HomeMy WebLinkAboutR-1992-D6065 IAFF / Personnel (PERS)• • RESOLUTION NO. 6065 A RESOLUTION authorizing the execution of an Agreement autho- rizing the one-time waiver of certain provisions of the Collective Bargaining Agreement between the City of Yakima and the International Associa- tion of Fire Fighters, AFL-CIO, Local 469 (PERS) for the years 1991 and 1992. WHEREAS, the parties have heretofore entered into a written Collective Bargaining Agreement effective January 1, 1991 through December 31, 1992; and WHEREAS, the City of Yakima has annexed territory former- ly served by Yakima County Fire Protection District No. 10, commonly known as the Fruitvale Fire Protection District; and WHEREAS, pursuant to RCW 35.13.215, .225, and .235, employees of the annexed Fire Protection District may transfer to the payroll of the City when the City Fire Department determines such transferred employees are necessary to provide service; and WHEREAS, the City of Yakima Civil Service Commission for Police and Fire has placed Jim Kenard, District 10's former chief, on the register for City of Yakima alarm dispatcher, having found that Jim Kenard met the minimum requirements for such position; and WHEREAS, Section 19.1 of Article XIX of the aforemen- tioned Collective Bargaining Agreement requires that an appli- cant must test for the position of alarm operator before being placed in the same position; and WHEREAS, Jim Kenard has met the requirements of state law with respect to the appointment of the position of alarm dispatcher and the parties desire to waive the contractual testing requirement, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager, Fire Chief, and the City Clerk are hereby authorized and directed to execute the attached and incorporated Agreement between the City and the International (res/iaff . jv) 1 Association of�,E r`e' Fighters, AFL-CIO, Local 469 (PERS) re- lating to Jim Kenard. Roberts City Clerk C EP F 'I? 1/24/83 AGREEMENT This Agreement is entered into by and between the City of Yakima, a municipal corporation (hereinafter called "City"), and International Association of Fire Fighters, AFL-CIO, Local 469 (PERS), exclusive bargaining representative of PERS employees in the City of Yakima Fire Department. RECITALS A. The parties have entered into a written Collective Bargaining Agreement effective January 1, 1991, through December 31, 1992. B. The City of Yakima has annexed the territory formerly served by Yakima County Fire Protection District No. 10, commonly known as Fruitvale Fire District. Pursuant to RCW 35.13.225, employees of the annexed fire protection district may be transferred to the payroll of the City as the City Fire Department determines such transferred employees are necessary to provide services. One former employee of the Fruitvale Fire Protection District, Jim Kenard, has been placed on a re-employment list by the City of Yakima Civil Service Commission for Police and Fire Employees pursuant to RCW 35.13.225. C. The Employer has determined that it has an opening for a dispatcher within the PERS bargaining unit represented by the Union, and desires to place Jim Kenard in such dispatcher position. D. The City Fire Department further anticipates that the position of alarm supervisor may become open in the near future. WHEREFORE, in consideration of the mutual covenants, conditions and promises herein, the parties agree as follows: 1. The City may offer the available dispatcher position to Jim Kenard; provided, that before Jim Kenard is placed in such position as a dispatcher, he will undergo the physical and psychological examinations in accordance with current Civil Service Commission guidelines for the dispatcher position. 2. It is understood and agreed by the parties that, in order to accomplish the placement of Jim Kenard in the dispatch position, the requirements of Section 19.1 of Article XIX of the parties 1991-1992 Collective Bargaining Agreement are waived. This Agreement shall not constitute a waiver of the requirements of Article XIX of the current bargaining agreement for any other purpose. 1 3. In order to create a current register of qualified candidates for the entry level Fire Dispatcher position, an appropriate Civil Service exam will be administered within ninety (90) days, starting March 1, 1992. 4. In the event the alarm supervisor position becomes open, the parties agree that the provisions of Article XIX of the 1991-1992 Collective Bargaining Agreement will apply during the term of said Collective Bargaining Agreement. 5. The provisions of this Agreement constitute the entire agreement of the parties regarding the subjects described herein, and in the event of conflict between the provisions of this Agreement and any other provisions of the 1991-1992 Collective Bargaining Agreement, the terms of this Agreement shall control. 6.
