R-93- 127 fixing time for public hearing before the Hearing Examiner on a petition to vacate portions of Riverside Street, South 15th Street, South 16th Street, and South 17th Street all in the vicinity south of East Chestnut Street and East of the right of way I-82. WHEREAS, pursuant to RCW 35.79.010, a petition has been filed with the City Clerk, requesting the vacation of a street or alleyway (or portion thereof) within the City of Yakima, true copy of which petition is attached and incorporated into this resolution; and WHEREAS, such a petition has been signed by the owners of more than two- thirds (2/3) of the property abutting upon the street or alley (or portion thereof) which is requested to be vacated, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The above referenced petition for vacation is hereby referred to the Hearing Examiner for public hearing pursuant to Section 1.43.080 of the City of Yakima Municipal Code. The Hearing Examiner is directed to make written recommendation to the City Council regarding said petition. The Hearing Examiner Public Hearing shall be held on January 13, 1994 at 9:30 a.m. in the City Council Chambers of City Hall, which date and time are not more than sixty (60) days nor less than twenty (20) days after the passage of this resolution. It is further resolved that the City Clerk give notice of the Hearing Examiner in the form and manner prescribed by RCW 35.79.020 and Section 1.43.080 of the City of Yakima Municipal Code. ATTEST: ATTEST: KY-}"LL-vt--- Mayor City Clerk PETITION NO. 1156 City of Yakima, Washington Narrative for the Vacation of Portions of Public Rights -of -Way Along Riverside Street, S. 15th Street, S. 16th Street and S. 17th Street The rights-of-way proposed to be vacated are delineated by the attached legal description entitled 'Exhibit A," exhibit map and boundary survey plat. There are 27 abutting parcels with a total of 7 separate property owners. This petition has been signed by 6 owners and contains 86% of the abutting property owners signatures. The complete vacation of the described rights-of-way will not deny sole access to any abutting property owners. This petition for right-of-way vacation is submitted in order to allow for the construction of a retail store, approximately 125,000 square feet, with a future grocery expansion of approximately 65,000 square feet, which will encompass the vacated rights-of-way and abutting properties. This retail facility is estimated to provide 150 jobs to the community. The northern portion of the project site is presently zoned commercial. We propose to extend the commercial (CBDS) zoning to the southern limit of the property. This will allow for a large scale commercial development appropriate for the Interstate 82 frontage and compatible with the existing auto dealerships to the north. Landscaping and fencing will be utilized to mitigate impacts on other less intensive uses to the south and east. Based on conversations with the City of Yakima Traffic Engineering Department, we understand the vacation of the right-of-way proposed in this petition to be consistent with the Six-year Transportation Improvement Plan and the Urban Area Comprehensive Plan. The granting of easements, removal and relocation of the existing public 16 -inch water main, 8 -inch sanitary sewer and franchised Pacific Power & Light electric line which are located in the vacated rights-of-way along 17th and Riverside Streets will be coordinated with the respective agencies as discussed below. A portion of the existing 16 -inch water main is proposed to be removed and relocated. The on- site removal would begin near the intersection of Riverside and Chalmers running west along Riverside Street until it intersects with 17th Street, then removal will continue north along 17th Street for a distance of approximately 250 feet. The new 16 -inch water main will connect to the existing water main at the point of removal near the intersection of Riverside and Chalmers Streets and will proceed north approximately 210 feet, then run west approximately 275 feet to the point of connection. Easements will be granted for on-site water main. The existing 8 -inch sanitary sewer will be removed beginning at a point approximately 350 feet south of the intersection of 17th Street and Chestnut Street to a point approximately 50 feet west of the intersection of Chalmers and Riverside Streets. The new 8 -inch sanitary sewer will run from the point of removal east a distance of approximately 340 feet, then will run approximately 280 feet to the south to the point of connection with the existing sanitary sewer. Easements will be granted for on-site sanitary sewer.
