A RESOLUTION authorizing an agreement between the City of
Yakima and Yakima County Department of
Community Services for a Retirement Assistance
Project.
WHEREAS, the City of Yakima operates a Parks and Recreation
Division; and
WHEREAS, Yakima County wishes to encourage the offering of
public recreational programs to disabled senior citizens; and
WHEREAS, the City Council deems such activities to be
healthy and beneficial for the citizens of the City; and
WHEREAS, the City Council deems it to be in the best interest
of the City to execute the attached and incorporated agreements,
now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager and the City Clerk of the City of Yakima is
:-;hereby authorized and directed to execute the attached and
incorporated agreements between the City of Yakima and Yakima
County r a Retirement Assistance Project for Senior Citizens.

1992 AGREEMENT
BETWEEN THE CITY OF YAHIMA AND THE
YVIA COUNTY DEPARTMENT OF CO
This Agreement is made and entered into the oU — day of ' j 1992,
by and between the City of Yakima, Department of Public %, rks, '' arks and
Recreation Division, herein referred to as the "City' and Yakima County
Department of Community Services, herein referred to as "County".
WITNESSETH, That in consideration of mutual covenants, promises and
agreements herein contained, the parties mutually agree as follows;
1. The City shall assist five (5) developmentally disabled senior citizens
in retirement transition through participation at the Yakima Senior
Center or participation in other appropriate community programs.
This Retirement Assistance Project shall run approximately six
months beginning April 1, 1992 through September 30, 1992.
2. During the performance of this Agreement, the program, shall not
discriminate on the basis of race, color, sex, religion, national origin,
creed, or the presence of any sensory, mental or physical handicap.
3. Special areas of responsibilities for both the City and the County are
contained in Attachment "A" which is attached and incorporated
into this Agreement.
4. It is understood that the City does not maintain liability insurance on
the County, or its employees, or its clients/residents.
5. The County, shall defend, indemnify and hold harmless the City, its
agents, officers, and employees from any and all liability resulting
out of the performance of this Agreement.
6. As consideration for the services specified in this Agreement, the
County agrees to compensate the City according to the payment
schedule, Attachment "B" which is attached and incorporated into
this Agreement.
7. If the County fails to comply with the terms and conditions of this
Agreement in such a manner that the Parks and Recreation
Manager in his sole discretion deems that the continuation of this
Agreement is no longer in the best interest of the City, the City may
terminate this Agreement by giving the County five (5) days notice of
termination.

8. If the City substantially deviates from the terms and conditions of
this Agreement, the County may terminate this Agreement by
written notice, giving the City thirty (30) days notice of termination.
9. All notices required by this Agreement; shall be deemed properly
served when deposited in the United States Mail three (3) days prior
to any deadline listed herein, postage prepaid, and addressed to the
appropriate party at the addresses listed below.
10. This Agreement constitutes the entire Agreement betweenthe
parties. There is no other oral or written Agreements between the
parties as to the subjects covered herein.
11. If any portion of this Agreement is changed per mutual agreement
or any portion is heldinvalid, the remainder of the Agreement shall
remain in force.
12. Any modification of this Agreement must be in writing and signed by
both below signators.

ATTACHMENT 'A'
Areas of Responsibilities:
1. The City of Yakima Parks & Recreation Division shall:
A. Hire, train and supervise a senior recreation leader through the
Washington Service Corp. to work with the program.
B. Work with five (5) developmentally disabled senior citizens to assist
with transition from work to retirement.
C. Assess clients recreational and social needs and establish individual
leisure goals. Maintain documentation on each client.
D. Provide opportunities for clients to participate in activities as
independently as possible, with non -disabled senior citizens.
E. Recruit volunteers to assist with ongoing retirement assistance for
clients.
F. Provide a written program report to the County at the conclusion of
the project.
G. Shall bill the County for services by October 1, 1992.
2. The County shall:
A . Assist the City in recommending the scope of the program.
B. Identify and refer five clients for service.
C. Pay the City within 30 days of receiving a bill for services. All
payments shall be sent to the City of Yakima, Parks & Recreation
Division, 2301 Fruitvale Blvd., Yakima, WA 98902.
