKIMA COUNTY FIRE PROTECTION DISTRICTS NO. 1, 2, 3, 4, 6,
9, 11, 12, and 14, hereinafter called "Districts."
RECITALS:
The City of Yakima has heretofore provided alarm services to the
Districts and Cities for the handling and processing of fire, alarm, and
emergency calls. The parties desire to enter into a contract for the continuation
of such services, now, therefore, for and in consideration of the covenants and
conditions hereinafter contained,
THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1. FIRE DISPATCH CENTER. Yakima shall continue to operate a central
facility to be known as the Fire Dispatch Center within the City of Yakima and
shall use the same for the purpose of receiving fire and emergency service calls
from the respective areas served by all of the parties hereto, and shall dispatch
fire apparatus of the appropriate party in answer to any such fire or emergency
calls and for the purpose of receiving and transmitting mutual aid calls among
the various parties hereto and for other related business.
2. AUTHORITY OF DISPATCH CENTER. It is agreed that the duty of
operating the Fire Dispatch Center and the complete management thereof is
vested in Yakima and that Yakima shall have the full, complete, and exclusive
authority to operate and manage such Fire Dispatch Center, including, but not
limited to, the authority to hire and fire employees and operators for such office.
3. EXPENSE OF MAINTENANCE AND OPERATION. The expense of
continued maintenance and operation of the Fire Dispatch Center, including
the expense of operating all telephone lines terminating at the Fire Dispatch
Center, and including the maintenance of equipment located within the Fire
Dispatch Center belonging to the Districts and/or Cities shall be borne by
Yakima.
4. TERM. This Contract is for a term of three (3) calendar years
commencing January 1, 1994. It shall terminate on December 31, 1996 at
midnight.
5. COST OF SERVICE. Yakima shall maintain a record of all the Districts'
and Cities' alarm calls, and each District and each of the Cities of Union Gap
and Selah shall be charged by Yakima for each call as stated herein. During
the calendar year 1994, the cost per alarm call shall be TWENTY DOLLARS
AND EIGHTEEN CENTS ($20.18). The cost per alarm call for 1995 and 1996
shall be adjusted effective January 1 of each year of the contract term to an

amount equal to the 1994 cost per alarm multiplied by a fraction, the
numerator of which shall be the Consumer Price Index published by the Bureau
of Labor Statistics of the U.S. Department of Labor for All Urban Consumers
(CPI -U) U.S. City Average for All Items, with a reference base period of 1982-
84=100 (Index) for the most recent month available immediately preceding the
January 1 adjustment, and the denominator of which shall be the same Index
published for the same month in 1993. If the U.S. Government ceases to
publish the Index on a 1982-84=100 reference base, the Index shall be
converted to the currently published standard reference base period in
accordance with the conversation factor published by the United States
Department of Labor, Bureau of Labor Statistics. If the Index is discontinued or
revised during the term, such other governmental index or computation with
which it is replaced shall be used in order to obtain substantially the same
result as would be obtained if the Index had not been discontinued or revised.
If a correction is made to previously published Index data, the corrected data
shall be used prospectively.
Each District and each of the Cities of Union Gap and Selah shall be
billed in January of each year for alarm service during that calendar year based
on the number of alarm calls handled by Yakima for each District and the Cities
of Union Gap and Selah during the previous calendar year times the cost per
alarm call rate applicable for the respective year.
6. PAYMENT FOR ALARM CALLS. Each District and each of the Cities of
Union Gap and Selah shall pay for each year's billing for alarm services within
ninety (90) days after billing by Yakima. Payment shall be made to Yakima
Director of Finance and Budget, City Hall, 129 North 2nd Street, Yakima,
Washington.
7. DEFINITION OF ALARM CALLS. A call to be charged for under the
terms of this Agreement is defined as follows:
A. An alarm call is defined as a call requiring the dispatch of
equipment from Districts or the Cities. Any number of vehicles from the
responsible Districts or Cities may answer any such alarm call. All
communications dealing with such alarm call shall be deemed one (1)
alarm call.
B. Mutual Aid. In the event an individual District or Union Gap or
Selah requests mutual aid, it shall pay for each additional alarm call it
requests.
8. J ARLY TERMINATION OF CONTRACT. The parties to this Contract
agree this Contract will be terminated if a combined communications center is
placed into operation as a result of implementing a 911 System, which replaces
the existing Fire Dispatch Center. Such termination shall be effected by giving
at least sixty (60) days written notice to each of the parties to this Contract. A
combined communication center is defined as a central receiving point and
dispatching center for all police, fire, emergency medical services, and related
emergencies. If the combined communications center is placed into operation
at a time other than the end of the calendar year, the Cities and Districts will be
responsible for payments for that calendar year only through the time the
services provided by the City of Yakima are terminated. If payment for the
