D 5 9 97 A RESOLUTION authorizing the City Manager and the City Clerk of Yakima to execute a release of easement re- garding property of James E. Guthrie. WHEREAS, the City of Yakima acquired an easement on July 6, 1990, in the property of James E. Guthrie, for the purpose of installing and maintaining utilities for a prospective development by the property owner; and WHEREAS, the property owner has petitioned the City to vacate the easement due to his decision to not proceed with the development plans; and WHEREAS, the City Council deems it to be in the best interest of the City that the easement be vacated, now, there- fore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and the City Clerk are hereby authorized and directed to execute a "Release of Easement," a copy of which release is attached hereto and by reference made part hereof. Guthrie of 5 Narth 46th Avenue, Yakima, WA On July 6, 1990, James E. Guthrie granted to the City of Yakima an easement for installing and maintaining utilities across real property described as follows: A 16.00 foot easement for public utilities over and across that portion of Lots 56 and 57 of Plat of First Addition to Suburban Acre Homes as recorded in Volume "B" of Plats at Page 72, Records of Yakima County, Washington, described as follows: The North 16.00 feet of the South 196.00 feet of the above described parcel, EXCEPT the East 168.50 feet thereof, AND a 16 over and of Plat Homes as Page 72, described the West the above .00 foot easement for public utilities across that portion of Lots 56 and 57 of First Addition to Suburban Acre recorded in Volume "B" of Plats at Records of Yakima County, Washington, as follows: The South 196.00 feet of 16.00 feet of the East 168.50 feet of described parcel. In consideration of the payment of One Dollar ($1.00), receipt of which is acknowledged, the City of Yakima does, by this instru- ment, release to James E. Guthrie the easement described above, it being the intention of the parties to terminate such easement. In witness whereof, I have caused this release to be executed at Yakima, Washington on the date indicated below.
