A JOINT RESOLUTION OF' THE CITY OF YAKIMA AND YAKIMA COUNTY approving .certain Yakima Air Terminal Board 'resolutions and authorizing implementation. WHEREAS, the. Yakima Air Terminal Board is the regulatory and administrative agency for the Yakima Air Terminal with authority under RCW 14.08.200(7). to adopt rules and regula- tions .for the management, government, and use of properties under its control; and WHEREAS, the Yakima Air Terminal Board is within the jurisdiction of: the.: Federal Aviation Administration which requires certain regulations regarding ground vehicle opera- tions; and . WHEREAS, a. United States Customs Office has started service -and operations at the Yakima Air Terminal, for which the United States' Customs requires a user fee due to the. volume of business at ,the Yakima Air Terminal; and WHEREAS,. the Yakima Air Terminal Board has adopted cer- tain rules and regulations for the above-described purposes, which' rules and regulations are contained in the attached Yakima Air Terminal Resolutions 09-91-002 and 09-91-003, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The Yakima Air Terminal Resolutions 09-91-002 _and 09-91-003, copies of which are attached and incorporated as a part hereof, are hereby "approved and their implementation is authorized as of the date of this resolution's enactment by the City of Yakima City Council. Chairman Commissioner T,zs, Commissioner ATTEST: Clerk of the Board By: Approved as to form: Deputy Prosecuting Attorney fres/airtrmnl.sc) YAKIMA AIR TERMINAL RESOLUTION 09-91-003 RATES, FEES, AND CHARGES FOR AIRPORT USER FEE CUSTOMS SERVICES SECTION 1: SERVICE PROVIDED BY U.S. CUSTOMS, USER FEES FOR CLEARANCE OF PILOTS, PASSENGERS, AND THEIR PERSONAL EFFECTS. PILOTS AND PASSENGERS OF AIRCRAFT UTILIZING U. S. CUSTOMS CLEARANCE AT YKM, WHETHER PRIVATE, RECREATIONAL, COMMERCIAL, OR PRIVATE CHARTER, WHERE CLEARANCE IS REQUIRED FOR PERSONS AND THEIR PERSONAL EFFECTS ONLY. 1. The Owner or Operator of any aircraft transporting passengers into the United States and landing at the Yakima Air Terminal to clear U.S. Customs shall pay to the Yakima Air Terminal a user fee of $20.00 if invoiced by the Airport, or $15.00 if paid directly to the Airport during normal business hours (Monday -Friday, 8 am to 5 pm, except holidays), for each and every aircraft operation at Yakima requiring U.S. Customs clearance for persons and their personal effects only. In addition, if the service provided by U.S. Customs is at a time other than the normal business hours of the U.S. Customs Inspector,(Monday-Friday, 8 am to 12 noon, 1 pm to 5 pm, closed holidays), the aircraft owner or operator shall reimburse, directly to U.S. Customs, the costs of any overtime or other charges imposed by Customs. EXCEPT, the Airport customs user fee will be waived for the clearance of pilots, passengers, and their personal effects of U.S. Government or Canadian Forces aircraft when clearing customs at Yakima. 1 SECTION 2: SERVICES PROVIDED BY U.S. CUSTOMS, USER FEES FOR OTHER ACTIVITIES U.S. CUSTOMS INSPECTOR SERVICES FOR ACTIVITIES OTHER THAN CLEARANCE OF PILOTS, PASSENGERS, AND THEIR PERSONAL EFFECTS: 1. For goods and commodities entering the United States at the Yakima Air Terminal, or other activity utilizing the official services of the U.S. Customs Inspector based at the Yakima Air Terminal, the person, firm, or corporation (consignee) requesting such entry or service shall pay to the Yakima Air Terminal a customs user fee and other fees as outlined below. A. For clearance of air freight aircraft 12,500 pounds or less maximum gross landing weight, and its contents, the customs user fee shall be $50.00, exclusive of any U.S. Customs fees that may be imposed. B. For clearance of air freight aircraft with a gross landing weight of greater than 12,500 pounds , the customs user fee shall be $100.00, plus $20.00 for each goods or commodity entry, whether formal or informal, requiring customs action, exclusive of any U.S. Customs fees that may be imposed. C. For clearance of commercial vehicles, other than aircraft, the customs user fee shall be: a) For the 1991 calendar year, $10.00 per entry, either formal or informal. b) Effective January 1, 1992, and until further amended, $20.00 per entry, formal or informal, for the first 10 entries from any individual person, firm, or corporation (consignee), then $10.00 per entry for each subsequent entry up to a maximum yearly fee of $1,200.00 for any individual person, firm, or corporation (consignee). c) These charges do not include any fees or charges levied by U.S. Customs. U.S. Customs fees shall not be included as part of the maximum yearly fee. D. For any other service requiring U.S. Customs action, for which action is performed by the U.S. Customs inspector based at the Yakima Air Terminal, the person, firm, or corporation (consignee) requesting such action shall pay to the Yakima Air Terminal a customs user fee of $20.00 per individual action, exclusive of any U.S. Customs fees that may be imposed. 2 SECTION 3: OTHER FEES AND CHARGES THE FOLLOWING FEES AND CHARGES WILL BE IMPOSED ON USERS OF THE YAKIMA AIR TERMINAL WHO DO NOT HAVE A LEASEHOLD OR OTHER ARRANGEMENT WITH THE AIRPORT ESTABLISHING FEES AND CHARGES BY WRITTEN CONTRACT, LEASE, USE AGREEMENT OR OTHER LEGAL INSTRUMENT. 1. For aircraft operations outlined in Section 2, aircraft landing fees shall be paid to the Yakima Air Terminal in accordance with the following rate schedule. A. $0.55 for each 1000 pounds of gross landing weight for each landing, or, $10.00, which ever is greater. 2. For aircraft operations outlined in Section 2, an aircraft parking fee shall be paid to the Yakima Air Terminal in accordance with the following rate schedule. A. For aircraft with a gross landing weight- of 12,500 lbs or less, the fee shall be: 0-8 hours, no charge 8-24 hours, $3.00 each additional 24 hour period, $3.00 B. For aircraft with a gross landing weight of 12,501 lbs or greater, the fee shall be: 10 percent of landing fee, or $10.00, whichever is greater, for each consecutive 24 hour period. SECTION 4: METHOD OF PAYMENT PAYMENT OF THE REQUIRED USER FEES AND OTHER CHARGES SHALL BE MADE IN THE FOLLOWING MANNER. A. All customs user fees, landing fees, and parking fees shall be paid to: YAKIMA AIR TERMINAL 2300 WEST WASHINGTON AVENUE YAKIMA, WASHINGTON 98903 B. All such fees and charges shall be due and payable as incurred, and shall be subject to a delinquency charge of one and one half percent (1 1/2%) per month in the event of failure to pay within ten (10) days of billing date. 3 SECTION 5: AMENDMENT OF FEES AND CHARGES THE YAKIMA AIR TERMINAL BOARD MAY ADJUST THESE FEES AND CHARGES, FROM TIME TO TIME, WITH THE AMENDED FEES AND CHARGES BECOMING EFFECTIVE IMMEDIATELY UPON BOARD ACTION. SECTION 6: DEFINITIONS ENTRY shall mean when paperwork is submitted to U.S. Customs by a entry filer to obtain release of merchandise. CONSIGNEE shall mean the person, firm, or corporation to whom imported merchandise is shipped. COMMODITY shall mean any article of commerce. OTHER ACTIVITIES REQUIRING U.S. CUSTOMS ACTION shall include drawbacks, intensive exams, statement processing, inspections, and the like. AIRCRAFT GROSS LANDING WEIGHT shall mean the maximum gross landing weight for the aircraft as approved by the Federal Aviation Administration (per FAA Advisory Circular 150/5325-5, latest edition). SECTION 7: EFFECTIVE DATE OF RESOLUTION THIS RESOLUTION SHALL BE IN FULL FORCE AND EFFECT UPON ADOPTION BY THE YAKIMA AIR TERMINAL BOARD. YAKIMA AIR TERMINAL RESOLUTION 09-91-002 GROUND VEHICLE OPERATIONS The Yakima Air Terminal is a Certificated Commercial Service Airport operating in accordance with Title 14, Code of Federal Regulations, Part 139, Certification and Operations: Land Airports Serving Certain Air Carriers. 14 CFR 139-329, Ground Vehicles states; EACH CERTIFICATE HOLDER SHALL; (a) Limit access to movement and safety areas only to those ground vehicles necessary for Airport Operations; (b) Establish and implement procedures for the safe and orderly access to, and operation on, the movement areas and safety areas by ground vehicles, including provisions identifying the consequences of noncompliance with the procedures by an employee, tenant, or contractor; (c) When an air traffic control tower is in operation, ensure that each ground vehicle operating on the movement area is controlled by one of the following: (1) Two way radio communications between each vehicle and the tower. (2) An escort vehicle with two way radio communications with the tower to accompany any vehicle without a radio, or, (3) Measures acceptable to the Administrator (F.A.A.) for controlling vehicles, such as signs, signals, or guards, when it is not operationally practical to have two way radio communications with the vehicle or an escort vehicle. (d) When an air traffic control tower is not in operation, provide adequate procedures to control ground vehicles on the movement area through prearranged signs or signals. (e) Ensure that each employee, tenant, or contractor who operates a ground vehicle on any portion of the airport that has access to the movement area is familiar with the airports procedures for the operation of ground vehicles and the consequences of noncompliance;, and, (f) On request by the Administrator, make available for inspection any record of accidents or incidents on the movement areas involving air carrier aircraft and/or ground vehicles. 1 THEREFORE, THE YAKIMA AIR TERMINAL BOARD, BY RESOLUTION, ESTABLISHES THE FOLLOWING PROCEDURES FOR THE MOVEMENT OF GROUND VEHICLES ON THE MOVEMENT AND SAFETY AREAS OF THE YAKIMA AIR TERMINAL SECTION 1, DEFINITIONS MOVEMENT AREA means the runways, taxiways, and other areas of the airport which are used for taxiing, air taxiing, takeoff, and landing of aircraft, exclusive of loading ramps and aircraft parking areas. NON MOVEMENT AREAS, as it relates to this resolution, shall mean all other areas of the airport within the security perimeter fence, other than movement or safety areas, including loading ramps, service roads, aircraft parking ramps, and the like, that have direct access to the movement or safety areas. SAFETY AREA means a designated area abutting the edges of a runway or taxiway intended to reduce the risk of damage to an aircraft inadvertently leaving the runway or taxiway. SAFETY AREA DIMENSIONS RUNWAY 9-27 500' wide situated equally about the runway centerline (250' each side of runway centerline) and extending 1000' westerly beyond the threshold of runway 09, and easterly 750' beyond the threshold of runway 27. RUNWAY 4-22 300' wide situated equally about the runway centerline,(150' each side of runway centerline) and extending 600' beyond each runway threshold. TAXIWAYS 118' situated equally about the taxiway centerline (59' each side of taxiway centerline). GROUND VEHICLES NECESSARY FOR AIRPORT OPERATIONS means vehicles used in direct support of rescue, maintenance, and inspection activities associated with the movement and safety areas. These include ARFF (Aircraft Rescue and Fire Fighting) vehicles, law enforcement vehicles, ambulances, snow removal vehicles, mowers, airport operations vehicles, FAA and NWS vehicles, contractor vehicles while under employment of or contract with the airport, FAA, or NWS, and the like. AIRCRAFT SERVICE VEHICLES means vehicles necessary to provide service to aircraft. Vehicles in this category are fuel trucks, aircraft tugs, deicers, aircraft ground power units, and the like. AIRCRAFT SUPPORT VEHICLES means catering vehicles, courtesy vans, cargo vehicles, baggage tugs, and the like. 2 OTHER VEHICLES means vehicles that, on occasion, have a necessity to operate on movement areas or safety areas or on non movement areas with direct access to movement or safety areas. This category of vehicles includes military vehicles, vehicles for the transport of dignitaries, delivery vehicles, and the like. ESCORT VEHICLES means a vehicle equipped with an operating amber rotating beacon or strobe, a radio capable of transmitting and receiving transmissions on ground control frequency, 121.9 mhz, and operated by a person who has been issued a permit by the Yakima Air Terminal authorizing him/her to operate the vehicle in the prescribed area. AIR TRAFFIC CONTROL TOWER (ATCT) means the F.A.A. air traffic control facility at the Yakima airport, which hours of operation are currently from 0600 icl to 2200 icl daily. ACCEPTABLE TRAINING COURSE shall mean the training course developed by the Yakima Air Terminal, including this resolution, airport layout maps, including Exhibit A, and the Department of Transportation/Federal Aviation Administration publication AS -90- 3, contained herein and by reference made a part of this resolution. Each person requesting authorization to operate ground vehicles on the movement areas, safety areas, or on non movement areas with direct access to movement and safety areas, must certify, in writing, to the Airport Manager that he/she has read and does understand the guidelines in the resolution, the DOT/FAA publication, and maps, and does understand the conditions contained therein. NOTICE; If any deviations in procedures exist between the FAA publication and the Resolution, the Resolution shall take precedence. AIRPORT CLOSURE means when all or a portion of the movement areas, safety areas, or non movement areas with direct access to the movement areas or safety areas of the airport are closed due to emergencies, incidents, accidents, or other activities resulting in closures. REGULARLY OPERATE shall means a person who regularly operates a vehicle on movement areas, safety areas, or non movement areas of the Yakima Air Terminal in connection with their employment. SHORT TERM OPERATION means an operation necessitated by a single event or short term activity. Short term shall mean three days or less. 3 SECTION 2, VEHICLE OPERATIONS ON MOVEMENT AND SAFETY AREAS - AUTHORIZATION. A. After November 30, 1991, only persons who have satisfactorily completed an acceptable training course shall operate ground vehicles on the movement areas, safety areas, or non movement areas with direct access to the movement areas or safety areas of the Yakima Air Terminal. Such operations shall be in accordance with the following terms and conditions. 1. All vehicles operating on the movement or safety areas must have; a. An operating amber rotating beacon or strobe, and, b. Radio capable of communicating with Yakima ATCT. OR c. Escorted by a vehicle with a and b. EXCEPT d. During periods of airport closures due to aircraft incidents or accidents, or other types of emergency responses resulting in airport closures, these conditions will not apply to vehicles of emergency response agencies while operating in the closed areas. 2. The driver of each vehicle must have a permit issued by the Yakima Air Terminal authorizing said person to operate on movement and safety areas, or areas with direct access to the movement or safety areas, of the Yakima Air Terminal, unless said driver is escorted by and under the direct and immediate control of a permittee. Persons requesting permits must; a. Obtain training materials available from the airport. b. Thoroughly read and understand all training materials. c. Satisfactorily complete questionnaire attached to the training materials. d. Enclose completed questionnaire, written certification that all materials have been read and understood by the applicant, a description of the activity necessitating access to the movement areas or safety areas or areas with direct access to the movement and safety areas, and the required fee of $10.00. Return all materials to the Yakima Air Terminal, Managers Office, 2300 West Washington Avenue, Yakima, Washington, 98903, EXCEPT; The permit fee will be waived for public agencies. e. Upon receiving items listed in 2d, and if the Airport Manager or his designee determine that sufficient training has been accomplished and the applicant has need for such permit, the airport will issue an "Authorization To Operate Ground Vehicles" permit. f. While operating a ground vehicle on the movement areas and safety areas of the airport, the permittee shall display the permit on their person in a visible location. 4 EXCEPT, during periods of airport closures due to aircraft incidents or accidents, or. other emergency responses resulting in airport closures, these conditions will not apply to drivers of emergency response vehicles while operating in the closed areas. NOTICE: A PERMIT TO OPERATE GROUND VEHICLES ON THE MOVEMENT AND SAFETY AREAS OF THE AIRPORT DOES NOT ALLOW ACCESS TO THE PASSENGER PRE -BOARDING AREA OR THE TERMINAL RAMP AREA. ACCESS TO THESE AREAS IS COVERED UNDER SEPARATE RESOLUTIONS AND ORDINANCES, AS GOVERNED BY 14 CFR PART 107 AND 108, AIRPORT AND AIRLINE SECURITY, AND THE AIRPORT SECURITY MANUAL (RESTRICTED ACCESS DOCUMENT). SECTION 3, VEHICLE OPERATIONS ON NON MOVEMENT AREAS HAVING DIRECT ACCESS TO MOVEMENT OR SAFETY AREAS, AUTHORIZATION, DEVIATIONS, AND EXCEPTIONS. A. Operators of aircraft service vehicles, or other vehicles WHO REGULARLY OPERATE VEHICLES on non movement areas with direct access to the movement areas or safety areas must be operated in accordance with the following guidelines. 1. Operators of such vehicles must complete the training in Section 2, paragraph 2, except the permit issued will be valid for vehicle operations on non movement areas only. 2. Vehicles operating on non movement areas that DO NOT, by the nature of their operation, enter movement or safety areas are not required to have radio capability with the ATCT nor are they required to have rotating beacons or strobes. If such a vehicle develops a need to operate on the movement or safety areas, it must be accompanied by an escort vehicle and the driver must comply with all applicable requirements of this resolution. B. Operators of aircraft service vehicles, or other vehicles WHO REQUIRE SHORT TERM OPERATIONS on any portion of the airport, whether movement area, non movement area, or safety area; 1. Must have an escort vehicle, or, 2. Prior to each operation, authorization for any such operation must be obtained from the airport management. It must be demonstrated that the operation can be conducted in a safe manner and within the intent of this resolution. Authorization for operations at times other than normal airport business hours must be obtained during normal business hours. Business hours are 0800 to 1630 , Monday through Friday, closed holidays. No authorization will be given for operations on runways or taxiways, or their safety areas without an escort vehicle. 5 SECTION 4, GENERAL OPERATIONAL GUIDELINES A. During periods of tower operation, clearance must be obtained from tower personnel before entering the movement areas or safety areas of the Yakima Air Terminal. Tower operation hours currently 0600 lcl to 2200 lcl daily. B. During periods that the tower is closed, currently 2200 lcl to 0600 icl daily, each vehicle operator shall; 1. Announce their intentions on ground control frequency (121.9) prior to entering a movement area or safety area, stating; a. "Attention all aircraft at Yakima Air Terminal" b. State the vehicles call sign and present location. c. State which safety area or movement area the vehicle will be operating on. d. State the vehicles final destination. 2. Wait for an acknowledgement of the transmission from aircraft or other ground vehicles operating in the vicinity. 3. Visually scan the area, including traffic patterns and approaches, and listen for noises that would indicate aircraft operations. STOP, LOOK, LISTEN. 4. Proceed with extreme caution. Remember, aircraft always have the right of way over ground vehicles. 5. Once clear of the safety area or movement area, again announce on ground control frequency that the vehicle is out of the movement or safety area. C. Runway crossings and entering runway safety areas will be allowed only under the following conditions. 1. Vehicles necessary for airport operations may enter any portion of the movement areas or safety areas while operating in accordance with procedures outlined in this resolution. 2. Aircraft service vehicles are not allowed to cross, operate on the runway surface, or operate in the safety area of runway 09-27. If necessary, service vehicles may cross runway 04-22, preferably at the threshold of runway 22, and all operations must be in strict accordance with procedures outlined in this resolution. 3. Aircraft support vehicles are not allowed to cross or to enter the safety areas of either runway. 4. Other vehicles are not allowed to operate on any runway or runway safety area without an escort vehicle. 6 D. Operations on taxiways and associated safety areas will be allowed only under the following conditions. 1. Vehicles necessary for airport operations may enter any portion of the movement areas or safety areas while operating in accordance with procedures outlined in this resolution. 2. Aircraft service vehicles may operate on the taxiways and associated safety areas when a demonstrable need exists for such operation. All such operations shall be conducted in accordance with procedures outlined in this resolution. 3. Aircraft support vehicles are not allowed to operate on any taxiway or its associated safety areas without an escort vehicle. 4. Other vehicles are not allowed to operate on any taxiway or associated safety area without an escort vehicle. SECTION 5, CONSEQUENCES OF NONCOMPLIANCE. A. After November 30, 1991, any person operating a ground vehicle on a movement area, safety area, or non movement area with direct access to the movement areas or safety areas of the Yakima Air Terminal in violation of this resolution shall; 1. For the first offense, have his/her airport driving privilege suspended until such time proper training is accomplished and a Authorization Permit has been issued by the Airport. 2. For any consecutive offense, or first offense if committed with wilful disregard to the rules and regulations of the Yakima Air Terminal, a complaint may be filed with the City of Yakima Police Department charging the violator with criminal trespass in the second degree in accordance with RCW 9A.52.080, as it now reads or may be amended in the future. 3. Any additional or further criminal offenses will be dealt with appropriately. 7 SECTION 6, AUTHORIZATION PERMIT, SAMPLE.
