HomeMy WebLinkAboutR-1993-017 Annexation• • • RESOLUTION NO. R-93-17 A RESOLUTION withdrawing the Wide Hollow annexation and establishing an annexation policy with respect to the West Valley area. WHEREAS, the City Council has heretofore held a public meeting on October 20, 1992 and November 10, 1992 pursuant to RCW 35 13 125 to determine whether it would accept the proposed Wide Hollow annexation commenced through the use of Outside Utility Agreements; and WHEREAS, the City Council deems it to be in the best interest of the City of Yakima not to accept the Wide Hollow annexation; and WHEREAS, the citizens of the unincorporated West Valley area have commenced the incorporation of approximately twenty square miles contiguous to the City of Yakima in the West Valley area, and WHEREAS, the City Council of the City of Yakima has engaged in a negotiation process with the proponents of said incorporation for the purpose of ending such incorporation, resolving issues associated with three related lawsuits, and modifying the City's Outside Utility Agreement policy related to sewer service; and WHEREAS, these negotiations were unsuccessful, however, the City Council nevertheless wishes to declare its policy with respect to annexation of the unincorporated West Valley area, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1 The City respects the right of self determination by citizens and will not oppose the West Valley incorporation election. Section Z. The City Council hereby rejects the Wide Hollow annexation commenced on October 13, 1992. Section 3. In the event an incorporation election in West Valley is unsuccessful, the City will not use Outside Utility Agreements in place of Annexation petitions. Section 4 The City continues to offer and support annexation elections in West Valley The City is prepared to respond to the service needs of the West Valley Urban Area and will endeavor to build community support for annexation elections. Section 5 The City will continue to offer West Valley the opportunity to create Neighborhood Community Councils as a part of any annexation election. The City remains willing to negotiate a contract for services with the West Valley Fire District to ensure quality fire protection for West Valley in the future and provide financial security to the Fire District. Section 7 The City also sincerely desires to end the costly litigation in this matter and urges that the ongoing appeals be withdrawn by West Valley (Puhrmann and Leitch v. City of Yakima. Washington Supreme Court Cause No. 59239-0; City of Yakima v. Yakima County and Washington State Boundary Review Board for Yakima County, Superior Court Cause No. 91-2-02163-4 and 91-2-01860-9).
