Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Lenore Lambert, Walter Robinson, Don Schussler and Bill Whitaker. Also present were City Manager McMicken City'Attorney Andrews, and Administrative Assistant Jim ` • . Mr. Sebastian, a Yakima citizen, expressed his views to the Council r- egarding YVT and the pending franchise negotiations. The Council discussed the 1973 'Budget and City Manager McMicken.gave the Council a brief report on some contemplated reductions in the preliminary budget, including' some reduc- tions in additional personnel requested by some department heads. No final decisions were made at this time,'pending further consideration. • 1 • The Council heard a report from City Manager McMicken regarding a proposal for the sale • of the Masonic Temple to the City.' A visit to Masonic Center by Citizen representatives and Staff members was planned. • The meeting adjourned'at'3 :00•P.M.° . • • REGULAR MEETING - MONDAY, NOVEMBER 27, 1972 - 3 :00 O'CLOCK P.M. The City Council' then met in regular' session at the hour 'of 3 :00 P.M., Mayor Broad pre- siding, Councilmen Brown, Lambert, Lust, Robinson, Schussler and Whitaker, City Manager McMicken'and City'Attorney Andrews present on roll call. . The Invocation given by Councilman Wray Brown.' ' The minutes of the special meeting of 17, 1972, special and regular meetings of November 20, 1972, and the special meeting of November 22, 1972, been duly certi- fied accurate by two Councilmen, one present wishing to'" have said minutes read publicly, Mayor declared said minutes approved "as recorded. City Manager McMicken referred to Memoranda of•'Agreement with IAFF," YPPA", a:rid AFSCME regarding:labor negotiations and explained that it'required "ratification` prior to the passage of the Ordinance relating salary"ranges: Mr. McMicken read the agreement'which the Fire Fighters had signed and stated that this agreement is representative of the others. He reviewed the_contents of agreement and stated for "saaary • increases and longevity, •explaining that another Ordinance will be submitted to cover the salary increases effective January 1, 1973, and covering that year. Mr. McMicken further reported that Police and Firemen do not have Blue Cross and the medical' insurance would include $3.00 - toward the'"premium for medical coverage'and stated that as of January 1,'1973, $13.50 would be paid toward.the premium of each of the employees. 7He r.eported'that.Police'and Fire will have once -a -month pay schedules; that most City employees had requested a twice -a -month schedule. He stated that the Ordinance will be retroactive to Octoberll, 1972. After due discussion, it was MOVED by Robinson, seconded by Lambert, that the Memoranda of'Agreement with the 'IAFF,'YPPA and • AFSCME be-ratified: carried', Broad, .Brown, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. . It was:MOVED by Schussler, seconded by Whitaker that Ordinance No: 1464; relating to a revised classification andsalary ranges for City employees,.be passed as read: carried,' Broad, Brown , Lambert, Lust, Robinson, Schussler - and Whitaker voting aye by voice vote. ' ORDINANCE. NO."1464 ;'AN'ORDINANCE to a classification plan and salary ranges for certain.city employees; amending'Section 2.20.100 of the City of Yakima Municipal Code; and declaring - 'an 'emergency. It was MOVED by Lust, seconded by Lambert that Ordinance No. 1465, relating to licensing and business regulations on.dances music', and entertainment,'be passed as•'read: carried, • Broads ;` :Brown; Lambert, Lust,' '"Robinson,'. Schussler and Whitaker voting' aye on roll call. City Clerk Jack Daniel, explained the proposed 'amendments•to Sections -'5 ;28 - and 5.46 of the Yakima-Municipal Code; -r-eporting .that •each - application for a one - Flight dance 'permit would consist of $15.00 to be credited toward the license fee, thereby'making the fees consis- tant between the two sections of the . Code. Mr. Daniel further explained that Section 5.28, as presently - written, allows :the $15.00. charge; but that Section 5 46' allows only $10. He the $15.00_'charge is appropriate,',since " there :are'adni'riistrative costs involved in processing applications -with respect to - fire inspections and police reports. ORDINANCE NO. 1465,'AN ORDINANCE relating to licenses and business.regulations; providing for applications for permits and :payment of permit fees for dance halls cabarets and entertainment licenses • for - premises licensed to - serve': liquor; 'and amending Section'5.28. 100 subsection : 5.46.030 .("b) :, :. and adding subsection 5 :46.030 (c) all d: the City of Yakima Municipal Code. It was MOVED by Robinson,- seconded by Lust that Ordinance No. 1466, amending the City of Yakima Municipal Code to reduce the permissible height of obstructions at street inter- sections be passed as read: carried, Broad, "Brown,•Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. Councilman Robinson requested an explanation of this amendment by Public Works Director, D.ave.Vargas.. Mr.'Vargas stated that the present three feet requirement does not provide clear vision for small cars and the proposed two r 476 . NOVEMBER 27, 1972 feet provision would provide for a growth allowance so that shrubbery would not grow to be a hazard soon after being trimmed. He further stated . that if a cement retaining wall had been placed at the corner of an intersecting street by the property owner, that owner would be asked to remove it, but if the City had placed it, it would require permission to remove it at the City's own expense. Mr. George Gaiser, being present, spoke in favor of the proposed Ordinance and stated an existing problem on South 18th Street where a hedge is high on both sides of the road . and requested that action be and enforced. Public Works Director, Dave Vargas, also reported that hedges would not be permitted to obstruct alleys: -- This being the time set for a report from - the City Engineer on the percentages of protest on the Franklund Pear Blossom Addition and Others Paving District, Public Works Director, Dave Vargas, reported on the amount of protest on Alley -Block 27 and stated that all those on the west side of the alley had protested, but that no protests were received from the east side, explaining that the advertising charge on the L.I.D. on the west side would be $20.00 higher due to the presence of two more owners and a $20.00.higher assesment. Mr. Vargas reported that 60 per cent protest is required to defeat a project, but that policy has been to accept 50 per-cent of protest. He further recommended paving the alley, since the maintenance on unimproved streets is higher and money would be saved through paving now. Mr. Vincent, being present, stated that this area is zoned commercial and that most of.the property on the west 'side is in a state of disrepair, with almost all of the property being for-sale. He further - requested that improvements be made now, since the alley in the block north and south of it are paved. Mrs. Ruth Schneider, - being present, reported that the Haunted House on the west side was to be torn down after use and stated that when the alley was dug to replace irrigation piping, tenants were not informed and plastic piping was reportedly placed inside the old wooden pipes. She stated that asses - ments were much too high for those on a limited income. She suggested that those buyers of the homes on the west side by asked to pay. Mr. Howard Elofson, being present, requested that the alley be paved to be consistent with the surrounding neighborhood. There was discussion as to a change in the Council's policy for percentages of protest required to defeat a project. Councilmen Schussler stated that he did not believe it necessary to change the policy, but that the alley should be treated . as a special case in this situation. Councilman Brown. stated opposition to the paving. Others present and speaking to this matter were Mr. Ray Spratt and Mr. Stan Hiatt. Public Works Director, Dave Vargas, continued to report on the amount of protest on the other paving projects, stating that the portion outside the City on 32nd Avenue and Carol Avenue had been pro- tested out and recommended that the City go ahead with improvements to those areas inside the City. He also reported that. there could be no joint L.I.D. formed by the City and County because of the large percentage of protest from outside the City. He further reported that the most frequent cause of protest is the cost of the assessment. He reported only one protest on Rock Avenue and on 50th Avenue, but stated that the outside City portion. of Madera Way had been protested out. After due discussion, it was MOVED by Robinson, seconded by-Schussler that the described portions of 32nd° and 33rd Avenue, Carol and Clinton, Rock Avenue, North 50th and Madera Way, plus the alley -Block 27 be paved, with the exception of those parts protested out, and 50th and Madera Way be limited to the portions described by Mr. Vargas: carried, Broad, Lambert, Lust, Schussler andt Whitaker voting aye by voice vote; Brown voting nay by voice vote. City Manager McMicken referred toga letter received from Mr. Mark D. Spahr concerning the Yakima Water System and stated that the recommendations given place more responsibilities on the City in this field and reported that Utilities Director, Frank Stein, is working on the preparations for a Cross Connection Control Ordinance,. It was the decision of the Council to bring this matter back for discussion at a later Council meeting. City Manager McMicken referred to his report No. 160 concerning the Yakima Valley Trans - portation.Franchise Renewal. Mr. Walt Shields, Manager of Yakima Valley Growers & Shippers Association, stated that he did not believe a five -year renewal to be sufficient for future expansion plans by some plants served by the line and observed that if renewed for only five years, plants may have to relocate in the Lower Valley. He further reported that the removal of these industries to the Lower Valley would have a direct effect on the down- town area of Yakima. Mr: - Shields recommended a 25 -year franchise renewal. Mr. Stafford, being present, stated that approximately 200 employees from his plant in Selah would be required to move if the YVT franchise renewal failed. Mr. Hart Fellows, being present, suggested possible track relocations and track improvements to allow cars to proceed unhindered on main streets. Mr. H. G. Wells, Secretary- Treasurer of the Greater Yakima Chamber of Commerce, reported on a decision by the Board of Directors, which favors a 25 -year franchise renewal, since the growers and shippers in this area depend on this line and it is essential to the economy of the Yakima Area. There was discussion as to'the possible track relocations and the costs of each. After due discussion, it was MOVED by Schussler, seconded by Whitaker that December 18, 1972, be set as the date for a'public hearing on the matter of the YVT Franchise Renewal: carried,'Broad, Brown, Lambert,.Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Petition No. 767, having been submitted to the City Clerk on November 10, 1972 by Chester Perry and'Others, requesting the revocation of Business License from Dental Arts Labora- tory at 1612 South Third Avenue, and having been referred to the Staff for study and for recommendation at the previous meeting, City Manager McMicken reported that the Laboratory had been found to be an authorized home operation under the Municipal Code. Mr. Tom Rasmussen, Attorney for the owner, Duane Wessman, reported that the business is being conducted according to the code requirements and that the matter is a case of neighborhood dispute. Mr. Rasmusson,further stated that he concurs with the findings of the City. Mrs. Perry, being - present, reported that all the neighbors in the 1600 block had signed the petition and that in checking with the City, she had been informed that the area was zoned residential. City- Attorney Andrews confirmed that the area is zoned residential and since the business is a home occupation, it can be located in the residential area. City Clerk, Jack Daniel, reported on the visit by Mrs. Perry in which she registered a complaint. This resulted in a visit to the owner of the business to a'sk questions and Mr. Daniel had found that on the basis of the information given, the Business follows the City Ordinances. Mr. Daniel further reported on a second complaint by Mrs. Perry and a second visit in which Mr. Newell Pock and Mr. Daniel had gone back to the owner and found that on an occasion of the owner's wife going to the hospital, the owner had brought in outside domestic help, which was not a violation of Ordinances. City Manager McMicken requested Mrs. Perry to report any outside employees seen by Mrs. Perry to the City, at which time it will be determined if the owner is in violation of an Ordinance. • • c • :—.477 • NOVEMBER 27, 1972 Councilmen Lust and Whitaker 'absent after 5:30 P.M. • . City Manager McMicken referred to the authorization for the temporary closure of Second Street and reported that preparations had'begun:..•.:,There was discussion as,to the parking angles and •Mr, McMicken reported the portion, of the street to be: used, ,for parking area,. stating that exit routes would, be north. on Second, - -or west on A "- Street., Public Works . Director, Dave Vargas, reported on the plans•for barricades- across the street and the appropriate signs for the lot. There was discussion as to the effect of free parking on the Mercy Parking'.Lot. City Manager McMicken explained that the crosswalk on - Third Street would not have lights or signals, but would have an island. in the middle ..Mrs. Vargas reported-that. the Mall Board had expressed displea.s•ure over the free parking being offered in competition• with their large parking lot...,After due. discussion, it was MOVED by Brown, seconded by Schussler that Resolution•No. D -1- 963 - ; authorizing the temporary closure be passed as read: carried, Broad, Brown and Schussler voting aye on roll call,- Councilmen Lambert, Lust-and Whitaker absent. D -1963, A RESOLUTION authorizi -ng ;the•temporary through traffic of a portion -of North 2nd Street in the City of Yakima; and establishing regulations for use of the closed - portion of such street. - - - - ,- • It was MOVED by 'Robinson, seconded by Brown =that Resolution No.. City Manager McMicken requesting authorization for the following out ;of -state travel requests: 1.• Homer Matson, Chief, Housing and Renewal, for 'travel" to.Salem, Oregon, to attend the NARHO Regional Board Meeting, November 30, 1972 - December 1, 1972. 2. Francis Jaeger, City Engineer, for travel to St.'Paul, Minnesota,-to confer with Burlington Northern Officials on the Walnut Street Underpass final design, con - struction schedules, and specific details, November 26, 1972 - November 28, 1972, it was MOVED by Robinson, seconded by Brown that said travel be approved and expenses.
