Executive session to consider the selection of a site or acquisition of real estate by lease or purchase under RCW 42.30.110(1)(b) Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Danny Herrera and Holly Cousens (attending via speakerphone) Absent: Councilmember Eliana Macias MOTION: Lund moved and Brown seconded to adjourn to Executive Session for up to 30 minutes to discuss the selection of a site or acquisition of real estate by lease or purchase. The motion carried by unanimous vote, Macias absent. Executive Session was held and adjourned at 5:23 p.m. 1. Roll Call Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Danny Herrera, Holly Cousens (virtually via Zoom and present until 5:58 p.m.), Eliana Macias (present at 5:37 p.m. virtually via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Sonya Clear Tee 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio led the Pledge of Allegiance. 4. Open Discussion for the Good of the Order A. Proclamations MarJon Beauchamp proclamation Councilmember Herrera proclaimed the Council is pleased and proud to honor MarJon Beauchamp as an outstanding athlete for his commitment to basketball, and becoming a fine Page 1 of 5 17 example of American youth. MarJon Beauchamp accepted the proclamation and said his influence was from his grandfather Henry Beauchamp, former Mayor of Yakima and he understands the importance of giving back to your community, and plans to do so. B. Appointments to Boards, Commissions and Council Committees i. Appointment of Samantha Panduro to Community Integration Committee youth position MOTION: Byers moved and Lund seconded to appoint Samantha Panduro to the City's Community Integration Committee. The motion carried by unanimous vote. 5. Council Reports A. Discussion on the Council Nominating Committee process City Clerk Claar Tee reported at the June 7, 2022 meeting, Council directed staff to add a discussion on the Council Nominating Committee process to a future agenda. She noted information on the process is included in the agenda packet.After discussion, MOTION: Byers moved and Brown seconded to change the Council Nominating Committee term from two years to one year. The motion carried by unanimous vote. 6. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Lund moved and Byers seconded to approve the consent agenda. The motion carried by unanimous vote. A. Approval of minutes from the July 5, 2022 City Council regular meeting and July 12, 2022 City Council retreat B. Approve payment of disbursements for the period June 1 -30, 2022 C. Resolution authorizing an agreement with Central Washington Soccer Academy for the placement of a storage container at Chesterley Park RESOLUTION NO. R-2022-082,A RESOLUTION authorizing a revocable license agreement with Central Washington Soccer Academy for installation and use of a storage container at Chesterley Park. D. Resolution authorizing an interagency agreement with the Department of Natural Resources (DNR)for single resource responses to wildfires or other emergencies RESOLUTION NO. R-2022-083,A RESOLUTION authorizing an Interagency Agreement between the Department of Natural Resources (DNR) and Yakima Fire Department. E. Resolution authorizing a collective bargaining agreement for 2022-2025 with the International Association of Firefighters (IAFF) Local 469 representing the PERS bargaining unit Page 2 of 5 18 RESOLUTION NO. Resolution accepting the Office on Violence Against Women (OVW)grant entitled 2021 OVW Fiscal Year 2021 Firearms Technical Assistance Project Pilot Sites Initiative Solicitation RESOLUTION NO. R-2022-085,A RESOLUTION accepting the Office on Violence Against Women (OVW)grant entitled 2021 OVW Fiscal Year 2021 Firearms Technical Assistance Project Pilot Sites Initiative Solicitation in the amount of$499,212.00. G. Resolution authorizing Task Order 2022-01 with HLA Engineering and Land Surveying, Inc. to provide engineering services for Project SW2646 DID#24 Stormwater Improvements RESOLUTION NO. R-2022-086,A RESOLUTION authorizing Task Order 2022-01 with HLA Engineering and Land Surveying, Inc. to provide engineering services for Project SW2646 DID#24 Stormwater Improvements. H. Ordinance amending the 2022 Budget for the City of Yakima and making appropriations from unappropriated fund balances within various funds for expenditure during 2022 for various purposes. (Second Reading) ORDINANCE NO. 2022-018,AN ORDINANCE amending the 2022 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2022 for various purposes. I. Ordinance amending Section 8.72.040 of City of Yakima Municipal Code Chapter 8.72 Excavations in Public Rights-Of-Way ORDINANCE NO. 2022-019,AN ORDINANCE amending Section 8.72.040 of City of Yakima Municipal Code Chapter 8.72 Excavations in Public Rights-Of-Way to specify that an applicant's indemnification obligation includes any act or omission by the applicant. J. Ordinance updating Classification and Compensation Plan for City Employees Section 2.20.100 ORDINANCE 2022-020,AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective August 21, 2022; and repealing all preceding pay ordinances in the City of Yakima Municipal Code. 7. Public Comment Patricia Hoendermis, City resident and with the Yakima Valley Landlord Association, spoke against the Ordinance amending Title 7, Chapter 7.50 of the Yakima Municipal Code, Utility Accounting, Billing and Administration. Tony Courcy, City resident, spoke on several topics. PUBLIC HEARINGS 8. Public input meeting to consider citizen comments on the proposed 2022 Annual Action Plan (DRAFT)for Community Development Block Grant(CDBG) & HOME Investment funds. Neighborhood Development Services Manager Archie Matthews briefed Council on the public Page 3 of 5 19 input meeting. Mayor Deccio opened the public hearing and, with no one coming forward to speak, closed the hearing. DEPARTMENT ITEMS 9. Resolution authorizing an agreement with the Washington State Department of Commerce for grant funding for the plans, specifications and bid documents for the construction of a swimming pool at Martin Luther King Jr. Park Parks and Recreation Manager Ken Wilkinson briefed Council on the grant funding for a community swimming pool at Martin Luther King, Jr. Park. The City Clerk read the resolution by title only. MOTION: Lund moved and Herrera seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-087,A RESOLUTION authorizing execution of an agreement with Washington State Department of Commerce for a grant of$1,000,000 through the Local & Community Projects Program for plan, specifications and bid documents for the construction of a swimming pool at MLK Jr. Park. 10. Resolution establishing the Policies and Procedures for Naming Public Parks and Parks and Recreation Facilities Parks and Recreation Manager Ken Wilkinson briefed Council on the issue. The City Clerk read the resolution by title only. MOTION: Byers moved and Lund seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-088,A RESOLUTION amending Resolution R-2005-51, establishing policies and procedures relating to the naming of public parks and parks and recreation related facilities, to allow parks and park facilities to be named after living individuals. 11. Ordinance related to amendment of flag policy Senior Assistant City Attorney Ryan Bleek briefed Council on two proposed flag amendment ordinances. The City Clerk read the ordinance by title only.After discussion, MOTION: Byers moved and Brown seconded to pass the ordinance that amends the City's flag policy and does not include a provision for guest flags. The motion failed by a 4-2 vote with Deccio, Lund, Macias, and Herrera voting no and Cousens absent. MOTION: Brown moved and Byers seconded to direct the City Manager to conduct a citywide survey on flags flying on City buildings. The motion failed by a 4-2 with Lund, Macias, Deccio and Herrera voting no and Cousens absent. MOTION: Lund moved and Macias seconded to pass the ordinance that amends the City's flag policy and includes a provision for guest flags. The motion carried by a 4-2 vote with Brown and Byers voting no, Cousens absent. Page 4 of 5 20 ORDINANCE NO. 2022-021,AN ORDINANCE amending City of Yakima Municipal Code Section 1.13.020 relating to Flag Display policies. 12. Ordinance amending Title 7, Chapter 7.50 of the Yakima Municipal Code, Utility Accounting, Billing and Administration Utility Customer Services Manager James Dean briefed Council on the proposed ordinance amendment.After discussion, MOTION: Lund moved and Brown seconded to have the ordinance be made more clear and concise. The motion carried by unanimous vote, Cousens absent. City Manager Robert Harrison reported he will meet with the Yakima Valley Landlords Association to review the draft ordinance before bringing back a revised version to Council. 13. Other Business MOTION: Brown moved and Lund seconded to direct staff to bring at a future business meeting potential changes to the ordinance regarding Advanced Life Systems (ALS) and BLS (Basic Life Support) emergency services. The motion carried by unanimous vote, Cousens absent. MOTION: Brown moved and Byers seconded to direct the City Manager at a future meeting to create a Public Development Authority. The motion carried by unanimous vote, Cousens absent. MOTION: Byers moved and Lund seconded to direct staff to bring back to Council annexation options that include projected costs and income for each option in a future study session. The motion carried by unanimous vote, Cousens absent. 14. Adjournment MOTION: Lund moved and Byers seconded to adjourn to a City Council study session on July 26, 2022, at 5 p.m. in the Council Chambers. The motion carried by unanimous vote, Cousens absent.
