A RESOLUTION:authorizing the execution of an On -The -Job
Training Agreement with Daniel K. Ruff and the
Washington State Division of Vocational
Rehabilitation.
WHEREAS, the City of Yakima, Daniel K. Ruff, and the
Washington State Division of Vocational Rehabilitation desire to
arrange for on-the-job training of Mr. Ruff at the City
Wastewater Treatment Plant; and the City Council of the City of
Yakima deems it to be in the best interests of the City that
such an arrangement be carried out according to the provisions,
terms, and conditions of the attached agreement document and
that it is in the best interest of the City that the attached
agreement document be executed, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk of the City of Yakima are
hereby authorized and directed to execute an agreement with
Daniel K. Ruff and the Washington State Division of Vocational
Rehabilitation for the purpose mentioned above, a true copy of
which agreement, entitled "On -The -Job Training Agreement With
The City Of Yakima," is attached hereto and by reference made a
part hereof.

ON-THE-JOB TRAINING AGREEMENT WITH
THE CITY OF YAKIMA
TRAINER: City of Yakima, Wastewater Treatment Plant
TRAINEE: Daniel K. Ruff
AGREED:
1. Training will be provided by the City of Yakima as a Wastewater Treatment
Pla, t O.erator in training, 40 hours .er week for 52 weeks commencing
and ending on 5' All related training expenses will
be paid by the Division of Voca ion:1 Rehabilitation.
2. The Process Control Supervisor at the facility will provide general
supervision and outline training activities.
3. Mr. Ruff will engage in the following: chlorination, janitorial, equipment
maintenance, laboratory testing, plant operations, log entries, monitoring
plaint improvement, gathering samples, cleaning various plant equipment,
and other related duties as required.
4. Mr. Ruff will be responsible, prompt, efficient in his work and timely in
his academic assignments, and abide by all rules of conduct of employees of
the City of Yakima.
5. Noel Kelley, Division of Vocational Rehabilitation Counselor, will provide
monitoring of the plan and will assist both the trainee and the trainer as
needed. The trainer will supply monthly training evaluations to the
Vocational Rehabilitation Counselor to assist in the monitoring activity.
6. The City of Yakima will not be responsible for any liability for on-the-job
injuries during the training period. Mr. Ruff will not have Labor and
Industry coverage through the City of Yakima. Mr. Ruff has private
insurance coverage through Washington State Basic Health Plan. He also
has Labor and Industries coverage for pre-existing conditions related to his
Labor and Industry claim. The Division of Vocational Rehabilitation will
not be responsible for any liability for on-the-job injuries during the
training period.
Mr. Ruff has observed the conditions for the Yakima Wastewater Treatment
facility and recognizes that there is a constant risk of severe injury or
death during the activities he will perform there.
Mr. Ruff acknowledges that his activities at the City facility will bring him
into contact with unusual working conditions which include but are not
limited to the following:
Exposure to chlorine gas;
Exposure to caustic materials;
High electrical voltages;
Working on ladders, scaffolding, and numerous flights of stairs;

Working in confined spaces near location of toxic gases;
Lifting of objects sufficient to cause back injuries or loss of balance
if not lifted carefully.
Mr. Ruff, for himself, his heirs, administrators, and assigns, does release
and discharge the City of Yakima and its officers, employees, and agents
from all claims, demands, actions, and causes of actions of any sort, for
injury sustained to his person and/or property during Mr. Ruff's presence
at the facility due to negligence or any other fault.
7. The City of Yakima and the trainer accept the responsibility to inform Mr.
Ruff of all safety practices currently used at the facility, to avoid
injuries/accidents possible in Section 6 above.
8. The City of Yakima, as trainer, and as a non-profit organization, is not
obligated for any wages, salaries, or other remuneration to the trainee for
any services rendered.
9. The City of Yakima may terminate this agreement at any time for any
reason related to the trainee's attitude, attendance, work habits,
performances, etc.
10. The trainee acknowledges that he has had the opportunity to read every
part of the above agreement and to consult an attorney if he so chooses.
11. This contract will not be in effect until signed by Mr. Ruff and a
representative of the Division of Vocational Rehabilitation having
authority to bind the State to the responsibilities recited above.
12. Throughout the duration of this contract, Daniel Ruff is not an employee of
the City of Yakima, nor is there any obligation for the City to employ Mr.
Ruff upon completion of his training.
