HomeMy WebLinkAbout10/24/1972 Special Meeting / Regular Meeting 456 OCTOBER 24, 1972 MINUTES OF SPECIAL MEETING YAKIMA CITY COUNCIL OCTOBER 24, 1972 The City Council met in special session pursuant to due notice at 1:30 P.M., October 24, 1972, in the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Lenore Lambert, Jim Lust, Walter Robinson, Don Schussler and Bill Whitaker. Also present were City Manager McMicken, City'Attorney Andrews and Administrative Assistant Jim Flint. Present after 2 :00 P.M. were Police Chief Jack LaRue and Lt. Bernard Kline. - The Council discussed. the Yakima Convention Center. Use of a Consultant was mentioned. The Council discussed plans for a Council /Department Head Retreat to be held November 10, 1972, from 9:00 A.M. to 9:00 P.M. Several locations for the Retreat were discussed, but further study was indicated. A report prepared by the Planning Department on Revenue Sharing and Community Development . was discussed and briefly explored. . City Attorney Fred Andrews brought to the attention of the Council two lawsuits now pending against the City and several of its personnel: First, a suit against a former Police Chief Madden and Police Chief LaRue has been filed by a former employee; Second, the Animal Control Officer, Del Trimble, has been named along with the City as defendant for false arrest by a Yakima resident. Police Chief LaRue submitted a report prepared on the Crime Commission Center. Both Chief LaRue and Lt. Kline answered questions directed to them by Council members about the report. . The special meeting adjourned at 3:00 P.M. REGULAR MEETING - TUESDAY, OCTOBER 24, 1972 - 3 :00 O'CLOCK P.M. The City Council then met in regular session at the hour of 3 :00 P.M., Mayor Broad pre- siding, Councilmen Brown, Lust, Robinson, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Lenore Lambert being absent, it was MOVED by Robinson, seconded by Schussler that Councilman Lenore Lambert be excused: carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. The Invocation was given by Councilman Lust. The minutes of the special and regular;meetings of October 16, 1972, and the special meeting of October 20, 1972, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. This being the time fixed for the Hearing on Resolution of Intention No. D -1940, to improve property by the construction of curbs, gutters and surfacing of certain streets and an alley, in accordance with Petitions No. 731,743, 751 and 752, Public Works Director, Dave Vargas, referred to the City Engineer's Report on the percentages of protest on the pro- posed Franklund Pear Blossom Addition and Others Paving District through October 20, 1972, Those present and protesting certain portions of the proposed L.I.D. and asking questions regarding how the costs were figured, means of payment, costs of constructing a sewer, etc., were Mr. Jongewaard, Tim Weaver, Ruth Schneider, Mrs. Nichols, Mr. Ray Spratt, Dennis Sexton and Stan Hiatt. Mr. Vargas stated that the status of the project can be checked at any time in his office. City Attorney Andrews explained that there are 30 days in which to protest and that protests must be inwwriting. Councilman Lust asked that a letter be sent out regarding costs since enough interest was indicated at this meeting.. After due discussion, it was MOVED by Robinson, seconded by Whitaker that. Ordinance No. 1453 be passed as read: carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye on roll call. Lambert absent. ORDINANCE NO. 1453, AN ORDINANCE providing for the improvement of certain streets and alley by grading, ballasting, surfacing with asphaltic concrete and constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improve ment District, providing for the method of payment thereof, and creating a special fund. This being the time fixed for the Hearing on the Planning Commission's recommendation on the Rezone application filed by Delmar and Beverly Edler, requesting rezone of property located at 66 West Mead, Planning Director Jay Otto reviewed the Planning Staff Report of August 30 , 1972, which recommended denial of the rezone application, and the Planning Commission Minutes of September 5, 1972, which denied said rezone application. He also reported that Mr. Edler appealed the Planning Commission's decision and at the City Council Hearing of September 25, 1972, the matter was referred back to the Planning Com- mission for rehearing at their Hearing of October 3, 1972, when they recommended approval of the rezone request for the following. reasons: 1. This use of property was partially existing at the time of annexation and should have been zoned industrial at that time. 2. Denial of this request would be an undue haidsh';p on the owner of the property. 3. Granting of this request will result in the extension of an existing zone. . 457 • • OCTOBER 24, 1972 • Mr. Bob Maulding, -owner of two requested the possibility of zoning.to be extended to •Landon•Avenue. City Attorney•Andrews• that it was not legally appropriate to include other areas. In.view of the fact that work -has started on the building and a problem with the building permit is presented, it was MOVED by Robinson, seconded by Lust that Ordinance No. 1454, recommendation of the Planning•.Commissi.on and.rezoni.ng said property be passed as read, with. an amendment to Section 4, using.the emergency clause instead of the 30 -day c- lause: carried, Broad, Brown, Lust, Robinson, Schussler and Whitaker voting aye • on roll call. ' Lambert absent. ORDINANCE NO.• -AN ORDINANCE accepting'the •recommendation of the. Planning. Commission and.rezoning certain property situated at 66 West Mead Avenue in the City of.Yakima, Washington, from R -2, Two Family Zone, to M -1, Light Industrial Zone, and declaring.an • emergency. • Petition No. 760, having been filed with the City Clerk on October 20, 1972, by Mrs. Ida Volanka and61 other property owners.in the vicinity of Folsom, Brown and Kerr, requesting reduction of the speed limit on Custer, limiting parking on•certain streets', disposition of garbage littering alleys,. and enforcement of hedge trimming, it was MOVED by Schussler, seconded by Brown, that this petition be •referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown,•'Lust, Robinson •Schussler and Whitaker voting,aye by voice vote. Lambert absent. • An Ordinance appropriating.$5,890 to the General Fund for Visitors and Convention.Bureau . • -and Chamber of•Commerce purposes, .having been read in its entirety at this meeting, was • laid on the table for...one week or until October 30, 1972.. City Manager McMicken explained that this money would come out of the Council budget and that the design for the Convention. Center is complete. • An Ordinance appropriating $27,675 to transfer funds for the benefit' of the Yakima Center for Youth Development and Change, having been read'in its entirety at this meeting, was laid on.the table for one week or until October 30, 1972. • . It was MOVED by Robinson, seconded by Whitaker that Ordinance No. 1455, relating to traffic control, designating, speed limits on certain streets. in the City, of Yakima and amending subsection 9.75.010 (c) of the Yakima Municipal Code be passed as read: carried, • Broad, Brown,• Lust, Robinson, Schussler and Whitaker voting aye ' on•rollcall.• - Lambert • absent. No. 984, and providing for the issuance of Local Improvement District Installment - Notes for the payment of the unpaid portion thereof. • Mrs. Fred Hosea, being present, requested free bus rides in Yakima on November 7,•1972,. that day being.General'Election -Day. She stated that it would help those rides and would. also be :good "business for the-city, buses., City Manager McMcken•referred the matter to•City Jack Daniel, who reported that there had been.complaints last . • fall when elderly people had•trouble getting on because of the .many children riding free. He stated the amount of revenue lost for one day of free rides to b'e $27 $300: Transit Manager, Bob Knight,, said that there were problems in not giving children free rides and that Senior citizens are already'riding at a. reduced rate. Lambert absent. • • Mr. Jack Sparling, Chairman of the Citizen's Task Force, being present, requested.that the Council authorize the employment of Mr. Nye Wilson of Berkeley, California, as pro - fessional consultant to• study and assist in the 'architectural tion and Cultural-Center. He estimated his 'salary .at $100 a day; expenses. 4 "It was MOVED by Robinson, seconded by Brown, that Mr.•Nye Wilson- be- employed. at $100 a expenses for two or three days: carried, Broad, Brown, Lust, .Robinson, Schussler and Whitaker voting aye by voice vote. Lambert absent. - • • • ._ • - • - The matter -of• t-he = City's -assistance• with downtown Christmas decorations having been con - tinued from the previous week, City Manager McMicken called upon Public Works Director, Dave-- Vargas, for• a •repor"t.• -Mr-. Vargas reported •.that -- last' year's 'in"stallation and removal of the decorations was .handled by a private•contractor, engaged•by the Chamber'of- Commerce at $2,365.00. He stated that it would take five or six men a •solid week to do the job.' City/Attorney Andrews reported that the Chamber does have an insurance policy, but if the . decorations should fall down and cause injury or damage, the. City would have no bond or insurance to cover it. Mr. Philippe Marmorat, representing, the Chamber of Commerce Merchant's' Association; being present;. reported on-the practice of the' City - of •Walla Walla • regarding decorations. and - stated that' he would. work toward getting -the •downtown merchants together •for a• better plan next "year. Councilmen Lust and - Schussler• expressed `strong - reservations about the City•assisting, but felt it could be done for year 'only. After due discussion, it was MOVED by Schussler, seconded by Brown, that the City finance the installation and.r.emoval of the' decorations for this year only, with Mr•.•Marmorat • providing the garlands: carried, Broad, Brown, Lust, Robinson and Schussler voting aye by voice vote; Whitaker voting nay by voice vote. Lambert absent. • • 45s OCTOBER 24, 1972 • City Manager McMicken-reviewed his report, No. 157, concerning Technology Transfer and stated that he feels there is a need for ,some: type, of, continuing action with Batell,e North - west :' He .introduced.,the.Technolo.gy Transfer Team members Glen Koelling, Training and Safety Officer; A1.,Richards, Street Superintendent; Emil Kissell, Parks Superintendent; Tom Froula, Systems Analyst; and Al Burleson, Water Foreman, and asked each team member to briefly, give his impressions of the six -month program, in which Science /Technology Broker_from Batelle Northwest spent four days per month with the City. It was the consen- sus of the five - member team that such a program would be of benefit to smaller cities like Yakima, making possible more inter - departmental cooperation and economy, and that such a program should be pursued on a continuing basis. Mr. McMicken discussed the possibility of several cit,ies.going.together..and sharing Broker expenses. No formal action was taken by the Council at this,.time. . . Councilman Robinson absent after 5:15 P.M. City Manager McMicken,reported.that bids were received and. considered by a bid .board on August 4, 1972,. for. the South First Street & Mead Avenue and Other Sanitary Sewers, as follows: . DeBlasio. $14,743.05 Traub & Traub • • 25,905.60 The City Engineer recommending.that bids be awarded to'Traub and Traub for Schedules I and III, and explaining that the amount for Schedule I had been adjusted due to the deletion of Safeway extension, and to A. V. DeBlasio for Schedules II and IV, who•submitted the lowest and best bids, was MOVED by Lust, seconded by Brown that the recommendation of the City. Engineer be .accepted and that the contracts be awarded to Traub &Traub for Schedule I, in the.amount of $27,293.70 and Schedule III in the amount of $23,887.50 and to A. V. DeBlasio for Schedule II in the amount of $7,060.20 and Schedule IV in the amount of $14,743.05, and that the City Manager be authorized to enter into contracts with said contractors.,upon the filing of the proper bond and insurance: .carried, Broad, Brown, Lust, Schussler and Whitaker voting aye by voice vote. .Lambert and Robinson•absent.. Mayor Broad requested that Dave Vargas notify the Safeway people of the deletion of. the Safeway extension. . City Manager.McMicken referred to the matter of authorization to apply to the Federal - Aviation Administration for a grant to finance installation.of security fencing. at the Yakima Air Terminal. and explained that federal regulations require.the City to install security fencing.at.the Yakima Air Terminal, that financial assistance for such fencing project may be available in the form of a grant from the Federal Aviation Administration and recommended that the City be authorized to make application for a request for a grant to fin_anc.e said installation of security fencing. He stated that 24 feet: of fence is needed, plus.the removal of the existing water pump and the installation of a new one at an approximate cost of $23,860. After due discussion, it was MOVED by Lust, seconded by Brown that Resolution No. D -1948 authorizing application to the Federal Aviation Admini- stration for said grant to finance installation of security fencing at the Yakima Air Terminal, be passed as read: carried, Broad, Brown,,Lust, Schussler and Whitaker voting aye on roll.call. Lambert and Robinson absent.. RESOLUTION NO.,D- 1948, A RESOLUTION.authorizing and directing the City Manager of the City of Yakima to.apply Federal Aviation Administration for a grant to finance installa- tion of security fencing at the Yakima Air Terminal. • . , • .City Manager McMicken explained the request for extension of time of retirement for the Plumbing Inspector, Ben Drinkwater, stating that six months is a reasonable period since plans have not yet been made for his replacement. After due discussion, it was MOVED by Lust, seconded by Whitaker.that Resolution No. D -1949 extending the time of retirement for Ben Drinkwater, be passed as read: carried, Broad, Brown, Lust, Schussler and Whitaker voting aye on roll call.
