YAKIMA CITY COUNCIL
July 5, 2022

1. Roil Call
Present: Mayor Janice Deccio, presiding, and Councilmembers Matt Brown, Patricia Byers,
Holly Cousens, and Danny Herrera

2. Pledge of Allegiance
Mayor Deccio led the Pledge of Allegiance.
3. Interpreter Services
Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in
Spanish.

5. Council Reports
A. City of Yakima delegation trip to Washington, D.C.
MOTION: Deccio moved and Brown seconded to appoint Assistant Mayor Lund and
Councilmembers Byers and Cousens as the Council representatives on the DC
trip. The motion carried by unanimous vote, Lund and Macias absent.
6. Consent Agenda
Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there
were any additions or deletions from Council members present. There were no changes. The
City Clerk read the Consent Agenda items, including resolutions and ordinances, by title.
(Items on the Consent Agenda are handled under one motion without further discussion—see
motion directly below.)
MOTION: Cousens moved and Byers seconded to approve the consent agenda. The
motion carried by unanimous vote, Lund and Macias absent.

A. Approval of minutes from the June 21, 2022 City Council regular meeting and June
28, 2022 study session
B. Project Completion and Contract Acceptance for TT C Construction LLC of the 30-
inch Transmission Main Valve Installation Project AC2533
C. Set date of August 1, 2022 for a closed record public hearing to consider the
Yakima Planning Commission's recommendation regarding the preliminary plat of
"Spring Creek Heights" submitted by Michael & Kathy Hovenkotter, located at 7509
Occidental Rd
D. Resolution authorizing a contract with Yakima Valley Partners Habitat for Humanity
in the amount of$87,500 of HOME Investment funds to assist with new
construction of a single family dwelling to be sold to a qualified low to moderate-
income first time homebuyer located at 2912 W Arlington Ave.
RESOLUTION NO. R-2022-076,A RESOLUTION authorizing an agreement with Yakima
Valley Partners Habitat for Humanity in the amount of up to Eighty Seven Thousand Five
Hundred Dollars ($87,500) in Federal Housing and Urban Development HOME funds under
CFDA Contract#14.239 for property acquisition and construction of a low income housing unit
in the City of Yakima.
E. Resolution authorizing an agreement with Joe Park Construction, LLC for the City
of Yakima Police Department Services Division Office Construction Project

F. Resolution authorizing a Memorandum of Understanding with the City of Yakima
Police Department and the Washington State Patrol, the Yakima County Sheriffs
Office and Police Departments for, Grandview, Granger, Mabton, Moxee, Selah,
Sunnyside, Tieton, Toppenish, Union Gap, Wapato and Zillah to jointly cooperate
through a Yakima County Mutual Law Enforcement Assistance Agreement
RESOLUTION NO. R-2022-078,A RESOLUTION authorizing a Memorandum of
Understanding with the City of Yakima Police Department and the Washington State Patrol,
the Yakima County Sheriffs Office and Police Departments for Grandview, Granger, Mabton,
Moxee, Selah, Sunnyside, Tieton, Toppenish, Union Gap, Wapato and Zillah to jointly
cooperate through a Yakima County Mutual Law Enforcement Assistance Agreement
G. Resolution authorizing the City of Yakima to participate in a SIED application on
behalf of the Yakima First Partners, LLC for a project at South 1st Street and
Russell Lane
RESOLUTION NO. R-2022-079,A RESOLUTION authorizing the City of Yakima to support
the grant and loan application of up to $1,000,000 from Yakima County Supporting Investments
in Economic Development (SIED)fund to install street and traffic signal improvements in the
vicinity of South 1st Street and Russell Lane for Yakima First Partners, LLC, in the City of
Yakima.
7. Public Comment
Mary Place and Pam Cleaver, City residents, shared their concerns with the need for
emphasis patrols in high traffic areas around the City and asked what citizens can do to help.

Tony Courcy, City resident, spoke on various topics.
PUBLIC HEARINGS
8. Public meeting to consider the Notice of Intent to Commence the Golden Ridge Annexation in
the Vicinity of Coolidge Road and S 94th Avenue
Planning Manager Joseph Calhoun briefed Council on the issue.
Mayor Deccio opened the public hearing and, with no one coming forward to speak, closed the
hearing.
MOTION: Cousens moved and Brown seconded to direct staff to draft the official
Annexation Petition and collect signatures from property owners to begin the
Annexation review procedures. The motion carried by unanimous vote, Lund and Macias
absent.
9. Closed record public hearing and Resolution to consider the Hearing Examiner's
recommendation regarding the preliminary plat of Anderson Park Phase 4 submitted by
Cottonwood Partners LLC located in the vicinity of Occidental Rd & S 58th Avenue
Senior Planner Eric Crowell briefed Council on the issue.
Mayor Deccio opened the public hearing and, with no one coming forward to speak, closed the
hearing.
After discussion, the City Clerk read the resolution by title only.

carried by unanimous vote, Lund and Macias absent.
RESOLUTION NO. R-2022-080,A RESOLUTION approving the Preliminary Long Plat of
Anderson Park Phase 4, a 30-lot subdivision, located in the vicinity of Occidental Rd. and S.
58th Ave.
DEPARTMENT ITEMS
10. Resolution authorizing a Purchase and Sale Agreement with McCurley Fruitvale Property,
LLC for the property located at 506 Fruitvale Boulevard, Yakima, Washington
City Attorney Sara Watkins reported the Transit Division has been seeking property to provide
needed future space for bus storage, maintenance, and enhancement of services and
infrastructure. She noted the property at 506 Fruitvale Boulevard meets the needs of the
Transit Division, provides income to the Transit Division through a lease-back by the current
owner, and is within the Transit Division's budget. Transit Manager Alvie Maxey mentioned
this property will provide much needed space for Transit needs.

MOTION: Cousens moved and Byers seconded to adopt the resolution. The motion
carried by unanimous vote, Lund and Macias absent.
RESOLUTION NO. R-2022-081,A RESOLUTION authorizing a Purchase and Sale

Agreement with McCurley Fruitvale Property, LLC for the property located at 506 Fruitvale
Boulevard, Yakima, Washington.
11. Ordinance amending the 2022 Budget for the City of Yakima and making appropriations from
unappropriated fund balances within various funds for expenditure during 2022 for various
purposes (First Reading)
Jennifer Ferrer-Santa Ines, Director of Finance and Budget, briefed Council on the first
reading of the ordinance, noting it will be brought back for a second reading at the next
business meeting.
The City Clerk read the ordinance by title only.
AN ORDINANCE amending the 2022 Budget for the City of Yakima; and making
appropriations from Unappropriated Fund Balances within various funds for expenditure during
2022 for various purposes.
12. Ordinance amending Section 6.44.020 of the City of Yakima Municipal Code by adopting
RCW 9.41.305 which prohibits the open carry of firearms or other weapons in a local
government building
Amanda Brusic,Assistant City Attorney, briefed Council on the ordinance.
After discussion, the City Clerk read the ordinance by title only.
MOTION: Cousens moved and Byers seconded to pass the ordinance. The motion
carried by unanimous vote, Lund and Macias absent.
ORDINANCE NO. 2022-016,AN ORDINANCE relating to Public Safety; amending Section
6.44.020 of the City of Yakima Municipal Code by adopting RCW 9.41.305 which prohibits the
open carry of firearms or other weapons while knowingly being in a local government building
used in connection with local government meetings.
13. Emergency ordinance to authorize the continued prosecution of Violation of Protective Orders
Mayor Deccio reported an additional item has been added to the agenda due to its emergency
nature.
MOTION: Byers moved and Cousens seconded to temporarily suspend the Council
Rules of Procedure to add this item to the agenda. The motion carried by unanimous vote,
Lund and Macias absent.
Senior Assistant City Attorney Cynthia Martinez briefed Council on the emergency ordinance.

MOTION: Byers moved and Cousens seconded to pass the ordinance. The motion
carried by unanimous vote, Lund and Macias absent.
ORDINANCE NO. 2022-017,AN ORDINANCE relating to Public Safety; removing statutes
repealed by the State and adopting the newly codified equivalent RCW's 7.105.450, 7.105.455
and 7.105.465 as an Emergency Ordinance to authorize the continued prosecution of Violation
of Protective Orders and Antiharassment Orders in the City of Yakima Municipal Court.

MOTION: Cousens moved and Brown seconded to add to a future study session
options on traffic control. The motion carried by unanimous vote, Lund and Macias absent.
Councilmember Byers recognized Councilmember Cousens as a newly elected representative
of the Association of Washington Cities Board for the next two years.
15. Adjournment
MOTION: Cousens moved and Byers seconded to adjourn to a City Council retreat on
July 12, 2022, at 3 p.m. at the Harman Center Ballroom, 101 N. 65th Avenue, Yakima,
WA. The motion carried by unanimous vote, Lund and Macias absent. The meeting adjourned
at 6:14 p.m.
