D 60 2 0 A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Work Experience Agreement with the Central Wash- ington Home Builders Association. WHEREAS, the Central Washington Home Builders Association provides a training program to persons Wishing to acquire skills to enter the construction industry and this association has requested the City of Yakima to execute the attached agreement by which the City would cooperate in that program; and WHEREAS, the City Council deems it to be in the best interests of the City that the attached agreement be executed by the City and that the City cooperate in the Central Wash- ington Home Builders Association Training Program, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and City Clerk of the City of Yakima are hereby authorized and directed to execute an agreement with the Central Washington Home Builders Association, for the purpose mentioned above, a copy of which agreement, entitled "Work Experience Agreement," is attached hereto and by refer- ence made a part hereof. ATTEST: 4Ut11.p2 City Clerk (res/wrkxprnc.sc) Mayor WORK EXPERIENCE AGREEMENT It is hereby agreed between the City of Yakima (hereafter "the City") and the Central Washington Home Builders Association (here- after "the Association") that both parties will cooperate in the construction of a structure known as a "gazebo," in Miller Park on North 4th Street, Yakima, Washington, according to the following terms and conditions: 1. The purpose of the parties' affiliation is two -fold: (a) to provide sound and safe construction at low cost to the City, which shall serve the public's interests and (b) to provide a learning experience for persons wishing to enter the construc- tion industry. 2. The Association is responsible for the selection of trainees who can undertake and complete construction as promised and who conduct activities on public grounds in a safe and reli- able manner. The Association will provide trainees with safety instruction and supervision on the job site, adequate to ensure that safe practices are maintained. 3. The Association will defend and hold the City harmless from any claim or suit filed for any activity at Miller Park in which a trainee participated and for any act or omission attributable to a trainee, related to the gazebo project, and for which the City is notified of any damage or loss. 4. The Association will require, prior to participation of any trainee on this project, a statement by the trainee that the trainee (a) understands and agrees that s/he is not an employ- ee of the City of Yakima as a result of participation in this project nor that the trainee has any right to future employ- ment with the City of Yakima, (b) understands and accepts the risk of working with power tools and the other hazards in- volved in a construction project including working at heights off the ground, and (c) the City of Yakima does not provide any health insurance or worker's compensation coverage to trainees on this project. 5. The City of Yakima has the right to end the participation of any trainee whose performance or conduct on this project or in Miller Park is unsatisfactory. 6. The Association will not discriminate in its selection and training of the trainees, as to race, color, creed, religion, sex, marital status, age, national origin, or the presence of any sensory, mental or physical handicap provided that the prohibition against discrimination does not apply if a partic- ular disability prevents the proper performance of the partic- ular work involved. The Association shall provide personnel to perform manual labor for the construction of the gazebo and personnel to demonstrate proper construction techniques and supervise the trainees. All work will be done in a workmanlike manner, and the result shall be a sound structure made pursuant to plans and specifications approved by the City of Yakima prior to any construction. The City shall obtain a building permit and shall provide or pay for the cost of building materials for the gazebo. The City's financial obligation is stated in total in this paragraph. 8.
