A RESOLUTION authorizing and directing the Cit} Manager of the Cit) of
Yakima to obtain propert) acquisition legal services from the
law firm of L) on, Weigand, Suko and Gustafson, P.S.
WHEREAS, the Cit) of Yakima is proceeding with the Yakima Gateway/I-82
Improv ement Project; and
\VIIEREAS, the Cit} of Yakima needs to acquire a number of parcels of land
prior to construction of the Yakima Gateway street improvements; and
\VIIERLAS, the law firm of L\ on, Weigand, Suko and Gustafson, P.S. has
previous]) assisted the Cit) with acquisition/condemnation legal services for the
Nob hill and Transit Transfer Projects, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The Yakima Cit) Manager is hereby authorized and directed to obtain real
estate acquisition legal services for the Yakima Gatewa} /I-82 Improvement
Project in accordance with the attached Letter Agreement with the law firm of

This will confirm our discussion wherein I advised that our office
would be willing to handle the condemnation matters related to the
above project as in the past matter for the City of Yakima. I
understand you would like us to be involved in the following:
1. Negotiations with condemnees/parties in interest or their
attorneys and/or their attorneys where your acquisition agent's
efforts to resolve a parcel have broken down.
2. Preparation of settlement documents related to parcels where
agreement has been reached and closing of the transactions
whereby the city acquired real property and appropriate
easements.
3. Preparation and handling of condemnation lawsuits.
4. Consultation and coordination with the city staff as necessary
to this process.
Our services will be billed monthly to the City based on the
commercial hourly rates of the respective attorneys and legal
assistants working on the various files, less $10.00 per hour for
attorneys, and $5.00 per hour for legal assistants. For 1994, your
rates would be as follows:

These are actually our 1993 rates which would normally be adjusted
sometime in the first half of 1994, but we will commit to holding
these rates for the City through 1994. We would expect some
reasonable increase if this project continues into 1995.
Additionally, all out-of-pocket costs and standard office charges for
copies, postage, long distance calls, fax, express mail and mileage
will be charged. We expect that the City would follow its prior
practice of processing and paying our bills monthly in the ordinary
course of its business.
