The City Council met in special session pursuant to due notice at 12:00 Noon, August 28, 1972 in the Conference Room at Yakima City Hall. ' • Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Jim Lust, Walter II Robinson, Don Schussler and Bill Whitaker. Also present were City Manager.McMicken and City Attorney Fred Andrews... The Council engaged in a discussion of extention of City utilities to urban fringe areas as a policy for such extention of services is related to annexation and regional planning. No decisions were made, and the-Council agreed that the would be discussed again the following week. At 2:00 P.M. Jack Sparling, Chairman of a city convention and cultural center committee, arrived at the meeting, and discussed plans for developing a convention and cultural center. It was agreed that the staff would interview financial consultants for the • project. The special meeting ajourned at 3:00 P.M. REGULAR MEETING - AUGUST 28, 1972 - 3 :00 O'CLOCK P.M. The City Council then met in regular session at the hour of 3 :00 P.M., Mayor Broad pre- siding, Councilmen Brown, Lambert, Lust, Robinson, Schussler and Whitaker, City Attorney Andrews and City Manager McMicken present on roll call. The Invocation was given by Mayor Broad. The minutes of the regular meeting of August 21, 1972, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor ' Broad declared•said minutes approved . as - recorded. This being the time fixed for a Hearing on the;.Rezone..Application filed by Mrs. Raymond Spratt, requesting rezone of property located at 317 North First Street, Planning Director Jay Otto reviewed the staff report on this request dated July 24, 1972, and Plan- ning Commission minutes dated August 1,. 1972. He reported that in order to piovide an opportunity-to conform with the General Plan and correct an error. in the official zoning map for the City of Yakima, the entire west half of the blocks 27 and 28, which are located immediately east of North First Street and'between East D and East B Streets, have been included in the advertising of this rezone request. He further reported that the Planning Staff and Commission recommend approval of the rezone request from B-2, Local Business Zone to B -3, General.. Business Zone in that this request: 1. Conforms to the General Plan; 2. Conforms with land use trends in the area ;• 3. Corrects an obvious error. , o.n the official zoning map; 4. Makes several existing non - conforming uses conforming. • After due discussion, it.was MOVED by Brown, seconded•by Whitaker.•that Ordinance No. 1435 accepting the recommendation of the Planning Commission and zoning. said property from B -2, Local.Business Zone, to B -3, General Business Zone, be passed as read: carried', Broad, Brown, Lambert, Lust; Robinson; Schussler and Whitaker voting aye.on roll.call. ORDINANCE.NO. 1435,. AN ORDINANCE accepting the recommendation-of-the Planning Commission and rezoning• certain property situated at 317 North 1st Street in the City of Yakima, Washington, from B -2, Local Business.Zone,.,to B -3, General B.usiness..Zone.. This-being the time fixed for a Hearing on•the•Rezone Application, filed by Yakima Public Schools, requesting.rezone of•property located at 104 North 4th Avenue; Planning Director Jay Otto explained that the Yakima School District plans to enlarge and modernize the existing office space and maintenance facilities located on this site. He stated that by presently being in two zones, a..portion of the facility is nonconforming. Mr. Otto referred to• the' staff report• on•• this matter dated: July•24, 1972 . and •the Planning Commis- sion minutes.dated.August, 1, 1972: Hereported the Planning Staff and Commission recommend the application be approved, in that the rezone conforms to the General Plan . and land development trends in the area.: •After due. discussion; ' it was. Polo, requestingrezone•.of property Iodated at 208 North 6th Avenue from R =3 Multiple Family Zone B -2. Modified Business-.Zone, or B -3; General Jay Otto re -• viewed the staff report on this matter.dated;July 24, 1972 and the Planning Commission minutes dated August:l, 1972. He explained that the staff has.expanded the area of con- sideration to include the additional• areas from 106 -through 212!North 6th Avenuer.and 105 through 211 North 7th.Avenue to permit consideration of a•darger rezone• area•.' Mr reported that based. upon the currentiland use zoning of the .area in question, the recommendation of the General Plan, the - .Arterial Street Plan and : the•findings -that• have been developed, the staff and Planning Commission recommend that the subject area be re- zoned to B -2 Modified Business Zone. Present and speaking to the matter was Mrs. Freeland, 201 North 7th Avenue. AUGUST 28, 1972 ORDINANCE NO. 1437, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 208 North 6th Avenue in the City of Yakima, Washington, from R -3, Multiple Family Zone, to B -2, Modified Business Zone. A Damage Claim having been filed with the City Clerk on August 25, 1972, by Earnest and Elizabeth Lee, in the amount of $11,000.00 for damages caused by a flood -out, it was MOVED by Schussler, seconded by Lust that said claim for damages be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and voting aye by voice vote. An Ordinance appropriating $5,000 within the Airport Fund and hiring professional services for airport planning having been read in its entirety at the previous meeting of August 21, 1,972, and being read by title only at this meeting, it was MOVED by Lambert, seconded by Brown that Ordinance No. 1438 providing for said appropriation, be passed as read: car- ried, Broad, Brown, Lambert, Lust, Schussler and Whitaker voting aye on roll call. Ro- binson not voting. ORDINANCE NO. 1438, AN ORDINANCE appropriating the amount of $5,000 from unappropriated money in 171- Airport Fund to Account 17 1 :543.31.31, Professional Services of the 1972 appropriation for 171- Airport Fund. It was MOVED by Lust, seconded by Whitaker that Ordinance No. 1439 specifying salaries for certain City employees and amending the Yakima Municipal Code, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. City Manager McMicken explained that this Ordinance is necessary to correct an Ordinance passed the previous week, wherein the class title Deputy City Clerk was omit- ted. ORDINANCE NO. 1439, AN ORDINANCE relating to a classification plan and salary ranges for certain city employees; amending Subsection (b) of Section 2.20.100 of the City of Yakima Municipal Code; and declaring an emergency. It was MOVED by Robinson, seconded by Lambert that Ordinance No. 1440 placing -a parcel of real property on the Irrigation Maintenance Roll of Local Improvement District No. 793, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. City Andrews explained that an agreement has been exe- cuted by the people involved and the assessmen_t..has.been paid.. ORDINANCE NO. 1440, AN ORDINANCE placinga`.parcel, of :.real - property_ in the City of Yakima on the Irrigation Maintenance Roll of Local Improvement District No. 783. City Manager McMicken brought on an off - the - Agenda item, that of Council approval of floor plans for the Senior Citizen Center. Mr. McMicken reviewed the Parks and Recreation Commission minutes on this matter dated August 25, 1972, in which the Commission concurred with the feelings of the Senior Citizen Steering Committee, and it approved the floor plan, requesting Mr. Bob Williams from the firm of Doudna - Williams to proceed with de- tailed drawings and specifications. Mr. Williams presented the floor plan for this . facility, which was reviewed by the Council. He indicated that anticipated construction costs are approximately $150,000 to $160,000, and the budget has approximately $20,000 for equipment. Mr. Williams explained that building plans included site' development, but not landscaping. City Manager McMicken explained that with the Council's approval, bids would be let'for construction of the Senior Citizen Center. After due discussion, it was MOVED by Lambert, seconded'by Brown that the floor plans be approved and bids be called for on construction of the Senior Citizen Center: carried, Broad, Brown, Lam - bert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. City' Manager McMicken explained that at the Parks and Recreation Commission meeting of August 25, 1972, the Commission recommended that the City drop the condemnation proceedings against Mk: and Mrs. Fred W. Riebe Jr. for the acquisition of property in connection with the Senior Citizen Center. After due discussion, it was MOVED by Lust, seconded by Brown that the City Attorney be directed to prepare legislation. that would dismiss the condem- nation proceedings against Mr. and Mrs. Riebe Jr.: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote. City Manager McMicken reported that the acquisition of a new park site on the west side\ of town will not be pursued with the intent of making an application for funding before the October 1, 1972 deadline. He stated that the reasons for this delay are (1) we don't have time to properly analyze the sites and obtain necessary appraisals justifying ac -, quisition cost, or to conclude the preliminary park development plan, and (2) the City does intend to file a proposal for funding for the park site now designated as Freeway Properties. He further stated that a preliminary park development plan is completed on this project that far more prepared for submittal, and that this plan will be pre- sented to the Council within the next month. Mr. McMicken explained that Parks and Recreation Director Bill Hutsinpiller has indicated it will be unlikely that .the City would get approval on parks for both the east and west sides of town. No formal action was taken. Councilman Whitaker excused at 4:15 P.M. City Manager McMicken explained that the engineering staff has negotiated an agreement with the Union Pacific Railroad Company and the State of Washington to accomplish the improvement of railroad grade crossings on Yakima Avenue. He reported that the total project cost will be $16,715, of'which Union Pacific Railroad will pay $1,040. He stated that the City's' share of $15,675 will be eligible for TOPICS financing. After due discussion, it was MOVED by Robinson, seconded by Lust, that Resolution No. D -1918 authorizing execution of said agreement with Union Pacific Railroad Company and the State of Washington, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Schussler voting aye on roll call. Whitaker absent. RESOLUTION NO. D -1918, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an agreement with Union Pacific Railroad Company and the State of Washington Highway Commission for improvement of the railroad grade crossing at Yakima Avenue. 425 • AUGUST 28,'1972 • City Manager McMicken reported that. Mr. Andrew Schab, Jr., 49 West Mead, has requested the vacation of a 16 foot wide utility easement. He further reported that the City has no objections, and all utility companies that might be involved have indicated concurrence • with this easement vacation. After due discussion, it was MOVED by Lambert, seconded by Robinson' that Resolution No. D- 1919:vacating a public utility easement held by the City of Yakima, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Schus- sler voting aye bn roll call. Public Works Director Dave Vargas reported that bids were received and considered by a bid board on August' 1972; 'for the South 16th Avenue and Nob Hill Boulevard Intersection Improvement as follows: r . . Schedule I Schedule II Total Yakima.Aspha•lt Paving Co. $10,277,93/= $28,081.25 $38,359.18 Superior'Asphalt•.& Concrete Co. $14,067.38 $23,396..00 $37,463.38 • The City Engineer recommending that the contract be awarded to Superior Asphalt & Con - crete Company, who submitted the lowest and best bid in the amount of $37,463.38; it was MOVED by 'Robinson, seconded by Lambert that the recommendation of the City Engineer be accepted and that.the contract be awarded to Superior Asphalt & Concrete Company, in the amount of $37,463.38, and that the City Manager be authorized to enter into a contract with said. contractor upon the filing of the proper bond and insurance: carried, Broad, Brown, Lambert, Lust, Robinson and_Schussler'voting aye.by voice'vote. Whitaker absent. Public Works Director.Dave Vargas reported that bids were received and considered by a bid board on August 17, 1972, for the South First Street and Mead Avenue•Sewer District, as follows: • • Larry DeBlasio Const. Co. $10,195.50 Ray C. Pickens $.8,513.93 . Mr. Vargas 'explained that both bids exceed the'engineer's estimate over 10 %, therefore, it is the'City recommendation that these two bids be rejected, and this project be combined with.L.I.D. No. 988, Franklunds Pear Blossom Addition and Others Sewer and Water District,. when the protest time expires for that project. After due discussion, it 'was MOVED .by Lust,. seconded by Schussler that the recommendation of.the City'Engineer be accepted and that both bids received for the South First Street and:Mead Avenue Sewer District, be rejected: carried, Broad, Brown, Lambert, Lust, Robinson and Schussler voting aye by voice vote. - Whitaker absent. • • Council members discussed the purchase of amplifying equipment the Council chambers. • City Manager McMicken reported that the. approximate cost for microphones would be $55 ' apiece. Councilmen Broad and Robinson indicated that unless.this equipment was a'ne- cessity, they were 'opposed to this purchase. Councilman Lambert.asked•if the 'decision on this matter could be delayed, and Council members concurred. •No formal action was • taken. 1 • There being no further business to come before the Council, it was MOVED by Lust, seconded by Robinson that'we do now adjourn at the hour of 4 :30 P.:M.: carried, Broad, Brown,.Lam- bert, Lust, Robinson and Schussler voting aye by voice vote.
