RESOLUTION NO. D 6 2 3 6
A RESOLUTION authorizing the Chief of the Yakima Fire Department to
execute a contract between Yakima Valley Community College
and the Yakima Fire Department whereby the Yakima Fire
Department would provide instruction in fire science and the
college would function as the accrediting agency.
WHEREAS, the Yakima Fire Department has participated successfully with
Yakima Valley Community College in providing a fire science degree program,
and
WHEREAS, the Yakima Fire Department as lead agency for regional fire
fighting agencies continues to have the unique ability to identify instructors who
are appropriately prepared and qualified for training students in fire science;
and
WHEREAS, upgrading training for existing fire fighting personnel and the
training of potential recruits for fire science careers are necessary for the
continued staffing of the Yakima Fire Department with trained fire fighting
personnel, and
WHEREAS, the City of Yakima benefits from more highly trained fire
fighting personnel and the safe and effective handling of the responsibilities of
the Fire Department; and
WHEREAS, the Yakima Fire Department will be reimbursed for the costs of
instructing/conducting fire science classes at the rate of $1,000.00 for each unit
of 45 student credit hours up to a maximum of $5,000.00; such remuneration to be
paid directly to the Yakima Fire Department, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The Chief of the Yakima City Fire Department is hereby authorized and
directed to execute the attached and incorporated contract between Yakima Valley
Community College and the Yakima Fire Depart Departmnt.

INSTRUCTIONAL CONTRACT
BETWFFN
YAKIMA VALLEY COMMUNITY COLL.FGE
(HEREINAFTER " COI J.FGE")
AND
YAKIMA FIRE DEPARTMENT
ARTICLE I
PREAMBLE
WHEREAS, the COLLEGE desires to provide for the preparation of the
students for fire science careers and "upgrading" training for regional fire
fighting personnel as part of their vocational educational programs; and
WHEREAS, YAKIMA FIRE DEPARTMENT as lead agency for regional fire
fighting agencies has the unique ability to identify instructors who are
appropriately prepared and qualified for such training programs; and
WHEREAS, the YAKIMA FIRE DEPARTMENT desires the benefits of
"upgrading" training for its fire fighting personnel and preparing potential
recruits for fire science careers; and
WHEREAS, the City of Yakima will benefit from more highly trained fire
fighting personnel;
NOW, THEREFORE, IT IS MUTUALLY AGREED THAT:
ARTICLE II
LENGTH OF CONTRACT
This contract between the above-mentioned parties shall be for a term
of one (1) year, beginning September 1, 1992 and ending August 31, 1993,
provided that, there shall be an automatic extension for an additional term of
September 1, 1993, through August 31, 1994, unless either party notifies to the
contrary the other by registered mail at least sixty (60) days before the
expiration of this agreement. During the extension period, all provisions of
and rights and privileges under this contract shall continue in full force and
effect.
ARTICLE III
PERFORMANCE TO BE RENDERED BY YAKIMA FIRE DEPARTMENT
YAKIMA FIRE DEPARTMENT agrees to:
(1) Provide related instruction under supervision of the COLLEGE to
all students registered with the COLLEGE for courses offered
pursuant to this agreement, provided such students meet any

prerequisites established by the COII.FGE for enrollment in such
courses.
(2) Secure instructors approved by the COJI.FGE who meet or surpass
COI .I.FGE minimum personnel standards for vocational instructors
as established pursuant to State Board rules WAC 131-16-080
through 131-16-094.
(3) Provide instructional materials as required for any courses
offered pursuant to this agreement.
(4) Operate such courses in conformance with all established
academic regulations and policies of the COI.I.FGE.
(5) Provide 10th day enrollment and grade reports and any other
data normally required from or about students to the COJ.I.FGE in
accordance with dates and schedules established by the COLLEGE.
(6) Act as agent for the COLLEGE and collect from each student
enrollment pursuant to this agreement and remit to the COLLEGE
all tuition and fees for these courses as required by statute, State
Board rules contained in Chapter 131-18 WAC, and rules or
policies of the COI JFGE.
ARTICLE IV
INSTRUCTIONAL FACILITIES
The YAKIMA FIRE DEPARTMENT and the COLLEGE shall jointly identify
appropriate instructional facilities located at Yakima, Washington. The
facilities shall meet all conditions and standards as required by appropriate
building and safety codes of Washington State and local agencies;
modifications and all other conditions shall be implemented and adhered to by,
and be the responsibility of, YAKIMA FIRE DEPARTMENT.
ARTICLE V
COT J.FGE REPRESENTATIVE
The COLLEGE shall designate a representative to assist the YAKIMA FIRE
DEPARTMENT with the program established by this contract. Any notice
regarding termination of this agreement by the YAKIMA FIRE DEPARTMENT
shall be made to the COLLEGE'S representative.
ARTICLE VI
RUMUNERATION
The COII.FGE agrees to remunerate the YAKIMA FIRE DEPARTMENT at the
rate of ONE THOUSAND DOLLARS ($1,000.00) for each unit of forty-five (45)
student credit hours of instruction or portion thereof produced through

programs conducted pursuant to this agreement to a maximum of FIVE
THOUSAND DOLLARS ($5,000.00) for the 1992-93 fiscal year, payable on a
quarterly pro -rata basis; such remuneration to be considered for any and all
instructional costs incurred by the YAKIMA FIRE DEPARTMENT.
Such remuneration is to be paid directly to the YAKIMA FIRE
DEPARTMENT, Yakima, Washington, 98901, who is hereby authorized by this
agreement to act as administrative agent for purposes of the receipt and
disbursement of remuneration from the COT.T.FGE.
ARTICLE VII
CREDIT AND GRADES
The number of credits for any course shall be determined by the
COLLEGE representative. The YAKIMA FIRE DEPARTMENT shall provide
recommended achievement reports to the COLLEGE representative at the end of
each course with respect to dates set by the COLLEGE registration office. The
COLLEGE representative shall arrange for the provision of appropriate records
and transcripts indicating the COLLEGE -established levels of achievement to
those students completing such courses in accordance with the regulations
and policies of the COLLEGE.
ARTICLE VIII
OPERATIONAL STANDARDS
In implementing courses, the YAKIMA FIRE DEPARTMENT shall abide by
any and all regulations concerning total classroom hours for college credits
registered. The COLLEGE reserves the right to review and evaluate the
performance of instructors and program content.
ARTICLE IX
STUDENT RECORDS
The COLLEGE shall maintain records of registration and completion for
all students registered in any course. These records shall be made available
upon request to the COLLEGE representative, provided that such request is not
in violation of the Family Education Rights and Privacy Act, USCS 1232.
ARTICLE X
NON-DISCRIMINATION
Both parties agree that neither shall discriminate on the basis of race,
sex or religion, national origin or physical disability.

ARTICLE XI
RIGHTS OF TERMINATION
Upon written notice by either party, this contract shall be terminated as
of the end of the academic year in which such notice of termination is served.
(In the event of such tee inination, each party is liable for all obligations that
may be outstanding and/or unsatisfied on a pro -rated basis as determined by
the amount, terms, and nature of the balance.)
ARTICLE XII
INDEMNITY CLAUSE
COLLEGE and YAKIMA FIRE DEPARTMENT each agree to assume
responsibility for any acts of their officers, agents, employees, and attorneys
for which they would be deemed legally liable.
