R-2022-105 RESOLUTION authorizing a Memorandum of Agreement with the Bureau of Alcohol, Tobacco, Firearms and Explosives ("ATF"). WHEREAS, the Yakima Police Department and ATF seek to maintain a Violent Crime Task Force ("ATF Task Force") to combat firearms trafficking and firearms related violent crime within the City of Yakima; and, WHEREAS, the agreement establishes the procedures and responsibilities of both the Yakima Police Department and ATF for the reimbursement of certain overtime and other pre -approved expenses incurred; and, WHEREAS, the agreement is necessary to ensure compliance with Title 28, U.S.C., Section 524(c), the Department of Justice, Assets Forfeiture Fund, which provides for the payment of overtime salaries, travel, fuel, training, equipment and other similar costs of State and local law enforcement officers that are incurred in a joint asset forfeiture law enforcement operation with a Federal law enforcement agency participating in the Assets Forfeiture Fund initiative; and, WHEREAS, the City Council deems it to be in the best interest of the City to approve the agreement, now, therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and the Chief of Police of the City of Yakima are hereby authorized and directed to execute the Memorandum of Agreement with the Bureau of Alcohol, Tobacco, Firearms and Explosives, which is hereby incorporated by reference. The agreement establishes the procedures and responsibilities of both the Yakima Police Department and ATF for the reimbursement of certain overtime and other pre approved expenses incurred relating to the ATF Task Force and to ensure compliance with Title 28, U.S.C., Section 524(c), the Department of Justice, Assets Forfeiture Fund. The agreement is on file in the City Clerk's office.
