A RESOLUTION authorizing the hiring of Robert Johns of the law
firm of Reed McClure for the purpose of repre-
senting the City before the Boundary Review Board
and in the matter of the City of Yakima v. Yakima
County, et al.
WHEREAS, the City of Yakima has previously retained the
law firm of Preston, Thorgrimson, Shidler, Gates and Ellis for
the purpose of representing the City in an appeal of the
Yakima County SEPA Responsible Official in the matter of the
formation of the West Valley Sewer District and before the
Yakima County Boundary Review Board concerning the formation
of the same sewer district; and
WHEREAS, a conflict of interest prevents the aforemen-
tioned law firm from continuing to represent the City of
Yakima in the appeal of the aforementioned SEPA litigation and
a conflict of interest may arise in representation of the City
before the Boundary Review Board; and
WHEREAS, the City Council seeks to obtain the most quali-
fied counsel available in this area of the law for representa-
tion of the City in this matter because of the importance of
the issues involved, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Council hereby authorizes and directs the City
Manager to retain attorney Robert Johns of the firm of Reed
McClure for the purpose of representing the City of Yakima in
the matter of City of Yakima v. Yakima County, et al. --
Yakima County Superior Court Cause No. 91-2-01860-9 and in the
matter of representing the City of Yakima before the Yakima
County Boundary Review Board when it considers the matter of
the West Valley Sewer District.
