HomeMy WebLinkAbout11/13/1972 Special Meeting / Regular Meeting 467 • NOVEMBER 13, 1972 • • • MINUTES OF SPECIAL MEETING • - YAKIMA CITY COUNCIL • • • • • • - NOVEMBER 13, 1972 - The City Council met in special session pursuant to due notice at :1 :30 P.M., November 13, 1972, in - the Conference Room at Yakima City Hall. • Councilmen present at the meeting were Mayor Bert Broad, Wray-Brown Lenore-Lambert, Jim • Lust, Walter Robinson, Don Schussler and Bill Whitaker. . Also present were City Manager McMicken, City Administrative Assistant Jim Flint; - The Council briefly discussed the vacation of E. Beech Street. There was' discussion on the budget and the impact Federal Revenue Sharing'money would have upon it. The Council decided to spend November 29, 1972, Spokane , about the cooperation that exists between the City and County and how this cooperation lead to a joint City- County Building.' - • • 1 The meeting - adjourned at three o'clock P.M. • • • .. The City Council then met in regular session at the hour of-'3::00 - P..M..;- Mayor Broad pre siding, Councilmen Brown,-Lambert, Lust, Robinson Schussler • and- Whi-take'r;- C ity Manager McMicken and City Attorney Andrews present on roll" call; • - . • • The Invocation was given by Mayor Bert Broad. - - - . The ininu.tes of` the special and regular meetings of- November 6. : .1972 , havirig'beeh duly '- accurate by two Councilmen, and no one present wishing'lto have 'said minutes • read publicly, Mayor Broad declared' said minutes - approved- as-recorded -. This being the time set for the Hearing on the matter of the Vacation of E. Beech.Street - between South 8th and 9th Streets, having been continued from 'October 10;=1972, and a petition being filed at this meeting by approximately two hundred adults and students in favor of said Vacation, City.Manager McMicken reported that th-is.proposed- vacation is - for the benefit and combined use of Washington Park and Wa'shingto'n- Junior - - High School and • explained - the the delay due to truck usage of this street and the -for a=n alternate route consistent with the over -all Arterial Street Plan. He further noted that the matter is on the Plahning-.Commission's :Agenda for November 14, 1972, following which - there will be a hearing.•in one Mr. McMicken recommended that the Council - make no- decision until •it receives information back from the Planning Commission. Mayor B commented that he saw no way' the Council could make an immediate' decision until all aspects-b -f the.issue had been deliberated by the Council and Planning Commission- and that the-Counc-il needs to see the whole picture, as there is both economicand social•impact in the proposed vaca- tion. Mr.'Bi'll Pleasant, Youth Director'at Southeast Community Center,-being-present; reported on a number of children playing 'close to the Street in this area and the many - heavy trucks going through. He suggested the trucks go around -the Park'by'the south route to Maple, or to-Pacific, .which is a natural route and where children do not play near the street as on Beech by the school and park. Mr. Pleasant f- urther- •repo'rted'that Washington Park was closed two years ago with apparently no complaints from•.trucks having to be rerouted. He expressed a feeling that there has been a lack of efforts . by the City on the east side •where . there are many . minorities compared with the''west= • side'of Yakima and asked for 'the immediate 7 closure . of Beech -Street: `Planning Director, ' Jay Otto, reported that he had met with P.T.A. and'Vice- Principal of Washington Junior .High School and felt that the matter should not be considered outside the context of the Arter- ial Street Plan and indicated that if there were to be consideration now, it would be without the •full picture and context of the General Street- Pian' amendment•. . 'Mr. Otto fur- - ther stated a concern over moving the problem from one area -to another. Mrs. Pleasant,' - President of Washington Junior High.School P.T.S.A., stated that the main seems to be over two companies rather than the of five hundred children. She suggested the possibility of trucks going over Nob Hill '•or °down to' Chestnut =and- over' the' other' side of the City and noted residents'in the -Beech•Street.area are- willing to drive around another way. She requested that the= Counci -1 -not - .hold- this matter for another month. City Manager McMicken exphasized that the Council is confronted with finding an alternate truck route. He took exception to - the allegation are not distri- buted equally throughout the City. Councilman Lambert observed that the- Council would be remiss if it were to by -pass the Planning Commission as the route may then have to be changed again and stated that the Council intends to try -- and close- Beech- Street: Virginia Hayes, Physical Education Instructor at Washington Junior High, being present, reported that her classes use both fields along Beech and-that' children are endangered -in crossing the street. .Don Hunt, Assistant. Principal, being present, requested that the route be• moved before there is a serious accident•with in this vicinity Councilmen Whitaker, Robinson; and Brown expressed concern over the amount of traffic in this vici- nity and emphasized a need for more time to come up with an appropriate truck route. Mr. Bob Wilson, Manager of Central Pre- Mix Company, being present, requested the . Council take into•consideration the 10 'occupied homes on compared with 33 on Maple and 65 ont'Spruce. .Mr. A.E. DeAtley of Superior Asphalt and Concrete Company; - being. present, expressed his concern for the children's safety and reported that he -had written . • the P.T.A. concerning the removal of parking on Beech and had talked to the Traffic Department concerning the closure of streets • He further 'stated had" - never seen "Beech closed as Mr. Pleasant had - reported. Mr:'DeAtleye:emphasized that'his company is not limited to one 'street in serving both the City and`County and feels the City "should be interested in business from his company. Councilman Schussler requested that a reporte be brought back from the Planning Commission's.meeting of November'14, 1972, in order that • • • AA ' 468 • NOVEMBER 13, 1972 • this matter might be brought back at the next regular Council meeting on November 20, 1972 It was MOVED by Schussler, seconded by Brown that this matter. be continued to the next regular meeting of the Council on November 20, 1972, with a report from the Planning Com- mission: carried, Broad, Brown, Lambert, Lust, Schussl,e,r and Whitaker voting aye by voice vote; Robinson voting nay by voice vote. A Damage Claim having been filed with the City Clerk on. November 9,, -1.97,2, by . .Allstate_ Insurance Company for Evalena C. Hall, in the amount of $26.25 for damages caused to her automobile during road surfacing,, it was MOVED by Schussler, ; -seconded by. Lust, that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown,- Lambert, Lust, Robinson, Schussler and Whitaker voting -aye by voice vote. An. Ordinance appropriating $57,389 in various funds to pay salaries and fringe benefits to E.E.A. employees, having been read in its entirety at the meeting of November 6, 1.972, and being read by title only at this meeting, it was MOVED by Lust, seconded Whitaker that Ordinance No. 1460, providing for said appropriation be passed as read: carried, Broad, Brown • Lambert, ; Lust, Robinson, Schussler_ and Whitaker voting aye_ bn roll call. ORDINANCE NO. 1460, AN ORDINANCE appropriating the amount of;:$26,629 from unappropriated money in 000 - General Fund to the 1972 appropriation for various departments and accounts within that fund; appropriating the amount of $13,848 from unappropriated money in 131 - Parks and Recreation Fund to the 1972 appropriation for various accounts within that fund; and appropriating the amount of $16,912 from 463- Water -Sewer Fund to the 1972 appropriation for various accounts within that fund. Tony Wentz, Yakima Police Patrolmen's Association, being present, spoke on the matter of the wage impasse and.asked for an-approximate time to expect a decision by the on the wage negotiations and how representatives would be notified. Mayor Broad announced,. that a meeting is to be held on November 14, 1972, at 7:30 P.M. in- the.Conference Room at Yakima City Hall and asked that the representatives of the Associations attend, but that representatives would not be invited to participate in discussion at time. Council- man Lust stated that he sees the options as follows: (1) Grant the request of both the - Unions; (2) Adopt.the, program of the City Manager; or (3) A compromise position between the other . two - alternatives. He further noted that if the Council decided in favor of alternatives 1 and 3 it will have a direct bearing on .the, Budget and n oted. that the Council is considering requests from Departments and has yet to decide what will be done with Revenue Sharing money. Ken Groth, -representing the.,F : ire Fighters, asked that the Patrolmen and Fire-Fighters be informed by letter as to t-he- decision_ of the Council within a reasonable time... .City Manager McMicken asked for clarification of the: Assoc . • further- intent should the Union not agree with the Counc,il's decision and indicated that_ he sees no purpose in the Association planning for, more- mediation after theCouncil has reached a decision, .since .the Council's decision should be final. _Mr. Wentz_ then refer- red to a letter written to Mr. McMicken regarding fact-finding, from which he had received no reply. There .was d-is.cussion, regarding -the carrying out of fact - finding before the Council reaches a decision.- Mr. Bill Horst, notified the Council at this , time that a committee from the Fire Fighters would be present at the November 14, 1972 .meeting.. • Mr. McMicken then referred to a letter dated October 5, 1972, from Mr. Wentz in which an impasse was declared and- in which a reference was made to - proceedings., of fa ct- find-ing. Mr. McMicken stated that he did not infer from the letter that the Y.P.P.A. was,-proceeding to fact - finding and -asked Mr. Wentz if someone had been :selected to represent2them in fact- finding. Councilman Lust stated that if the .Y. P. P.,A... is proceeding. ,to fact- finding, the Council should be made aware of this. Mr. Groth asked that some decision be made . clear before the Budget Hearing on December 1, 1972, and requested that the Council meet and come to . a decision as soon as possible. There was discussion as to measures being, . • taken to remove matters such as.labor and negotiations from the Open Meeting Law,. Councilman Robinson requested the City Clerk to prepare extracts from the minutes and such other information as pertinent to the Beech Street Vacation to be, given to:Plan,- ning Director, Jay.Otto.before the Planning Commission's evening meeting on November 14, 1972. Mr. Gordon Wonder, being present, thanked the Council for the speed with which Rail- road Crossing work was done on a portion of Yakima Avenue and commented „on the good quality of the work. . City Manager McMicken referred to the outside utility request for sewer service. to 5606 Haven Way, requested by Mr. I. H. Meyer for servile for.an existing family resi- dence and that the Staff recommends approval of the request for the following.reasons:'• 1. The single - family residential land use is in conformance with the General... Plan designation of low - density residential. • •• . 2. The property could be served without extension of City.services._. . 3. The applicant has signed an outside utility agreement. ._.. 4. The. retail-carpet outlet constitutes a pre- existing non - conforming use and would be allowed to continue, but not to expand when annexed to the City. City Manager McMicken explained that a retail carpet operation is presently being con- ducted on the premises. After due discussion, it was MOVED :,by Robinson, seconded by,. Brown that said utility request be approved as recommended:. carried,- Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote..
