'MINUTES OF SPECIAL MEETING
'YAKIMA CITY COUNCIL
OCTOBER 10, 1972
•
• The City Council met in special session pursuant-to 'due notice at 1:30 P.M., October 10,
1972, in the Conference Room at:Yakima City Hall:
II Councilmen present at the meeting' were Mayor Bert Broad, Wray•Brown,'Lenore•Lambert, Jim
Lust, Walter Robinson, Don•Schussler and Bill Whitaker. Also present were City Manager
McMicken, City Attorney Andrews and Administrative Assistant Jim Flint. •
The City Council received notice of an invitation to a meeting of a committee of the
Chamber of Commerce-to, take' place at eight o'clock "A.M. Thursday, October 12, 1972,
regarding downtown Christmas: decorations, pedestrian movement - in downtown Yakima,'and
various other miscellaneous matters. Mayor Broad and Councilmen Robinson and Schussler
indicated their intention to attend the meeting. .
Other miscellaneous announcements were made. No action was'taken on any•item.
The Council• studied and approved a proposed draft explaining the membership and operation
of.the Convention and Cultural Center Task:Force. The draft included a discussion of
committee orgainization and steps to take in the immediate future to implement.a study by
the task force.• The'Council discussed engaging .a'financial consultant for the convention .
and cultural center, and followed the recommendation of the City Manager to engage Foster
&Marshall as financial consultants for that project.

The minutes of the special and regular meetings of October 2, 1972, having been duly
• certified accurate by two Councilmen, and no one present wishing to have said minutes
read publicly;' Mayor. Broad declared said' minu-tes.approved as recorded.
Mr. Frank J. Fitterer, being present, Item No.. 9 on the Agenda was brought on for action
at this time. :Petition No."759, Notice of Intention to Commence Annexation Proceedings,

Fitterer, requesting annexation of property located on the south side of Englewood between
approximately 60th and 61st Avenues, it was MOVED by Robinson, seconded by Lust that this

This being the time -fixed for a review of the proposed scheduling for Yakima Avenue Rail-
, road Crossing and Walnut Street Underpass, City Manager McMicken read some letters
received this past week from downtown -businessmen, Mr. Philippe Marmorat, Bon Marche ;',Mr.
'Bruce Nordstrom, Norstrom Best, and'Mr. Richard Tweten ;'General Manager, Yakima 'Mall,
Shopping Center Corporation, all asking that the closure of Yakima Avenue for the proposed
improvements be delayed until after Christmas, and stating that closure of Yakima Avenue
until mid - November or later would prove economically ruinous to downtown merchants.
Public Works Director; _ :. Dave Vargas, rreferred• to charts di regarding the time
needed to complete the various phases of construction on the "B" Street and Lincoln Avenue
projects, as well as the Yakima Avenue Railroad Crossing and Walnut Street Underpass
projects, and reviewed these in detail = He- , reported that Union Pacific has'one track to
do, which will take approximately. one week,' commencing October 16'through 20, 1972, and
that they are very interested in doing that wor - -k a't that•time. He further reported that
it will take Burlington Northern one month to complete their six tracks, commencing on
October .16 ; to - f - November: 18•, L972,.. 'and. .that :we have a . firm "verbal commitment from Burlington
Northern that they can accomplish that work in that time. Mr. Vargas stated that the
street work .would 'go on concurrently. with "the - track work -, : and folTowirig Yakima Avenue
project:, work on - the ".Walnut - Street: •Underpass would :then; fo•l'low •"and that: :the •plans were'

present and :speakng to the matter of the Walnut Street Underpass project - was =Don Casad,
who is .working, onbthe. project designs.: Council :'members; asked - Mr Vargas: questions re •
whether Walnut could be done first, then•Yakima Avenue and if any of the funding will'be

Lambert indicated that she feels that the businessmen's concern about competition from the
• newly opened Valley Mall is understandable, but that the Yakima area is Well known for its

tremendous openings and that she is not convinced that al.l - the people flocking down there
will be doing the same thing in a few months Councilman Brown stated that as far as the
downtown merchants are concerned regarding-the pre - holiday season, that common sense tells
him that the project should be delayed until spring. Mayor Broad agreed with him..
Councilman Robinson indicated-that-he is•in favor of going ahead with both the•Un-ion
Pacific and Burlington Northern projects, as he feels that with the re- opening of:the
vastly improved "B" Street and Lincoln Avenue, people - will travel those streets, but that
he .w ill support•whatever action the majority of the- Council members take. Councilman-
' stated-that he does not believe-that he has• -to drive two :,extra blocks that it
will force him to go - miles to the Valley'Mall: After due discussion, it was.MOVED
by Whitaker, seconded by Schussler that authorization be given to proceed with the Union
Pacific track-'work and delay Burlington Northern track work until after the Christmas
season; or in the spring•: - carried, Broad ;•Brown-,' Lambert, Lust,:Robinson,- Schussler and
Whitaker voting aye , by - voice.vote. - ..

This being the time fixed for the Hearing on Petition No. 741, filed by•Allan •and Beatrice
Hart and Others, requesting annexation of property located on the west side of Ledwich
Avenue and between Mead Avenue and King Street, Director-of Planning, Jay Otto, reported
that the proposed annexation has been approved by the Planning Staff, the Planning Com-
mission, and the Boundary Review'Board. Mr. A. Adamaskyr,.1508 Ledwich Avenue,.asked some
questions which were answered by Mr. Otto about-the-proposed-annexation and contemplated
utility L.I.D.'s. After due - discussion; it -was MOVED by- Robinson, seconded'by'Lust 'that
Ordinance No. 1448 - annexing said property,•be- passed as-read:' carried; Broad,.Brown,
Lambert, Lust, - Robinson, Schussler and Whitaker voting aye roll -call. •
ORDINANCE NO. 1448, AN ORDINANCE annexing property to the.City of Yakima, and zoning said
property.
This being the time fixed for the Hearing on the matter-of the Vacation of.'a.portion of
"F" Street, between North 3rd and 4th Streets, City Manager McMicken reviewed the Planning
Department Staff report and the Planning Commission minutes on the Yakima*Parks Department
request for•the.proposed vacation, which- is:deemed necessary to create a lot of sufficient
size for the new Senior Citizens Center funded-by-the bond issue of-last-.year. He further
reported that the Planning-Staff and Planning Commission recommended approval of this
street vacation subject to the following requirements: - - -
1. That existing •utility• easements be- retained :or - satisfactorily re- routed.
2. That public access between North 3rd'and'4th Streets at the site of the •
vacation be provided. _ •
3. That all final park plans be available to those affected for "review so that -
items such as sidewalks,- curbs, street crown,• drainage,•and'driveway °access -.-
be adequately provided.
After due discussion, it was MOVED • by Robinson, Brownthat Ordinance No. 1449
providing for the vacation of a- •portion of "F" Street, be passed as read:•. - - carried., Broad,
Brown, Lambert, Lust; Robinson, Schussler and Whitaker voting aye on roll call

ORDINANCE NO. 1449, AN ORDINANCE providing for the vacation of a portion public street
in City of Yakima, Washington. .

This being•the time fixed the Hearing on the matter of.•the Vacation of E: Beech Street
between South -8th and 9th Streets, City Manager McMicken .explained that this proposed •
vacation is also proposed by the Yakima City Parks Department as a:part of there-develop-
ment of the Washington Park•area as-consented-by the bond issue of the electorate.: He
explained that it is in•the intent of the Parks Department to connect the existing -
school.playground and park, - provide a more functional and pleasing'park'area'and:connect
the passive activities of the current park -with the active use' of -the school playground.
He reviewed.the Staff Report•and the Planning Minutes, which•recommended that
this request for vacation be granted with the following provisions.::• -• • -
1. That existing utility easements be retained-or-satisfactorily re- routed.
- ,
2. • That public access. between South 8th and 9th Streets at the site of this '
vacation be provided. • .'

3. That all final,. park-plans-be available to those affected' agencies for •

Mr. McMicken- reported that letters -have been received from Mr. A. E. DeAtley of Superior
Asphalt and Concrete Company and Robert To. Wilson, - Manager of Central' Pre -Mix Concrete
.co., protesting. -the closure of Beech Street between Washington Park and Washington School
because their trucks travel this route and if this street werercl'osed it would result in
a substantial increase in their delivery cost's.' They-indicated that if this street is
closed, they would like -a satisfactory alternate route to be worked out. :Public works -
Director, Dave Vargas, referred to a map of the Park area.and'pointed out several of the
possible alternate routes for these two companies-to route their trucks. Present and
- speaking .to -.this matter were: - Mr. Al DeAtley,: Junior, Mr. DeAtley,- Senior, and Mr.. Robert
Wilson, who discussed the various proposed routes and again- stated that unless a satis-
factory route•can be worked-out, they protest this proposed vacation.' Mr. Nick Mason,
Principal of Washington Junior High School, spoke in favor of.the closure of Beech:Street.
After . much - discussion regarding the various' proposed truck routes, and it being'noted
that the can proceed without this proposed vacation being approved at
this time, it was MOVED•by- Schussler, seconded by Lambert, this matter be continued
to the- November 13, 1972-, meeting to further workout - a satisfactory truck route for the
two•companies protesting this proposed vacation: carried, Broad, Brown,' Lambert, Lust, '
Robinson, Schussler and Whitaker voting aye' by voice vote. -•

This-being the time time for the Hearing on•Petition No. 756",.filed by Albert.A. Eslick
and Clarence-Corbin; requesting 'Vacation of a portion of .Fourth Avenue adjacent to 412
North Fourth Avenue, Planning Director, Jay Otto, reviewed the .Planning Staff report and
the Planning Commission minutes, which recommended approval of the proposed street vaca-
•tion in • that the vacation does not affect private or public utilities located in the:area
and an exchange of properties proposed by the petitioners, will provide for a better and
II safer design of the. street than presently'exists. After due discussion, it was MOVED by
Brown - , seconded by'Robinson that Ordinance. No. 1450 providing for said vacation of a •
portion of Fourth Avenue, be passed as ready:. carried, Broad, Brown, Lambert, Lust,

benefits under the L.E.F;F. Pension'system for Policemen -and Firemen, - - they =d'o' =not need a
separate reference to• certain', leave benefits in the Yakima Mun'icipal:Code and :.it is at
the request of the Fire Fighters and Police Department personnel that this Ordinance
amending the Yakima Municipal Code be prepared. -. . • .
ORDINANCE NO., 1451, AN ORDINANCE relating to personnel:; specifying city employees eligible
for leaves of absence; amending Section 2.40.010 and -repealing Subsection•.'2.22A30 (c) of
the City of Yakima Municipal Code.
, An Ordinance appropriating $19,000 within the Traffic Department of the General Fund to
make payments for TOPICS study program, having been read in its entirety at this meeting,
was laid' on the table.for one week or until October 16, 19,72'.' City Manager McMicken gave
an explanation of this Ordinance, stating that the City started.the.TOPICS study and it
has been expanded to include Union Gap, Selah, and the. County and. the City is the pass -
through agency, whereby .the bills will be coming to the City to be paid and the City will
be reimbursed, 'and. each of the governments will be paying for their share of the expanded
project. . -

City Manager McMicken referred next to Item 15 on the Agenda, that of,the Special Report:
:Water-Sewer Rate Study, stating that it is not intended.- -to discuss :this matter at this
date, as it will take time to study the' and 'that a discussion:will be held later.
Mr. Hempstead; representing the Chamber of Commerce, stated that they'have'received some
questions about the proposed increase in rates, and asked for and was given a copy of the
report for their committee to study. No formal action,was taken. on this.-matter.:
A recommendation having been received from.the Planning .Commission on ,reconsidering the
rezone application filed by Delmar and Beverly Jean Edler, requesting' rezone of property
located at 66 West Mead, it was MOVED by Robinson; 'seconded by- Schussler that October
24, 1972, be fixed as the time for the rehearing on said matter:: carried,' Broad, Brown,
Lust, Robinson, Schussler and Whitaker voting aye by voice vote. •Lambert absent.

• City Manager ; :McMicken , referred to the matter of : authorization : to:execute_-an ,agreement
with Burlington Northern, Inc., and the State of Washington for Yakima Avenue grade
crossing improvements, which had been continued from October 24, 1972, :for_ :further study '
on the matter of whether the construction should be delayed. He stated that, in spite of
the decision to delay the construction until :after„theChristmas' season, in order to keep
our hand - in the whole construction process :.it' is believed that this Resolution-should
be passed. He reported the agreement does not provide for..a start.or_stop date.
After due discussion, it was MOVED by Brown,, seconded by,Schussler that Resolution No.
D -1942, authorizing.the execution of an agreement with - BurlingtomNorthern,•Inc., and the
State of Washington for improvement of the railroad grade crossing at Yakima Avenue, be

City McMicken referred to the matter of the review of. Federal..Revenue Sharing,
stating that this will.be studied further,as, work., progresses - :on ,,the`1973.Budget... He
read from a Congressional Report dated October 6, and referred to'some information
provided Council members on the subject by the National League of Cities. No_formal
action was taken. ,
