DECEMBER 4i 1972 . • The City Council met in special session pursuant to due notice at 1 :30 P.M., December 4, • 1972, in the Conference Room at Yakima City Hall." Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Lenore - Lambert, Jim Lust, Walter Robinson and Bill Whitaker. Councilman Dori Schussler absent. Also present were City Manager McMicken, City Andrews and Administrative Assistant Jim Flint. City Manager'McMicken introduced 1973 Preliminary Budget cuts that hacl been made and which would comply with Council direction. A general discussion ensued. . Types of revenue which are available to fund City - programs were also discussed and include. Federal Revenue•Sharing,'Utility'Taxes and Property Taxes. • The Council discussed annexation and what effect this have on City services. • The meeting adjourned at 3 :00 P.M. • REGULAR MEETING - MONDAY, DECEMBER 4, 1972 - •3 :00- O'CLOCK P.M. • The City Council then met in regular session at the hour of 3:00 P.M., Mayor Broad pre- . - siding,. Councilmen'Brown, Lambert, Lust, Robinson and•Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Schussler having requested mission to be excused, it was MOVED by Lust, seconded by Robinson' that Councilman'Schussle. be excused: carried, Broad, Brown, Lambert, Lust, Robinson and Whitaker voting aye by voice vote. • • The Invocation was given by Councilman Jim Lust. • The minutes of the special and regular meetings of November 27, 1972, having been duly • certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly,•.Mayor Broad declared said minutes approved as recorded Charter Amendment Number Five,.having been passed in the November 7,.1972, election, per- . mitting the reading of Ordinances and Resolutions by title only at City Council meetings, said Charter Amendment was read from. the Charter Book of the City of Yakima by Councilman Robinson, after which there was a signing of the Authentication of the Charter Amendment • by Mayor Bert Broad, which signature was attested by City Clerk Jack Daniel. • Councilman Schussler present after 3:30 P.M. . Thais being the time set for the Hearing on the proposed Walnut Street Undercrossing Improv : - ment Project, Public Works Director, Dave Vargas, passed to Councilmen'copies of the ABAM Preliminary•Project Design Report l and reviewed the various proposals of this report, including the following.recommendations: 1. Widening traffic lanes from 92 feet to 14 feet. 2. Developing a system for water drainage to a low point of the underpass for piping into a storm drain along First Avenue. 3. Installing elevated sidewalks almost three feet above the street level. 4.• The planting of street trees.- . • 5.. Surface-treatment to the retaining walls. 6.. Increase of the Underpass clearance from 12'feet to 15 feet. Mr. Vargas•stated that the project would range' from South First Avenue to South First Street. He further.recommended the exposed aggragate treatment for the retaining walls, stating that there would be an added benefit of lighter color as well as blending with the treatment proposed for the tree planter areas. Mr. Vargas recommended the _installation of plastic pipes for irrigating the trees, which will•cost $5 -$100 per tree. He reported' that mercury vapor lighting will-be installed at a cost of $30;000. Mr. Vargas further reported the.total cost of this project to be approximately $1,003,686. Mr. Arthur Fellow- being present, stated that he saw-no need . for --the placement of trees in this area: Councilman Lenore •Lambert'observed that these trees would help reduce smog and the level of noise along this area. Mr: Woods, being. present, expressed the importance of street • lighting and signalization on South First Street and Spruce Street, and stated a concern for those people' trying to get onto First Street from Spruce while Walnut Street is closed. Mr. Vargas reported that the Union Pacific Railroad has tentatively agreed to the removal of one of the four tracks at the intersection of•South'First Avenue and Walnut Street during the time the work on the Underpass is being Conducted and stressed that any further work such as this should be done while the street•is closed to avoid future closure". He expressed a regret that rubber pads for the railroad crossing were not 'included in the project, but-that the street - would be resurfaced around the Mr. Marble;• being present, also asked for street - lighting -at the intersection of South First Street and Spruce Street. Traffic Engineer, Al Ray, stated that the signal at First and Walnut will be in operation and that the flashing signals on First and D Streets would eventually be removed. There was discussion regarding the t'urn•rad.us required for accommodating. large tducks south "of Walnut Street at the ' intersection. Planning :Director, 'Jay Otto, being present, reviewed the Planning Staff report and stated that the Staff recommends the utilization of exposed aggragate for the retaining walls. He recommended that the Preliminary Report on the Walnut Underpass design be approved for the following reasons: 480 .. DECEMBER 4, 1972 1. The proposed project conforms to the General Plan's designation of Walnut Street as a major arterial. 2. The project as presented'in the report is acceptable from the engineering stand- point. • 3. The development would be an aesthetic and functional improvement to this portion of the City and the overall circulation system for the City. After due discussion, it was MOVED by Schussler, seconded Brown..that the Engineers Preliminary Design - Report be approved, and adopted utilizing exposed aggragate . surfacing. for the retaining walls, that bids be called for on this project, and that signalization of the project be referred to the staff for study and recommendation: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting,aye by voice vote. Council- man Robinson expressed his opinion that the placement of trees in this area was unnecessary An Ordinance appropriating various amounts from unappropriated money. in - various funds to Expenditure Object - - -11, Salaries and Wages, having been read by Title, was laid on the table one week, or until December 11, 1972. .City Manager McMicken explained that this Ordinance was necessary to accommodate the retroactive pay to October 1, 1972. • An Ordinance appropriating the amount of $85,800.57 from unappropriated money in 382 - Cumulative Reserve for Capital Improvement and transferring that amount to 143 -Urban Arterial Street Fund, having been read in its entir.ety.at the meeting of November 27, 1972, and being read by Title only at this meeting, it was MOVED by Robinson, seconded by Lust that Ordinance No. 1467, providing for said appropriation;.be passed: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting on roll call. City Manager McMicken explained that this appropriation would provide matchi ig funds for project. to be financed by the Arterial Street Fund. ORDINANCE NO. 1467, AN ORDINANCE appropriating the amount of $85,800.57 from unappropriated money in 382 - Cumulative Reserve for Capital Improvement Fund and transferring that amount to 143 - Urban Arterial Street Fund. It was MOVED by Robinson, seconded by Lust that Ordinance No. 1468, relating to personnel and specifying city employees eligibility for leaves of absence and amending the City of Yakima Municipal Code by passed carried,•Broad,_Brown, Lambert, Lust, Robinson,•Schussler and Whitaker voting aye bn roll call. City Manager McMicken explained that due to an oversight when passing the last Ordinance relating to this same subject, the emergency • Funeral leave for Police and Firemen had been omitted, neceessitating the prese.nt'Ordinance ORDINANCE NO. 1468, AN.ORDINANCE relating to personnel; specifying city employees eligible for leaves of absence; amending Section 2.40.010 of the City of Yakima Municipal Code; and declaring an emergency. . It was MOVED by Robinson, seconded by Lust that Ordinance No. 1469, imposing annual utility taxes and amending the City of Yakima Municipal Code.be..passed: carried, Broad, Brown,. Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll-call. City Manager , McMicken explained that this is an annual tax which the.City.levies against private utilities which is passed on to the consumer and stated that the present percentages remain the same. Present and speaking to this matter from the audience was Mr. Harold Floyd. ORDINANCE NO. 1469, AN ORDINANCE relating to licenses and business regulations; fixing and imposing annual license fees or taxes on certain utilities and providing for a surcharge; saving certain taxes; amending Subsection 5.50.050 (A) of the. City of Yakima Municipal Code; and declaring an emergency. • It was MOVED by Brown, seconded by Schussler that Resolution No. D -1967, authorizing a contract revision agreement with Gilbert H. Moen Company.be passed: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. City Attorney, Fred Andrews, explained that the existing contract needed.to be amended :to comply in lan- guage with State requirements and to provide means for payments and retained percentages in relation to the construction of Lions Park and Eisenhbwerrf swimming pools. RESOLUTION NO. D -1967, A RESOLUTION authorizing and directing the City Manager•and City Clerk of the City of Yakima to execute a Contract Revision Agreement with Gilbert H. Moen Company relating to construction of Lions Park and'Eisenhower swimming pools. • •• Mr. William Kirby, a•local service station employee, being present,•asked, that his name be placed on the list of' possible candidates to fill the•unexpired term of Lenore-Lambert on the Council. Mr. Kirby proceeded to give information concerning his background, including his place of birth and residence, service with the U.S. Marine. Corps, two years of .service with the Park Department as a Playground. Supervisor, and -three years. of service coaching a Miller swim team. -Mr. Kirby further expressed his interest in City and Council affairs. Mr. Jack Sparling, Chairman of the Convention and Cultural - Center Task Force,• stated that the Task Force needs another 60 days in which to prepare a recommendation for the Council and requested this extension of time. Mr. Sparling further reported that the Task Force is now doing serious planning and stated that the committee.will return.in 60 days to, make a presentation on the Convention and Cultural Center. It was MOVED by Robinson,.seconded by Brown that Resolution No.-.D -1968, approving- a form of contract providing for installment payments on water and sewer connection charges -be passed. carried, Broad, Brown, Lambert, - Lust, Robinson, Schussler and - Whitaker voting-aye on,roll call. City Manager McMicken explained that there was previous approval for 10-year pay ment. He further stated that the first paragraph of contract had- been revised to • accommodate the Alegria and Huck Annexation, making it possible for the owner to connect as soon as possible. - • . • .. • , . 481 • DECEMBER• 4, 1972 ., RESOLUTION NO. City Manager McMicken called for a demonstration of the portable television and video- , tape equipment now -used •in the Police Department.- Police Chief,. Jack LaRue,:explained that this piece of equipment was purchased through a City grant earlier''this year. Sergeant Dutcher, of the Yakima''Police Department, proceeded to explain the uses of the II equipment- in- - Police • court cases'with the use of a :'demonstration tape. .He' briefly reviewed the approximate costs of the video -tape equipment to 'Councilmen.
