D 62 0 3 A RESOLUTION authorizing the City Manager and the City Clerk of Yakima to execute a Quit Claim Deed to release four (4) sewer and water easements across property owned by US Bank of Washington, NA. WHEREAS, the City of Yakima has over time acquired four separate easement deeds (recorded under the following Yakima County Auditor's File Numbers 875926, 875927, 1711691 and 1711692) for the purpose of installing and maintaining water and sewer lines across the property now owned by US Bank of Washington, NA, and WHEREAS, the water and sewer line easements in question interfere with construction plans for a new branch bank building and WHEREAS, two of the existing lines need to be installed in a different location and the remaining two lines are no longer required, and WHEREAS, the responsible City Water and City Sewer departments have indicated that the easements are either no longer needed or can be adequately relocated, and WHEREAS, the property owner has requested that the City release these easements, and WHEREAS, the City Council deems it to be in the best interest of the City that the easements be vacated, on the basis that no public interest is served by retaining them in their original form and because no marketable value exists now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and the City Clerk are hereby authorized and directed to execute a "Quit Claim Deed," a copy of which is attached hereto and by reference made a part hereof Said deed is to be held until such time as the City Engineer has approved and accepted the realigned sewer line and a new easement in favor of the City of Yakima has been received. . 4 ADOPTED BY THE CITY COUNCIL this2 7 day of OC -1-015- , 1992.
