HomeMy WebLinkAbout11/20/1972 Special Meeting / Regular Meeting D 471 NOVEMBER 20, 1972 • MINUTES OF SPECIAL MEETING . • YAKIMA CITY COUNCIL ' NOVEMBER 20, 1972 • The City Council met in special session pursuant to due notice at 6:30 P.M., November 20, 1972, in the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Lenore Lambert, Walter Robinson, Don Schussler and Bill Whitaker. Councilman Jim Lust absent. Also present were City Manager McMicken, City Attorney Andrews, and Administrative Assistant, • Jim Flint. The Council discussed some general aspects of the budget. The City Manager reported to the Council that suggested budget revisions will be submitted to the Council next Monday, November 27, 1972. The Council sheduled the formal hearing to commence on December 1, 1972, at 1:30 P.M. The Council discussed proposed fees for park and . recreation activities, and reached the consensus that the Council shoulld determine or approve fees for various park and recrea- tion activities, particularly the rates for swimming and golf. The Council determined that it should reserve to itself the determination of policy as to whether or•not a differential should be established in such rates for city residents and non - residents. Councilmen considered a number of prospective appointees to the City Council and to various boards and commissions. The decision was made that the Mayor will be appointed to the Conference of Governments. No further appointments were made. The meeting adjourned at 8 :00 o.'clock P.M. • REGULAR MEETING - MONDAY, NOVEMBER 20, 1972 - 8:00 O'CLOCK P.M. The City Council then met in regular session at the hour of 8:00 P.M., Mayor Broad pre - siding,,Councilmen Brown, Lambert, Robinson, Schussler and Whitaker, City'Manager McMicken and City Attorney Andrews present on roll call. Councilman Lust being absent on roll call, it was MOVED by Robinson, seconded by Schussler that Councilman Lust be excused: carried, Broad, Brown, Lambert, Robinson, Schussler and Whitaker voting aye by voice vote. The Invocation was given by Councilman Lenore Lambert. • The minutes of the special meeting of November 10, 1972, and the special and regular meetings of November 13, 1972, and the special meeting of November 14, 1972, having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor. Broad declared•saidhminutes approved as recorded. . Councilman. Lust present after 8:10 P.M. This being the time set for the Hearing on the matter of the Vacation of E. Beech Street between South 8th and 9th Streets, having been continued. from October 13, 1972, and Petition No..769.having been filed'with the City Clerk on November 20, 1972, by approxi- mately 6 persons protesting said vacation, City Manager McMicken passed around to the Council members the Planning, Staff report concerning the proposed vacation and the recom- mendations from the Planning Commission. Planning Director, Jay Otto, reviewed this Staff Report and reported that the Planning Commission recommends the closure of Beech Street to be used for the proposed Park and, in addition, requested that the following two alter- nate routes be. considered: (1) North 18th Street out of the Concrete Plant to Yakima Avenue or Terrace Heights Road; (2) West from Beech Street to Fair Avenue and from Fair Avenue to Nob Hill, or 6th Street. • Mir. Otto further requested that none of the traffic be encouraged to use either Maple or Spruce. He stated that the Planning Staff members had taken a tour through the area in the afternoon of November 20, 1972, to deter- mine possible alternate truck routes and that as a result, the Planning Commission recom- mends the closure of Beech Street and the utilization of the alternate routes presented. Mr. Otto cited the results of a traffic count conducted on Beech Street which he believed revealed Beech Street to be a minor residential street. Mr. Warren Dewar, Attorney repre- senting Superior Asphalt & Concrete Company, emphasized the fact that North 18th Street has four ninety degree turns, is a narrow road, has notstreet light at Yakima Avenue, and gets a great deal of traffic use during the day.' He further stated- that more trucks would be using .Yakima Avenue if 18th street were utilized and that Maple would not be suitable because of the nearby school, while,.,Spruce would be dangerous due to the-park nearby. Mr. Dewar reported that Beech is. advantageous, as •a straight street and that any other route would not be economical for the two companies. He observed that safety seemed to be the main issue and recommended some sort.of traffic control device, such as fencing around the playground and park and push- button traffic lights at the crossings. Mr. Dewar emphasized that the City is not legally bound to close Beech, since there was not a. direct tie of the Bond issue to its closure. In referring to Petition No. 769, Mr. Dewar stated that it was signed by .people both inside and outside of the Beech Street vicinity who use this route to reach the plant and that Beech is more than,a residential street since it carries heavy truck traffic with 200 -250 trucks passing daily. He reported on an analysis of Petition No. 769 and stated that .approximately 63 persons who live in the area want to close the street, while 150 are in apposition to the closure. Mr. Albert DeAtley, Secretary Treasurer of Superior Asphalt, reported on the unloading of cars onto Pacific by the Yakima Speedway and emphasized that Beech is a- major arterial used•by the Yakima Speedway, Fair grounds, and Ice Arena. Mr. DeAtley stated that 68 persons inside the target area wanted the street closed, while 163 indicated opposition to the closure. He requested that the Staff go out and talk to the people in that, area and discuss alternatives with County Engineers. Mr. Beauchamp, Director of Southeast Community Center, opposed the idea of having children operate a push-button light at crossings, and stated 18th Street to be the best route. Mr. William. Schultz, Safety Director of Yakima Schools, reported that in • the interest of safety, the street Tshould be closed. Mrs. Pleasant, President of the AA X 472 NOVEMBER 20, 1972 Washington Junior High P.T.S.A., requested that Yakima County be engaged to help the two companies find a suitable route since they are not incorporated into Yakima. Public Works Director, Dave Vargas, reminded the Council that Walnut is scheduled to be closed for one year and alternate routes will have to be taken by those normally traveling that street also. Traffic Engineer, Al Ray, reported that Beech Street is 40 feet wide without park- ing, and stated that although Pacific is wider, it is only 24 feet wide after parking is considered. Mr. Ray reviewed the steps necessary in preparing for an Arterial and the funding sources. Councilman Schussler requested information as to whether the Council had the authority to determine and enforce a particular truck route, and indicated that the Council had.not previously realized the volume of truck traffic on this street and observed. that Beech is clearly not appropriate for heavy traffic. Others present and speaking to this issue were Mr. Adams, Mr. Lee, John Taylor, Pat Lawler, Jean Bradford, Bernie Lindeman and Nancy Fowler. It was MOVED by Schussler, seconded by Lust that the Hearing be closed: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. . It was MOVED by Brown, seconded by Schussler that Ordinance No. 1461, providing for the Vacation of E. Beech Street between South 8th and 9th Streets be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. Councilman Robinson explained his disappointment with the recommendation of the Planning Commission and emphasized that he did not believe 18th Street to be a suitable solution and that people on the other streetswill have similar problems when - another street is utilized. Councilman Whitaker explained that he felt the problem would be transferred from one area to another, but that the City should go through with its original intention to close the street. ORDINANCE NO. 1461, AN ORDINANCE providing for the vacation of a portion of public street in the City of Yakima, Washington. Petition No. 767, having been filed with the City Clerk on November 10, 1972, by Chester Perry and Others, requesting the removal of a business license from Dental Arts Laboratory at 1612 South Third Avenue, it was MOVED by Robinson, seconded by Schussler that said petition be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. A Damage Claim having.been filed with the City Clerk on November 16, 1972, by Mrs. Henry C. Moen, for damages caused during a fall over raised cement, it was MOVED by Lust,' seconded by Schussler that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Broad,. Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. It was MOVED by _Robinson, seconded by Lust that Ordinance No. 1462, creating the Federal Shared.RevenuegFundsbe passed as read: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye•on roll call. ' ORDINANCE NO. 1462, AN ORDINANCE creating the Federal Shared Revenue Fund -gas a special fund of the City of Yakima; specifying the source of revenue to be deposited in such fund; designating the purposes of such fund; providing for the method of expenditure from such fund; adding Chapter 3.87, "Federal Shared Revenue Fund ", to consist of Sections 3.87.010, 3.87.020 and 3.87.030, as a new chapter and new sections of the City of Yakima Municipal Code; and declaring an emergency. It was MOVED by Lambert, seconded by Robinson that Ordinance No. 1463, creating the Inter- governmental Agency Fund be passed as read: carried, Broad, Brown, Lambert, Lust, Robinsor_ Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1463, AN ORDINANCE creating the Intergovernmental Agency Fund as a special fund of the City of Yakima; specifying the purpose of such fund and providing for expen- ditures therefrom; adding Chapter 3.86, "Intergovernmental.Agency Fund ", to consist of Sections 3.86.010. and 3.86.020, as a new chapter and new sections of the City of Yakima Municipal Code; and declaring an emergency. Councilman Robinson absent after 9:45‘P.M. There was brief discussion concerning a replacement for Councilman Lenore Lambert. Those • present and speaking to this matter were Mary Jean Lord and Mrs. Rich. Councilman Lenore Lambert explained her position relative to a replacement and read a statement directed to the Yakima Herald Republic, which verified an error in reporting. The matter of a sanitary sewer installation without calling for bids was brought on for discussion. Public Works Director, Dave Vargas, reviewed the matter of the sewer exten- sion and the fact that work had been started by A.V. DeBlasio and reported that two- thirds of the people eligible want the extension and want to connect to the sewer. City Manager McMicken reported that the Council had previously opposed an accomodation for the Alegria property and stated that the City's Utility Fund would finance the project. He further reported that U'tilities'Director, Frank Stein, had found that people, were not billed unless they were directly hooked to the sewer and those not connected will not be asked to pay the service charge. Mr. Ralph Huck, being present, commented that he had been trying to get a sewer in for two years and explained the problems now being experienced in that neighborhood. He reported that outside agreements had been signed and those people wantinc the sewer are ready to' hook on, but stated that there is a lack of the required 75% who have indicated they would be willing to connect. After due discussion, it was MOVED by Brown, seconded by Lust that Resolution No. D -1960, authorizing the extension of the contract with A.V. DeBlasio without calling for bids be passed as read: carried, Broad, Brown, Lambert, Lust, Schussler and Whitaker voting aye on roll call. Robinson absent. RESOLUTION NO. D -1960, A RESOLUTION authorizing the extension of an existing contract with A.V. Robinson absent. RESOLUTION NO. D -1961, A RESOLUTION authorizing - payment of a claim filed with the City of Yakima by Officer.. Vernon W.• Henderson of the Yakima Police Department. It was MOVED by Brown, seconded by Lust .that. Byron and Janet Snodgrass. in the .amount of..$486..00_ for land, grass, and driveway. . RESOLUTION NO. D -1962, A RESOLUTION authorizing the purchase of right of way property for . 40th Avenue improvements ... .. _... .: :.1.: .. . . , . . . . . City Manager McMicken referred to the traffic signal plans for the Central.Bus.ines.s Dis -. trict. Traffic Engineer, Al. Ray, gave a report on the dates for signalization and light- ing on Lincoln .and, B Streets 40.th Avenue and . Nob. Hill,: 32nd and. Nob .Hill, 16th and Nob. Hill, and Yakima Avenue. -. . • ., Mayor Broad referred to the matter of .a mid -block .crosswalk for Second and _Third Streets at the alley, and asked if. the Council would like .to: try the mid - block crosswalk on an experimental basis. There was considerable.discussion ; as. to the..pos.sibility of install- ing a crosswalk with bar.rels.,.se.t. up.with some sort of blinking, .Lights to warn. cars. Several variations of that idea were discussed. Traffic Engineer, Al Ray, expressed con- cern_.over an arrangement of this..type and the.problems which might be.connected,with it. After due discussion, it was MOVED by :Lambert, seconded by.Lust.that the matter of the 'mid -block crosswalk be continued for one week: carried, Broad, Brown, Lambert, Lust, . II City Manager McMicken referring to the certification by the City Engineer of the comple- tion - of work and recommendation that the work be accepted and. final payment made on the 32nd Avenue and Nob Hill Blvd. Intersection improvement and the Rowe Hill Wells Pump & . Water System Installation, it was MOVED b.y seconded by that the Report of the City Engineer dated November 16, 1972, with respect to the completion of the work'on Public Works contracts South 32nd Avenue & Nob Hill Blvd. Intersection. Improvement and Rowe Hill Wells Pump & Water System Installation be approved,. the work be'accepted and payment of the final estimates as therein set forth is hereby authorized: carried, Broad, Brown, Lambert; Lust, Schussler and Whitaker vot.ing.aye by voice vote.
