HomeMy WebLinkAbout09/11/1972 Special Meeting / Regular Meeting 429 SEPTEMBER 11, 1972 MINUTES OF SPECIAL MEETING YAKIMA CITY COUNCIL - SEPTEMBER 11, 1972 The City Council met inspecial session pursuant to due notice at 12:00 Noon, September 11, 1972, in the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Lenore Lambert, Jim Lust, Walter Robinson, Don Schussler and Bill Whitaker. Also present was City Manager McMicken. Council members' discussed the Yakima Area Planning Committee. No conclusions were reached. The special meeting adjourned at 3:00 P.M. REGULAR MEETING - SEPTEMBER 11, 1972 - 3:00 O'CLOCK P.M. The City Council then met in regular session at the hour of 3:00 P.M., Mayor Broad pre- . siding, Councilmen Lambert, Lust, Robinson, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Brown absent on roll call, having been excused at the previous meeting. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of September 5, 1972, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read pub- licly, Mayor Broad declared said minutes approved as corrected. This being the time fixed for a Hearing on the Assessment Roll for L.I.D. No. 984, St. Elizabeth Hospital and Snokist Growers Domest -ic Water and Irrigation District, and there being no protests in writing or otherwise, it was MOVED by Robinson, seconded by Whitaker that Ordinance No. 1441 confirming said assessment roll, be passed as read: carried, Broad,.Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. Brown absent. ORDINANCE NO. 1441, AN ORDINANCE confirming the assessment roll covering Local Improve- ment District No. 984 as created and established by Ordinance No. 1355 of the Ordinances of the City of Yakima. Petition Nos. 752 and 753 having been filed with the City Clerk•:on September 1, 1972, by Orman - E. Arnold and Others, requesting improvement of property.by the construction of curbs, gutters and surfacing of Rock Avenue, and by the construction of water mains, Rock Avenue between King Street and Mead Avenue, it was MOVED by Robinson, seconded by Lust that Petition Nos. 752 and 753,. for the creation of Local Improvement Districts, be referred to the City Manager and Staff for study and recommendation: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. Petition No. 754, having been filed with the City Clerk on September 7, 1972, by Emil Kissel, Parks Superintendent and R. S. Goold, School District #7, requesting Vacation of a part of Beech Street for Park Department, it was MOVED by Lust, seconded by Schussler that a resolution be prepared setting October 10, 1972, as the time for a hearing by the City Council on the petition of. Emil Kissel and R. S. Goold, being Petition No. 754. City Attorney Andrews explained that since this vacation and the one following on the agenda are on behalf of the City, he has prepared resolutions to take place of this stan- dard motion. Councilmen Lust and Schussler withdrew their motion and second. It was then MOVED by Lust, seconded by Lambert that Resolution D -1923 fixing the time of hearing on the matter of the vacation of a portion of Beech Street for October 10, 1972, be passed as read: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. Brown absent. - RESOLUTION NO. D -1923, A RESOLUTION commencing street vacation proceedings and fixing the time and place for a hearing on the matter of the vacation of a of Beech Street, within the City of Yakima. . • Petition No. 755, having been filed with the City Clerk on September 7, 1972, by Emil Kissel', Parks Superintendent, requesting Vacation of part of "F" Street for Park Depart- ment, it was MOVED by Lust, seconded by Robinson that Resolution No. D -1924 fixing the time of hearing on said matter for October 10, 1972, be passed as read: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. Brown absent. RESOLUTION NO. D- 1924, A RESOLUTION commencing street vacation proceedings and fixing the time and place for. a hearing on the matter of the vacation of a portion of "F" Street within the City of Yakima. Damage Claims having been filed with the City Clerk on September 6, 1972, by Ruby L. McLaughlin, 322 North 26th Avenue, in the amount of $6.03 fo'r a garden basket damaged by the City Refuse Department, and by Harold I. Packer, 227 Cleman, in the amount of $15 for damages caused by a sewer backup, it was MOVED by Lust, seconded by Schussler that said claims for damage be referred to the City Manager and Staff for' study and recommen- dation: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. City Attorney Andrews requested that the matter of an Ordinance referring to the voters the deletion of the Charter provision requiring all resolutions and ordinances to be read in full, be continued for one week. He explained that dates specified by which legis- lation must be filed with the County. Auditor in order to get a proposition on the. general election ballot are such that September 18, 1972 would be "timely for Council action. It was then MOVED by Robinson, seconded by Whitaker that this matter be continued for one week or until September 18, 1972: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. City Clerk'Jack Daniel apprised the Council that it will cost approximately $700 to $900 to tie this proposition to the General Election. He stated that the City has to submit an ordinance to the County Auditor by the 22nd of September, 1972, in order for him to put it on the General Election ballot. 430 SEPTEMBER 11,.1972 Mr. Larry Mathews, 805 South 17th Avenue, reported On reactions to an initiative petition that he has been circulating in regards to removal of Yakima Valley Transportation railroad tracks from residential streets in Yakima. He indicated that there are strong feelings against the railroad tracks. Mr. Jean Allard, 416 South 15th Avenue, who has instigated said petition, raised the question.of whether trains or automobiles have the right of way on City streets. City Attorney Andrews indicated that more facts would have to be presen- ted before this question could be answered. Mr. Allard also asked for more background on a report of accident records on the Y.V.T. tracks, and it was determined that this report was supplied by the railroad. Mr. Allard asked what the Council's plans.were in terms of the franchise for Y.V.T., and it was pointed out that there will be staff and railroad discussions, Council meetings and public hearings on this matter, before the Council concludes on any of its decisions. Mr. Allard indicated that his main interest is safe streets. No formal action was taken. An appeal having been received from the Planning Commission's denial of the Application for Rezone, filed by Delmar and Beverly Jean Edler, requesting rezone of property located at 66 West Mead, it was MOVED by Schussler, seconded by Robinson that September 25, 1972, be set as a hearing date on this matter: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. Assistant Planner Ray Sturtz reported that the Planning Commission at its meeting of Sep- tember 5, 1972, recommended approval of a proposed Yakima Air Terminal General Plan Map and Figure 8, Noise Impacted Area Map as a portion of the Yakima General Plan. Mr Sturtz briefly described the General Plan Map for the Yakima Air Terminal and the Noise Impacted Area Map to be included as part of the General Plan Map for the airport. He stated that the technical aspects of the plan have been reviewed and informally approved by members of the Federal Aviation Administration. After due discussion, it was MOVED by Robinson, seconded by Whitaker that September 25, 1972, be set as the time for a hearing on this matter: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. City Manager McMicken explained that the aviation committee of the Chamber of Commerce, fixed base operators and others closely related to this matter would be invited to the hearing. A report having been received from the Planning Commission recommending approval of rail- road crossing improvements on Yakima Avenue, it was MOVED by Robinson, seconded by Schus- sler that September 25, 1972, be set as the time for a hearing on said matter: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote.. Brown absent. . • City Manager McMicken referred to the Resolution of Intention to create a local improve- ment district, South 18th Street and McNair Avenue Water District. He stated that this L.I.D. has been prompted.by a desire on the part of health officials to have a substitute water source available to replace the Abott well distribution system. He indicated that it has received approval from the County Commissioners. Public Works Director Dave Vargas reported that the plan would be to build lines down Ross Lane, McNair, Laketa and Lilac to serve all of the 45 parcels. He indicated that the estimated total cost of the project would be approximately $28,000. Mr. Vargas explained that about one -half of the cost is prorated equally to each parcel, and the one -half is prorated on square foot basis. City Manager McMicken pointed out that in addition to assessments, before a connection would be completed, the' property owners would have to apply for water service, pay ap- proximately $50 for a meter and .make their own house connection. After due discussion, it was MOVED by Robinson, seconded by Lambert that Resolution No. D -1925, a Resolution of Intention to create a local improvement district and fixing October 2, 1972, as a time for hearing on said matter,. be passed as read: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. Brown absent. RESOLUTION NO. D -1925, A RESOLUTION of intention to create a local improvement district. Parks and'Recreation Director. Bill Hutsinpiller reported that at the funding session of the state Interagency Committee for Outdoor Recreation, the Lions Swimming Pooa was clas- sified as #3 and did not receive the 75 percent funding assistance. He stated that we should resubmit this project for consideration and funding to the federal Bureau of Out- door Recreation for 50 percent funding. He explained that' ;th-e..application still will have to go through the state agency, which will have to approve the application on its merits and refer it to the federal government. /Mr. Hutsinpiller stated:;: that the Council would get further information in the future on this matter. No formal action was taken. Police Chief Jack LaRue reported, that the police department applied for and was granted a communications grant in 1970. He further reported that the grant has been completed for contract, as Phase I. He stated that in 1973 they would like to submit a second application to Law and Justice for supporting funds to complete the modernization of this system. Mr. LaRue reported that the total project cost is $41,455 of which the City's contribution will be $9,626. After due discussion, it was MOVED by Robinson, seconded by Lust that Resolution No. D -1926 authorizing submission of an application for Law and Justice funds to finance a Police Department Communications Center, be passed as read: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. Brown absent. RESOLUTION NO. D -1926, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to apply for a grant from the State of Washington, Planning and Community Affairs Agency Law and Justice Planning Office for a Communications Console Modernization project. City Manager McMicken referring to certification by the City Engineer of the completion of work and recommendation that the work be accepted and final payment made on the Gordon Road and North Sixth Avenue Domestic Water Cross -Tie Project to DeBlasio Construction Company in the amount of. $322.43, it was MOVED by Robinson, seconded by Lambert that the report of the City Engineer dated September 6, 1972, with respect to the completion of the work on Public Works Contract, Gordon Road and North Sixth Avenue Domestic Water Cross - Tie Project, be approved, the work be' accepted and payment of the final estimate as therein set forth is hereby authorized: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. 4317 SEPTEMBER.11, 1972 City Manager McMicken reported that bids were received and considered by a bid board on September 7, 1972 -, for the West Mead Avenue Arterial Improvement - Third Avenue to Ele- venth Avenue, as follows: Superior Asphalt & Concrete Co. $93,664.50 Yakima Asphalt Paving Co. $92,324.50 The City Engineer recommending that the contract be awarded .to Yakima Asphalt Paving Company, who submitted the lowest and best bid in the amount of $92,324:50, it was MOVED by Lust, seconded by Schussler that the recommendation of the City Engineer be accepted and that the contract be awarded to Yakima Asphalt Paving Co., in the amount of $92,324.50, and that the City Manager be authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote.. City Manager McMicken requesting that out -of -State travel be authorized for Emil Kissel, Park Supervisor, to attend the International Northwest Parks and Recreation Association Training Institute at Vancouver, B.C., September 27 through 29, 1972, it was MOVED by Robinson, seconded by Schussler that this travel be allowed with expenses paid: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. 433 SEPTEMBER 11, 1972 City Manager McMicken reported that in connection with 16th Avenue and Nob Hill Boulevard Intersection improvements, offer to sell documents have been received from Jack and Lillian Tangeman and Charles and Hazel Madden. City, Attorney Andrews explained that ordinarily a resolution is drawn up authorizing the purchase of right of way, but in this case, there are only two parcels to purchase and authorization can be done by motion. It was then MOVED by Robinson, seconded by that authorization be given to purchase these two parcels of property for 16th Avenue and Nob Hill Boulevard intersection im- provements as set forth in the offer to sell documents: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. Brown absent. City Manager McMicken announced the appointment of James Flint of Marced, California, as Administrative'Assistant, effective October 1, 1972. Mr. McMicken stated that Mr. Flint was chosen to replace Jim Williams. • City Manager McMicken excused at 4:50 P.M. City Attorney Andrews presented a plan proposed by the County Commissioner's office whereby indigent defendents charged with violating City ordinances would be provided with legal defense. He asked for tentative approval by the City Council of the plan that is still being developed, and it was MOVED -by Robinson, seconded by Schussler that said plan be informally approved: carried, Broad, Lambert, Lust, Robinson, Schussler and Whit- aker voting aye by voice vote. Brown absent. There being no further business to come before the Council, it was MOVED by Lust, seconded by Whitaker that we do now adjourn at the hour of 5:00 P.M.: carried, Broad, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote.
