HomeMy WebLinkAboutR-1993-123 Consulting / InterimRESOLUTION NO. R-93- 123 A RESOLUTION: authorizing the execution of a consulting services agreement with Interim Services. WHEREAS, the City of Yakima employs a work force of over 600 people; and WHEREAS, it is necessary to the operation of the City of Yakima to fill vacant positions in a timely, efficent manner for the purpose of avoiding legal liability and promoting a productive workplace; and WHEREAS, the Human Resources Division of the City of Yakima has a vacancy for the Chief Examiner position, and due to the number of vacant positions, Human Resources can not respond to the City's needs in a timely manner; and WHEREAS, Interim Personnel is a national personnel placement service, specializing in the recruitment, testing and placement of personnel for employers, and it is in the best interest of the City to contract to utilize their expertise according to the terms of the attached agreement, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and City Clerk are hereby authorized and directed to execute the attached and incorporated "Consulting Services Agreement", which is incorporated by this reference, with Interim Personnel for the purpose of recruitment, testing and placement services. ATTEST: i, > c City Clerk Mayor 1993-4 AGREEMENT BETWEEN THE CITY OF YAKIMA AND INTERIM PERSONNEL This Agreement is made and entered into the day of 1993, by and between the City of Yakima, Human Resources Division, herein referred to as the "City" and Interim Personnel, a company herein referred to as "Contractor." WHEREAS, the City finds it necessary to contract with Interim Personnel to provide specialized advertising, screening, testing (oral, written, performance) and a list of successful candidates to facilitate the hiring of vacant positions of the City. WITNESSETH; That for and in consideration of mutual covenants, promises, and agreements, herein contained, the parties mutually agree as follows; 1. The recruitment, testing and selection process are to be performed by the Contractor in compliance with the City's Civil Service Rules and Regulations. The contract shall commence on the 24th day of November, 1993, and terminate on the 31st day of December, 1994. 2. During the performance of this Agreement, the Contractor shall not discriminate on the basis of race, color, sex, religion, national origin, creed, or the presence of any sensory, mental, or physical handicap. 3. Special areas of responsibilities for both the City and the Contractor are contained in Attachment "A" which is attached and incorporated into this Agreement. 4. The Contractor specifically represents to the City that she/he is not an officer or employee of the City, nor does she/he reside with or contribute monetary amounts to any City employee or officer. 5. It is understood that the City does not maintain liability insurance on the Contractor. 6. As consideration for the services specified in this Agreement, the City agrees to compensate the Contractor according to the payment schedule, which is based on 6% of the annual salary for any position open to the general public only or simultaneously with promotional for which advertising, testing and a list of names is produced to form a register. As consideration for promotional vacancies only the City agrees to a fee based on 2.5% of the annual salary. 7. This Agreement, or any interest therein, can not be assigned in whole or in part by the Contractor to any other party unless mutually agreed upon by both parties. 8. If the Contractor fails to comply with the terms and conditions of this Agreement in such a manner that the Personnel Officer, in his sole discretion, deems that the continuation of the Agreement is no longer in the best interest of the City, the City may terminate this Agreement by written notice, giving the Contractor fifteen (15) days notice of termination. 9. If the City fails to comply with the terms and conditions of this Agreement, the Contractor may terminate this Agreement by written notice, giving the City thirty (30) days notice of termination. If for any reason prior to termination of this Agreement as provided herein the Contractor fails to provide the services specified in this Agreement and the City is forced to secure other such services, the Contractor shall be held liable for any and all additional expenses to fulfill their obligation to the City. 11. This Agreement constitutes the entire Agreement between the parties. There is no other oral or written Agreements between the parties as to the subjects covered herein. 12. If any portion of this Agreement is changed per mutual agreement or any portion is held invalid, the remainder of the Agreement shall remain in force. Hale, President Dated g/93 By HR/Interim es/contracts 11/16/93 PAGE 3 ATTACHMENT 'A' AREA OF RESPONSIBILITIES I. The City of Yakima, Human Resources Division shall: A. Provide employment application packets, job announcements, and mailing labels. B. Provide class specifications and sample advertising. C. Provide subject matter experts, and/or human resources staff for each open position to ascertain appropriate tests (oral, written, and performance); provide examination when applicable. D. Provide a list of advertising agencies when and where applicable. E. Assist in providing locations for field testing (equipment operation) if necessary. F. Provide lists of names for oral board members; provide sample of both oral and written exam packets, and work sample packets. IL The contractor shall: A. Follow applicable Civil Service rules and regulations regarding the work being performed. B. Receive, screen, and process employment applications as directed by the Human Resources Division in compliance with Civil Service rules and regulations. C. Provide advertising services as specified for any position assigned whether promotional or outside. Advertising costs locally (Yakima, Lower Valley, and Tri -Cities) to be paid by Interim, additional advertising costs paid by the City of Yakima. D. Advertising shall be by job announcements as presently accomplished within the City's operations, the Yakima Herald - Republic and any other publication as indicated by the City for the position. Develop and/or administer tests (oral and written) or performance (if necessary) to all eligible candidates, score and provide a list of all candidates for each position. F. Provide facilities and equipment (computers, etc.) for the administration of the employment exams (except heavy equipment operation) G. Coordinate entire testing process with the Personnel Officer or designee and the Civil Service Chief Examiner. H. Create Civil Service register in compliance with Civil Service rules. Shall deliver a Civil Service register to the Human Resources Division no later than thirty days from the closing date of the position. In addition, provide statistical analysis of the applicant pool as required by the Human Resources Division to comply with EEO regulations. cs/contracts 11/16/93 PAGE 5
