A RESOLUTION authorizing execution of the Yakima County Department of
Communications Intergovernmental Agreement for 911
Communications Services.
WHEREAS, Yakima County, the cities and towns of Grandview, Granger,
Harrah, Mabton, Moxee, Naches, Selah, Tieton, Sunnyside, Toppenish, Union Gap,
Wapato, Yakima, and Zillah, the Yakima Indian Nation, and the Yakima County
Fire Protection Districts (collectively referred to as "Members") have heretofore
adopted in December of 1990 an Intergovernmental Agreement for 911 Answering
Services; and
WHEREAS, the Members in 1991 adopted Amendment No. 1 to the
aforementioned agreement; and
WHEREAS, the parties wish to supersede the preceding agreement and its
amendment by substituting in its place a new agreement to provide for enhanced
911 PSAP service to the Members at the earliest possible date so as to provide an
enhanced emergency service communication system for the public, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The Mayor and the City Clerk are hereby authorized and directed to execute
the attached and incorporated agreement entitled "Yakima County Department of
Communications Intergovernmental Agreement for 911 Communication Services."

YAKIMA COUNTY DEPARTMENT OF COMMUNICATIONS
INTERGOVERNMENTAL AGREEMENT
FOR 911 COMMUNICATION SERVICES
This agreement, made and entered into by and between
Yakima County, the Cities and Towns of Grandview, Granger,
Harrah, Mabton, Moxee, Naches, Selah, Sunnyside, Tieton,
Toppenish, Union Gap, Wapato, Yakima, and Zillah, the Yakima
Indian Nation, and the Yakima County Fire Protection
Districts who are signatories to this agreement (hereinafter
collectively referred to as "the members").
WITNESSETH:
WHEREAS, the members and the residents of Yakima County
would benefit both in terms of efficiency and economy from
911 Public Safety Answering Point (PSAP) services and such
other services as the Administration Board may determine to
Yakima County and the cities and fire protection districts
within Yakima County; and
WHEREAS, Chapter 39.34 RCW, the Interlocal Cooperation
Act, authorizes the members to agree to the joint provision
of 911 PSAP and other services; and
WHEREAS, the members find it is in the best interest of
the residents of Yakima County to continue to use the
existing Yakima County governmental structure to provide said
services through the Yakima County Department of
Communications; and

WHEREAS, the members entered into an Intergovernmental
Agreement for 911 Answering Services in December, 1990, and
Amendment No. 1 to said agreement in 1991, and the members
find that it is in the best interest of the residents of
Yakima County that said agreement be amended;
NOW THEREFORE, the members mutually agree as follows:
1. PURPOSE.
1.1 This agreement shall supercede the above-mentioned
agreement of December, 1990, and Amendment No. 1 thereto.
1.2 It is the purpose of this Agreement to provide
Enhanced 911 PSAP services for the members at the earliest
possible time thereby benefiting them in terms of efficiency
and economy.
1.3 Further, it is intended by this agreement to
continue to provide Basic 911 PSAP services while the
Enhanced 911 system is under development.
2. DEFINITIONS. As used in this Agreement the following
words and phrases shall have the meanings indicated unless
the context clearly requires otherwise.
2.1 "PSAP" shall mean the location(s) of the equipment
and personnel which provide PSAP services.
2.2 Services" shall mean those services and equipment
required to answer 911 calls on a 24-hour basis.
2.3 "County" shall mean Yakima County.
2.4 "Basic 911" shall mean the ability of a person to

call for emergency services by using the three digit
number.
2.5 "Enhanced 911" shall mean the ability to
electronically track and identify the origin of
emergency calls in addition to Basic 911.
2.6 "Members" shall mean the signatories to this
agreement and such other entities as become signatories
or otherwise become members in the future.
3. PROVISION OF PSAP SERVICES. Yakima County, through the
Yakima County Department of Communications (hereinafter
referred to as SUNCOM), with the approval of the
Administration Board, shall be responsible for providing PSAP
services to all members.
3.1 The County, with the approval of the Administration
Board, shall directly or by contract equip, operate, staff
and maintain facilities and accessories (i.e., inventory,
equipment, and appurtenances) necessary and proper to provide
PSAP services to the members. Such facilities and
accessories shall be capable of servicing all members and
others by agreement.
3.2 The director and employees of SUNCOM shall be
subject to all employee and personnel policies and applicable
collective bargaining agreements of Yakima County and shall
be entitled to all rights and benefits as Yakima County
employees.

3.3 The County shall indemnify the director, employees
and board members in the performance of their duties pursuant
to Yakima County policy. SUNCOM will contribute to the
county insurance fund as do other county departments and the
county insurance fund will respond to any claims attributed
to the negligence of SUNCOM as an entity, including errors
and omissions liability of its administrative and operations
boards. SUNCOM shall not be liable to member agencies for
emergency communications provided by member agencies and not
intended by this Agreement to be provided by SUNCOM.
3.4 SUNCOM may contract with public and private
organizations for emergency services, alarm systems and other
communication services. Such organizations shall pay
standard rates for these services as established annually by
the Administration Board.
4. ADMINISTRATION BOARD.
4.1 There is hereby established an Administration Board
consisting of the following members or their designees;
provided, that the designee shall not be a member of the
Operations Board:
(1) The Mayor of Grandview.
(2) The Mayor of Granger.
(3) The Mayor of Harrah.
(4) The Mayor of Mabton.
(5) The Mayor of Moxee.

(6) The Mayor of Naches.
(7) The Mayor of Selah.
(8) The Mayor of Sunnyside.
(9) The Mayor of Tieton.
(10) The Mayor of Toppenish.
(11) The Mayor of Union Gap.
(12) The Mayor of Wapato.
(13) The Mayor of Yakima.
(14) The Mayor of Zillah.
(15) One member of the Board of Yakima County
Commissioners.
(16) The Yakima Indian Nation Tribal Council Chair.
(17) One representative of the Upper Valley Fire
Districts.
(18) One Fire District #5 Commissioner.
(19) One Citizen -at -Large.
4.2 Citizen -at Large Members.
4.2.1 The Citizen -at -Large member shall be elected
by the Administration Board. Any member of the
Administration Board may nominate a person to fill the
Citizen -at -Large position. The Citizen -at -Large member must
be a registered voter of Yakima County. The Citizen -at -Large
member shall not be an official or employee of any member.
4.2.2 The term of office of the Citizen -at -Large
member shall be two years.

4.2.3 The Administration Board shall select an
alternate Citizen -at -Large member to act in the absence of
the Citizen -at -Large member. The Alternate shall be selected
in the same manner as the Citizen -at -Large.
4.3 The functions of the Administration Board shall be
as follows:
(1) Establish rules and policies for its operation.
(2) Budget approval and recommendation to the
legislative bodies of the members.
(3) Establishment of policies for expenditures of
budgeted items for SUNCOM.
(4) Approval or disapproval of unbudgeted
expenditures recommended.by the Operations Board.
(5) Adopt administrative policies of SUNCOM.
(6) Employment and/or termination of employment of
the Director.
(7) Resolve any disputes that may arise between
the members of the Operations Board and any other
issues not resolvable by the Operations Board.
(8) Annually establish standard rates for services
provided to non-member private and public
organizations.
(9) Approve the salary to be paid the Director and
all SUNCOM employee union contracts negotiated by
the County.
(10) Take any other action necessary for the
operation of SUNCOM.
4.4 The Administration Board shall elect from among
themselves a Chair and Vice -chair each to serve terms of two
years.

4.5 A quorum of the Administrative Board shall be seven
members. In the absence of a quorum, the Administrative
Board may take action if the following five members are
present: (1) a representative from the Lower Valley, which
includes Mabton, Grandview, Sunnyside, and Granger; (2) a
representative from the Middle Valley, which includes
Toppenish, Zillah, Harrah, White Swan, the Yakima Indian
Nation and Wapato; (3) a representative from the Upper
Valley, which includes Union Gap, Yakima, Moxee, Selah,
Tieton, Naches; (4) a representative of the Yakima County
Commissioners; and (5) a Citizen -at -Large member. All
matters shall be adopted by a majority vote of those members
in attendance.
5. OPERATIONS BOARD.
5.1 There is hereby established an Operations Board
consisting of the following eleven members or their
designees:
(1) The Yakima County Sheriff.
(2) The Chief of Police of the City of Yakima.
(3) The Fire Chief of the City of Yakima.
(4) The Chief of Yakima County Fire District #5.
(5) The Chief of the Yakima Tribal Police.
(6) One representative chosen from the Upper
Valley Fire Districts and the Union Gap Fire
Department.

One representative chosen from the Police
Departments of the Cities of Selah, Moxee and
Union Gap.
(8) One representative chosen from the Lower
Valley Fire Departments.
(9) Two representatives chosen from the Lower
Valley Law Enforcement.
(10) One representative of the licensed private
ambulance providers in Yakima County.
(11) The County Medical Program Director.
5.2 The functions of the Operations Board shall be as
follows:
(1) Establish rules and policies for its operation.
(2) Development of operational priorities,
policies and procedures for systems development,
programming, operations and work rules.
(3) Overall supervision and evaluation of the
Director.
(4) Review and recommend for approval the
Director's proposed budget to the Administration
Board.
(5) Resolve disputes over SUNCOM operations
between users, and between users and SUNCOM,
subject to review by the Administration Board.
(6) Recommend to the Administration Board the
salary to be paid the Director.
5.3 The Operations Board shall elect from among
themselves a Chair and Vice -chair to serve a terms of two
years.
5.4 The Chair shall have the authority to appoint
standing subcommittees to examine special interests and make
recommendations to the Operations Board.
6. DIRECTOR.

6.1 There shall be a Director of SUNCOM appointed by
the Administration Board from a list of three names
recommended by the Operations Board. The Director shall be
selected upon the basis of administrative and technical
competence and shall be under the supervision of the
Operations Board.
6.2 The Director shall be responsible for
administration, budget, personnel, call receiving and
transfer, records, communications, security, and other PSAP
functions in conformance with the policies of the
Administration and Operations Boards.
6.3 The Director shall be responsible for reviewing,
renewing, and updating required licenses for the operations
of SUNCOM.
6.4 The Director shall offer technical assistance to
member and contract agencies and other entities as authorized
by the Operations Board. The Director with the approval of
the Operations Board shall prepare and present a proposed
budget to the Administration Board in accordance with the
member entities budget timetables.
6.5 The Director shall have authority to hire and fire
all personnel subject to Yakima County administrative
procedures, personnel policies and applicable collective
bargaining agreements.
7. TECHNICAL EXPERTISE. SUNCOM may provide to any member

technical expertise as may be required for proper operation
of member's communications systems and for procurement of
their communications equipment.
8. EQUIPMENT.
8.1 Each party shall be responsible for purchasing,
maintaining, and repairing the equipment necessary to receive
calls forwarded from a PSAP and retains all rights to such
equipment.
8.2 Upon dissolution of SUNCOM, equipment purchased by
SUNCOM may be purchased by a member at a value to be
determined by action of the Administration Board. Property
not sold in the foregoing manner shall be disposed of as
provided by Chapter 36.34 RCW; provided, that equipment
purchased with any Federal or State grant shall be disposed
of in accordance with the terms of the grant and/or
applicable law. If no grant or legal provisions govern
disposition of the proceeds, then such proceeds shall be
divided among the members in proportion to the funds paid
into SUNCOM during the term of this agreement.
9. BUDGETING - FUNDING.
9.1 911 telephone excise tax proceeds, authorized by
RCW 82.14B.030, shall be used only by SUNCOM.
9.2 Administrative costs of SUNCOM including services
by the County personnel department, auditor, treasurer,

prosecuting attorney and such other services as are provided
by the County will be paid by the County and shall be
reimbursed from the SUNCOM budget. The amount or manner of
calculation of such reimbursement shall be by annual
agreement between the Administrative Board and the County.
9.3 Annually, the Director and the Operations Board
shall develop a budget which will meet the anticipated
maintenance and operation expenses of the SUNCOM facilities
and accessories for the coming calendar year. They shall
submit the proposed budget to the Administration Board for
approval. After the Administration Board has approved the
final budget, it shall be forwarded to the Board of County
Commissioners for adoption.
9.4 It is the intent that the 911 telephone excise
taxes will fund 911 operations; however, in the event SUNCOM
expenses exceed 911 excise tax proceeds and other available
revenue, the Operations Board shall recommend to the
Administration Board a cost sharing formula for the members
sufficient to meet expenses.
10. ADMISSION OF NEW MEMBERS. Additional public entities
may become members upon such terms and conditions as
recommended by the Operations Board. The admission of such
additional members shall be by written addendum to this
Agreement, with the approval of the Administration Board.

11. AMENDMENTS. Amendments to this Agreement shall only
be made by written agreement of all members.
12. ARBITRATION. Any controversy between the members in
regard to the application

13. INDEMNIFICATION. Each member agrees to

assume the risk of liability for. its
negligent acts or omissions, or those of
own

agrees to save, indemnify, defend and hold the other members
harmless from any such liability.
14. DURATION OF AGREEMENT. This Agreement shall commence
on the date signed by all parties and shall continue in
effect until terminated; provided, that any party may
withdraw from this Agreement effective December 31 of any
year by giving written notice to the Administration and
Operations Boards of its intent to withdraw. Notice shall be
given prior to June 1st of the then current year. The
withdrawal of any member shall not require dissolution of

SUNCOM and no compensation shall be owed to any withdrawing
party.
15. SIGNATURES. Each party to this agreement shall attach
its signature page in a form required by law to constitute
valid execution. Each signature page shall be titled "YAKIMA
COUNTY DEPARTMENT OF COMMUNICATIONS INTERGOVERNMENTAL
AGREEMENT FOR 911 SERVICES SIGNATURE PAGE FOR [name of
entity]".
16. ENTIRE AGREEMENT. This document encompasses the entire
agreement of the members. No understanding or amendment,
addendum, or addition to this agreement shall be effective
unless made in writing and signed by all members.

FOR 911 ANSWERING SERVICES
This agreement, made and entered into by and between
Yakima County, the Cities and Towns of Grandview, Granger,
Harrah, Mabton, Moxee, Naches, Selah, Sunnyside, Tieton,
Toppenish, Union Gap, Wapato, Yakima, and Zillah, the Yakima
Indian Nation, and the Yakima County Fire Protection
Districts who are signatories to this agreement.
WITNESSETH:
WHEREAS, the members and the residents of Yakima County
would benefit both in terms of efficiency and economy from
911 Public Safety Answerin Point (PSAP) services to Yakima
County and the cities and fire protection districts within
Yakima County; and
WHEREAS, Chapter 39.34 RCW, the Interlocal Cooperation
Act, authorizes the members to agree to the joint provision
of 911 PSAP Services; and
WHEREAS, it would be more efficient to provide said
services through an existing governmental structure rather
than creating a new entity for the sole purpose of providing
911 PSAP services; and
WHEREAS, Yakima County is an existing governmental
structure encompassing the entire geographic, economic, and
population region to be served and agrees to establish a

Department of Communications with the capability of providing
911 PSAP services to members.
NOW THEREFORE, the members mutually agree as follows:
1. PURPOSE. It is the purpose of this Agreement to provide
Enhanced 911 PSAP services for the members at the earliest
possible time thereby benefiting them in terms of efficiency
and economy.
Further, it is intended by this agreement to provide
Basic 911 PSAP services as soon as technically feasible while
the Enhanced 911 system is under development.
2. DEFINITIONS. As usedin this Agreement the following
words and phrases shall have the meanings indicated unless
the context clearly requires otherwise.
2.1 "PSAP" shall mean the location(s) of the equipment
and personnel which provide PSAP services.
2.2 Services" shall mean those services and equipment
required to answer 911 calls on a 24-hour basis.
2.3 "County" shall mean Yakima County.

employee and personnel policies of Yakima County and
applicable collective bargaining agreements.

4.2 The Citizen-at-Large member shall be elected by the
Administration Board. Any member of the Administration Board
may nominate a person to fill the Citizen-at-Large position.
The Citizen-at-Large member must be a registered voter of
Yakima County. The Citizen-at-Large member shall not be an
official or employee of any member .
The appointment of the first Citizen-at-Large member of
the Administration Board shall begin immediately upon
appointment. The term of office of the Citizen-at-Large
member shall be one (1) year.
The Administration Board shall select an alternate
Citizen-at-Large member to act in the absence of the
Citizen-at-Large member. The Alternate shall be selected in
the same manner as the Citizen-at-Large.
4.3 The functions of the Administration Board shall be
as follows:
(1) Establish rules and policies for its operation.
(2) Budget approval and recommendation to the
legislative bodies of the members.

9.3 Annually, the Director and the Operations Board
shall develop a budget which will meet the anticipated

maintenance, operation, and insurance expenses of the SUNCOM
facilities and accessories for the coming calendar year.
They shall submit the proposed budget to the Administration
Board for approval. After the Administration Board has
approved the final budget, it shall be forwarded to the Board
of County Commissioners for adoption.
9.4 It is the intent that the 91.1 telephone excise
taxes will fund Basic 911 operations for calendar years 1991
and 1992 and that no additional member entity contributions
will be required during that period. However, iri the event
SUNCOM expenses exceed 911 excise tax proceeds, the Director
and the Operations Board shall develop and recommend an
amended budget to the Administration Board. Further, the
Operations Board shall recommend to the Administration Board
a cost sharing formula for the members.
10. ADMISSION OF NEW MEMBERS. Additional public entities
may become members upon such terms and conditions as agreed
to by the Administration Board. The admission of such
additional members shall be by written addendum to this
Agreement, with the approval of the Administration Board.
11. AMENDMENTS. Amendments to this Agreement shall only
be made by written agreement of all members.

12. ARBITRATION. Any controversy between the members in
regard to the application or interpretation of this Agreement
shall be submitted to the Operations Board for resolution.
If the Operations Board's action does not resolve the
controversy, it shall be appealed to the Administration
Board. If the Administration Board's action does not resolve
the controversy, it may be submitted to arbitration in
accordance with Chapter 7.04 RCW.
13. INDEMNIFICATION. Each member agrees to
and assume the risk of liability for its own
negligent acts or omissions, or those of its

agents, or employees to the extent that liability exists, and
agrees to save, indemnify, defend and hold the other members
harmless from any such liability.
14. DURATION OF AGREEMENT. This Agreement shall be

term of one year commencing January 1, 1991 and ending
midnight December 31, 1991 and, unless terminated or
modified, shall continue in effect for subsequent terms of
one year; provided, that any party may withdraw from this
Agreement by giving written notice to the Administration and
Operations Boards of its intent to withdraw at the end of
such term. Notice shall be given prior to June 1st of the
then current term. The withdrawal of any member shall not

require dissolution of SUNCOM and no compensation shall be
owed to any withdrawing party.
15. SIGNATURES. Each party to this agreement shall attach
its signature page in a form required by law to constitute
valid execution. Each signature page shall be titled "YAKIMA
COUNTY DEPARTMENT OF COMMUNICATIONS INTERGOVERNMENTAL
AGREEMENT FOR 911 ANSWERING SERVICES SIGNATURE PAGE FOR [name
of entity]".
16. ENTIRE AGREEMENT. This document encompasses the entire
agreement of the members. No understanding or amendment,
addendum, or addition to this agreement shall be effective
unless made in writing and signed by all members.

A RESOLUTION authorizing execution of the Yakima County De-
partment of Communications Intergovernmental
Agreement for 911 Answering Services.
WHEREAS, the residents of the City of Yakima would bene-
fit both in terms of efficiency and economy from 911 Public
Safety Answering Point ssrvices; and
WHEREAS, Chapter 39.34 of the Revised Code of Washington,
the Interlocal Cooperation Act, authorizes governmental units
within Washington to agree to the joint provision of 911
Public Safety Answering Point services; and
WHEREAS, it would be more efficient to provide such
services through an existing governmental structure rather
than creating a new entity for the sole purpose of providing
such services; and
WHEREAS, Yakima County is an existing governmental struc-
ture encompassing the entire geographic, economic, and popula-
tion region to be served and agrees to establish a Department
of Communications with the capability of providing 911 Public
Safety Answering Point services to communities within Yakima
County, including the Cite of Yakima; and
WHEREAS, the City Council deems it to be in the best
interest of the City of Yakima to join with other governmental
entities within Yakima County for the purpose of contracting
with Yakima County for 911 Public Safety Answering Point
services, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and the City Clerk are hereby authorized
and directed to execute the attached and incorporated agree-
ment with Yakima County which is entitled "Yakima County
Department of Communications Intergovernmental Agreement for
911 Answering Services."

FOR 911 ANSWERING SERVICES
AMENDMENT NO. 1
WHEREAS, Yakima County, the Cities and Towns of
Grandview, Granger, Harrah, Mabton, Moxee, Naches, Selah,
Sunnyside, Tieton, Toppenish, Union Gap, Wapato, Yakima, and
Zillah, the Yakima Indian Nation, and the Yakima County Fire
Protection Districts entered into an Interlocal Agreement for
911 Answering Services; and
WHEREAS, it is necessary to amend said agreement to
provide for inclusion of the Union Gap Fire Department within
paragraph 5.1(6) of said agreement; and
WHEREAS, the members have determined that the following
amendments to paragraph 5.1 should be adopted to that end;
NOW THEREFORE, the members mutually agree that
paragraph 5.1 of the Yakima County Department of
Communications Intergovernment Agreement for 911 Answering
Services shall be amended to provide as follows:
5.1 There is hereby established an Operations
Board consisting of the following eleven members
or their designees:
(1) The Yakima County Sheriff.
(2) The Chief of Police of the City of Yakima.
