The City Council met in special session pursuant to due notice at 1:30 P.M., December 11, 1972, iri'the Conference Room at Yakima City Hall. 0 II Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Lenore Lambert, Jim Lust, Robinson, Don Schussler and Bill'Whitaker. Also present were City McMicken, City'Attorney Andrews and Administrative Assistant Jim City Attorney Andrews discussed the Marco vs. Trimble and City of Yakima lawsuit in an executive session. City Manager McMicken explained Budget cuts and asked the Council for a final decision on the'Budget strategy. • The meeting adjourned at 3:00 P.M. REGULAR MEETING - MONDAY, DECEMBER 11, 1972 - 3:00 O'CLOCK P.M. • The City Council then met in regular session at the hour of 3:00 P.M., Mayor Broad pre- siding, Councilmen Brown, Lambert, Lust, Schussler and Whitaker, City Attorney Andrews ' and City Manager McMicken present on roll call. Councilman Robinson being absent on roll call, it was MOVED by Brown, seconded by Schussler that Councilman Robinson be excused: carried, Broad,•Brown, Lambert, Lust, Schussler and Whitaker voting aye by voice vote. The Invocation -was given by City Manager McMicken.. • The minutes special meeting of December 1, 1972, special and regular meetings of December 4, 1972, and the special meetings of December 7, 1972, and December 8, 1972, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor minutes approved as recorded. This being the time set for the-Hearing•on'Petition No: 766 to vacate•a.- ,portion of public right of way, filed by Fellows and Sonnabend,'and said petition having been withdrawn by . the Petitioner; -T it :was•.MOVED by Schussler, :seconded by Whitaker_ that this matter be post- poned indefinitely: carried, Broad, Brown, Lambert, Lust, Schussler and Whitaker voting aye by voice vote. Robinson absent. Petition No. 770, Notice of Intention to Commence Annexation. Proceedings, having been filed with the City Clerk on December 7, 1972, by Raymond Crane and others, requesting annexation of property located north of the` Chalet• Mall, it was. Schussler, seconded by Brown that this date be set-as the time for a meeting with the initiating parties who signed the. Notice of Intention to Commence Annexation Proceedings dated December 7, 1972, those initiating parties being Raymond and Juanita L. Crane, and Jon and Judy Scott: carried, Broad, Brown, Lambert, Lust, Schussler and Whitaker voting aye by voice vote. Mr. Scott stating that they are willing to assume their share of the City's existing indebtedness, it.-.was duly - moved, seconded and passed thatthe annexation proposed by. petition no. 770 (Notice of Intention to Commence Annexation Proceedings) be accepted by the City'of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness, and that a Notice of Intention to Annex be filed . with the Yakima County Boundary, Review Board, The-above MOTION-was-made by Schussler, seconded by Lambert and carried, Broad, Brown, Lambert, Lust, Schussler and Whitaker voting aye by voice vote. Robinson absent. It .was MOVED by Lust, - seconded by Brown-that Ordinance No. :1.470, def in-ing .and• second hand dealers and amending-the City -of. Yakima- .Municipal Code be.passed,: -- carried, Broad, Brown, Lambert, Lust, and Whitaker voting aye on roll call; Schussler voting nay on roll call: .Robinson absent. .City Attorney Andrews explained thatthis Ordinance was the result'-,of'.the,most recent. report: to. the:;Council and instruction from the Council in an attempt to control continuous garage sales, held in competition with second hand dealers-,and thatbthis Ordinance..would help .to-check-the carrying -on of such continued or frequent sales -without being licensed to do so,. Mr. Andrews further .r-eported. •that -the Ordinance would not prevent neighbors.•from coming together for a•- garage sale, in residen -- tial areas when those sales do not continue for more than four days or are not held more than twice a year. He stated that:a copy of. said Ordinance had been sent. to Mr. Walt Dauber, Attorney for a group of second hand dealers. Mr. Thompson of- Thompson's.Barter House, being present, stated that the Ordinance does not go as far as it might, but that it is -a step in the right -;direction., , -- Councilman Schussler expressed his- opinion that-the City-would not'.enforcethis Ordinance-and that the•.City will be •relying on .second hand ' dealers'to'compla.in before•there is enforcement. Councilman Lambert expressed the feeling that, like many other City Ordinances -, this may, depend, on proper complaint to the City before appropriate action may be taken. • ORDINANCEmNO. 1470, AN ORDINANCE relating to licenses.and business-regulations; defining and regulating second hand-dealers and• providing . a penaltyr-for -violations:;• and'.amending Sections 5.64:010, 5.64.030, ,s5.64.040.1and 5.64. 100 - of :the City of Yakima.,Municipal Code. An Ordinance appropriating various amounts from unappropriated money in various funds to Expenditure.Object- -. -11, Salaries and.Wages,,having been'read••by-.title at-the meeting of December 4, 1972, and having been read again by title at this meeting, it was MOVED by Brown, .seconded by Lust that Ordinance No. 1471, providing for said appropriation, be passed: carried, Broad, Brown, Lambert, Lust, Schussler and Whitaker voting aye on roll call. Robinson absent. : • ORDINANCE NO. 1471, AN ORDINANCE appropriating various amounts from unappropriated money in various funds to Expenditure Object - - -11, Salaries and Wages, of the 1972 appropriation for such various funds. • 484 • DECEMBER 11,.1972 - Councilman Robinson present after 3:30 P.M. Reports having been received from the Planning Commission, it was MOVED by Lust, seconded by Schussler that Monday, January 8, 1973, be set as the time of hearings on the following matters: a. Yakima Federal Savings and Loan - Application for Rezone to Planned Development Zone of property at 40th and Tieton Drive. b. Va Alta, Inc. (Holiday Inn) - Application for Rezone to B -3, General Business Zone. c. Street. Name Change - Arlington East and West;' carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Petition No. 759, having been filed with :the City Clerk on December 11, 1972, by Frank Fitterer and others, requesting annexation of property located south of Englewood Avenue, it was MOVED by Lust, seconded by Schussler that the Petition for Annexation filed by :.. Frank and Sharon Fitterer and. Lawrence and Norma McLaughlin, being Petition No. 759, be approved as meeting the requirements of law; that said Petition be referred to the City Manager and Planning Commission for study and recommendation; and that January 8, 1973 be set as the date for a public hearing by the City Council on this Petition: carried, Broad Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Mr. George Twohy, Vice Chairman of the Water Survey Committee, being present, passed to ' Councilmen copies'of a questionnaire and outlined suggestions from this committee regard - ing the present.Water- Sewer 'Rate Study. Mr. Twohy recommended a water tax limit, instead of the 12.5 per cent tax to be levied, and a reduction in the proposed water -rate increase found in the Water -Sewer Rate Study. He further reported that out of sixteen cities with populations over 20,000, only Richland and Spokane are higher than Yakima in taxes. Mr. Twohy observed that 'a third of Yakima's water is being lost through old wooden pipes and reservoir leakage, and requested that Revenue Sharing money be used to make needed repairs and replacements. Mr. Bill Hempstead, Chairman of the Water Survey Committee, being present, explained a graph showing profit and loss for Yakima from 1969 through 1971. He stated that if the City could improve the profit picture, it may be able to levy less tax. Mr. Hempstead referred to a map which traced the path of the water mains into the City's reservoirs and described the leakage which is occurring in these reservoirs., He further reported that the 12.5 utility tax could be cut.to 8 per without hurting the,City financially. Councilman Robinson observed that rates•would still need to be raised for Bond commitments and that lowering the tax would help -the overall capital funds, but not the water rates. Mayor Broad indicated that Mr. Hempstead would be notified of the time for the hearing on this matter. It was•MOVED by Lambert, seconded Schussler, that Resolution No. D -1969, authorizing the City Treasurer's Change Fund and other petty cash funds, be passed: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. . , RESOLUTION NO. D -1969, A RESOLUTION amending Resolution No. D -1573, adopted December 284 1970, and authorizing the existence of a City Treasurer's Change Fund, and other petty cash funds, within the General Fund of the City of Yakima. • It was MOVED by Lust, seconded by Robinson that Resolution No. D -1970, authorizing the repair of equipment and hiring replacement of equipment without calling for bids, be passed: carried, Broad, Brown, Lambert, Lust,'Robinson, Schussler and Whitaker voting aye on roll call. City Manager McMicken explained the necessity to repair this equipment in view of snow problems. RESOLUTION NO. D -1970, A RESOLUTION authorizing the repair of a W -24 Loader, and hiring the use of replacement equipment without calling for bids. • City Manager McMicken referred to the - matter of authorization to purchase right of way property for 40th Avenue improvements and reported that an Offer to Sell had been received from William and Nadine Walker in the amount of $965. After due discussion, it was MOVED by Robinson; seconded by Lust that Resolution No. D -1971, authorizing the pur- chase of property from William and Nadine Walker be passed: carried, Broad, Brown, Lambert Lust, Robinson, Schussler and Whitaker voting aye on roll,call. RESOLUTION NO D -1971; A RESOLUTION authorizing the purchase of right of way property'for 40th Avenue improvements.. • City Manager McMicken referring to the certification by the City Engineer of the completio of work and recommendation that the work be accepted and final payment made on ,the South 16th Ave. & Nob Hill Blvd. Intersection Improvement, Sch. I and II, and Gilbert Park Parking Lot Improvement, Sch. I, it was MOVED by Robinson, seconded by Lust that the Report of the City Engineer dated December 5, 1972,'•with respect to the completion of the work on Public Works Contracts South 16th Ave. & Nob Hill Blvd. Intersection Improvement, Sch. I and II, and Gilbert Park Parking Lot improvement, Sch. I, be approved, the work be accepted and payment of the final estimates as therein set forth is hereby authorized: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote.
