A RESOLUTION authorizing the City Manager and City Clerk of
the City of Yakima to execute an interlocal
cooperative solid waste agreement with the County
of Yakima pursuant to RCW Chapter 39.34.
WHEREAS, RCW Chapter 70.95 requires the City of Yakima
and County of Yakima to develop a coordinated, comprehensive
solid waste management plan as a cooperative effort; and
WHEREAS, the City needs to enter into an interlocal
cooperative agreement with the County of Yakima to memorialize
the terms of this cooperative solid waste management effort;
and
WHEREAS, the City Council deems it to be in the best
interest of the City of Yakima to execute the attached Solid
Waste Interlocal Agreement, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk are hereby authorized and
directed to execute the attached agreement entitled "Solid
Waste Interlocal Agreement."

SOLID WASTE INTERLOCAL AGREEMENT
This Agreement is entered into between Yakima County, a political
subdivision of the State of Washington and Yakima City
a municipal corporation of the State of Washington, hereinafter
referred to as "County" and "City" respectively.
PREAMBLE
This Agreement is entered into pursuant to Chapter 39.34 RCW for
the purpose of cooperative management of solid waste in Yakima
County. It is the intent of the parties to work cooperatively in
establishing a solid waste management plan pursuant to Chapter
70.95 and with emphasis on the established priorities for solid
waste management of waste reduction; waste recycling; energy
recovery, incineration, or landfilling of separated waste; or
landfilling of mixed wastes. The parties support waste reduction
and recycling and shall cooperate to achieve the goals established
by the solid waste management plan. The parties acknowledge their
intent to meet or surpass applicable environmental standards with
regard to the solid waste system.
I. DEFINITIONS
For purposes of this Agreement the following definitions shall
apply: "Solid Waste Management Plan" means the comprehensive plan
for solid waste management and updates as required by RCW
70.95.080.
"Solid Waste Advisory Committee" or SWAC means a group formed
pursuant to the solid waste planning guidelines comprised of
representatives of unincorporated Yakima County, incorporated
cities and towns, industry and businesses appointed by the Board
of Yakima County Commissioners.
"Disposal" means the discharge, deposit, injection, dumping,
leaking, or placing of any solid waste into or on any land or
water.
"Diversion" means the directing or permitting the directing of
solid waste to disposal facilities other than the disposal site
designated by Yakima County.
"Moderate Risk Waste" means (a) any waste that exhibits any of the
characteristics of hazardous waste but is exempt from regulation
under this chapter solely because the waste is generated in
quantities below the threshold for regulation and (b) any household
wastes which are generated from the disposal of substances
identified by the department as hazardous household substances.
(RCW 70.105.010)
"Solid Waste" means all putrescible and nonputrescible solid and
semi-solid wastes, including but not limited to garbage, rubbish,
ashes, industrial wastes, swill, demolition and construction
wastes, abandoned vehicles or parts thereof, and discarded
commodities but shall not include dangerous, hazardous or extremely
hazardous waste.
"System" means Yakima County's system of solid waste transfer
stations, drop box sites, landfills, and processing facilities as
established pursuant to the approved Yakima County Solid Waste
Management Plan.
"Waste Recycling" means reusing waste materials and extracting
valuable materials from a waste stream. (RCW 70.95.030)
"Waste Reduction" means reducing the amount or type of waste
generated but shall not include reduction through energy recovery
or incineration.
"Landfill" means a disposal facility or part of a facility at which
waste is placed in or on land and which is not a land treatment
facility. (RCW 70.95.030)
II. PURPOSE
The purpose of this Agreement is to establish the respective
responsibility of the parties in a solid waste management system
which includes, but is not limited to: planning, waste reduction,
recycling, and disposal of mixed municipal solid waste, industrial
waste, demolition debris and all other waste defined as solid waste
by RCW 70.95.030, and moderate risk waste as defined in RCW
70.105.010.
III. DURATION
This Agreement shall become effective on September 1, 1991, and
shall remain in effect through August 31, 2001.
IV. APPROVAL
This Agreement shall be submitted to the Washington State
Department of Ecology for its approval as to all matters within its
jurisdiction. This Agreement shall be filed with the City Clerk,
with the Clerk of Board of the Yakima County Commissioners and with
the Secretary of State of the State of Washington.
5.1 Either party may request review and/or renegotiation of any
provision of this Agreement other than those specified in Section
V. REVIEW AND RENEGOTIATION
5.2 below during the six-month period, March 1, 1996 through August
31, 1996. Such request must be in writing and must specify the
provision(s) of the Agreement for which review/renegotiation is
requested. Review and/or renegotiation pursuant to such written
request shall be initiated within thirty days of said receipt.
5.2 Review and/or renegotiation shall not include the issues of
system rates and charges, waste stream control or diversion unless
agreed by both parties.
5.3 Notwithstanding any other provision in this Agreement to the
contrary, the parties may, pursuant to mutual agreement, modify or
amend any provision of this Agreement at any time during the term
of said Agreement.
VI. GENERAL OBLIGATION OF PARTIES
6.1 YAKIMA COUNTY
a. Management. Yakima County agrees to provide county-
wide solid waste management services for waste generated and
collected within jurisdictions which are parties to this Agreement.
The County agrees to dispose of or designate disposal facilities
for all solid waste and moderate risk waste generated and/or
collected within the corporate limits of the City which is
delivered to Yakima County in accordance with all applicable
federal, state and local environmental health laws, rules, or
regulations.
b. Planning. Yakima County shall, in cooperation with the
City of Yakima, prepare a coordinated, comprehensive Solid Waste
Management Plan for solid waste including moderate risk waste but
shall not be responsible for planning for hazardous or dangerous
waste or any other planning responsibility that is specifically
designated by State or Federal statute.
c. Operation. Yakima County shall be or shall designate
or authorize the operating authority for transfer, processing and
disposal facilities, including public landfills, waste reduction
or recycling facilities and energy resource recovery facilities as
well as closure and post -closure responsibilities for landfills
which are operated by Yakima County.
d. Collection Service. Yakima County shall not provide solid
waste collection services within the corporate limits of the City,
unless permitted by law and agreed to by both parties.
e. Support and Assistance. Yakima County shall provide
limited support and technical assistance to the City if the City
seeks to establish a waste reduction and recycling program
compatible with the County waste reduction and recycling plan. The
County shall develop educational materials related to waste
reduction and recycling, moderate risk waste, and strategies for
maximizing the usefulness of the materials and will make these
available to the City for its use.
f. Facilities and Services. All personal and real property
acquired by Yakima County for solid waste management system
purposes shall be the property of Yakima County.
6.2 CITY
a. Collection. The City, an entity designated by the
City, or such other entity as is authorized by state law shall
serve as the operating authority for solid waste collection
services provided within the City's corporate limits.
b. Disposal. By ordinance, the city shall designate the
County disposal system for the disposal of all solid waste
generated and/or collected within the corporate limits of the City
and shall authorize the county to designate disposal facilities for
the disposal of all solid waste (and moderate risk waste) generated
or collected within the corporate limits of the City, except for
solid waste which is eliminated through waste reduction or waste
recycling activities or disposal of inert demolition debris
consistent with the Solid Waste Management Plan.
VII. COUNTY SHALL SET DISPOSAL RATES AND
OPERATING RULES FOR DISPOSAL
In establishing or amending disposal rates for system users, the
County may adopt and amend by resolution rates necessary to recover
all costs of operations including the costs of waste planning,
handling, processing, disposal, defense and payment of claims,
capital improvements, operational improvements, and the closure and
post -closure of landfills which are or were operated by Yakima
County. The SWAC will provide comments or recommendations to the
County in considering system or rate modifications.
VIII. LIABILITY
8.1 The County shall indemnify and hold harmless the City and
shall have the right and duty to defend the City solely through the
County's attorneys against any and all claims arising out of the
County's operations and settle such claims, recognizing that all
costs incurred by the County thereby are system costs which must
be satisfied from disposal rates as provided in section VII herein.
The county shall consult with the City and exercise good faith in
such defense or settlement. For purposes of this section "claims
arising out of the county's operations" shall include claims
arising out of the City's operation of motor vehicles in connection
with the system or other activities under the control of the City
which may be incidental to the County's operation.
8.2 The City shall hold harmless, indemnify and defend the County
for any property damage or personal injury solely caused by the
City's negligent failure to comply with the provisions of Section
8.5.
8.3 In the event the County acts to defend the City against a
claim, the City shall cooperate with the County. In the event the
City acts to defend the County, the County shall cooperate with the
City.
8.4 For purposes of this section, references to City or County
shall be deemed to include the officers, employees and agents of
either party, acting within the scope of their authority.
8.5 All waste generated or collected from within the corporate
limits of the City which is delivered to the system for disposal
shall be in compliance with RCW 70.95 and all other applicable
federal, state and local environmental health laws, rules or
regulations.
IX. SOLID WASTE MANAGEMENT PLAN
9.1 Yakima County is designated to prepare the Solid Waste
Management Plan (SWMP) and updates including the incorporated area
of the City pursuant to RCW 70.95.080(3).
9.2 The Solid Waste Management Plan will promote waste reduction
and recycling which meet or exceed the Washington State solid waste
management priorities pursuant to Chapter 70.95 RCW.
9.3 The Solid Waste Management Plan will be prepared in accordance
with chapter 70.95 RCW and solid waste planning guidelines
developed by the Department of Ecology. The plan shall include,
but not be limited to:
a. Descriptions of and policies regarding management practices
and facilities required for handling all waste types;
b. Schedules and responsibilities for implementing policies;
c. Policies concerning waste reduction, recycling, energy and
resource recovery, collection, transfer, long-haul transport,
disposal, enforcement and administration;
9.4 The cost of preparation by Yakima County of the Solid Waste
Management Plan will be considered a cost of the system and
financed out of the disposal rates.
X. FORCE MAJEURE
The parties are not liable for failure to perform pursuant to the
terms of this Agreement when failure to perform was due to a n
unforeseeable event beyond the control of either party to this
Agreement.
XI. MERGER
This Agreement merges and supersedes all prior negotiations,
representation and/or agreements between the parties relating to
the subject matter of this Agreement and constitutes the entire
contract between the parties.
XII. WAIVER
No waiver by either party of any term or condition of this
Agreement shall be deemed or construed to constitute a waiver of
any other term or condition or of any subsequent breach whether of
the same or a different provision of this Agreement.
XIII. THIRD PARTY BENEFICIARY
This Agreement is not entered into with the intent that it shall
benefit any other entity or person except those expressly described
herein, and no other such person or entity shall be entitled to be
treated as a third party beneficiary of this Agreement.
IV: SEVERABILITY
If any of the provisions contained in this Agreement are held
illegal, invalid or unenforceable, the remaining provisions shall
remain in full force and effect.
XV: NOTICE
Notices delivered to the County pursuant to this Agreement shall
be addressed to Yakima County Public Works Department, Solid Waste
Division, 128 North 2nd Street, Room 408, Yakima, Washington
98901-2614.
IN WITNESS WHEREOF this Agreement has been executed by each party

ELEMENT 1: ROLE OF THE CITY UNDER THE COUNTY SOLID
WASTE MANAGEMENT PLAN
Subtasks:
1. Review Yakima County Solid Waste Management Plan and
related documents.
2. Meet with Yakima County Solid Waste staff to review their
upcoming planning efforts and the future role of the City's Waste
Reduction and Recycling Plan.
3. Draft a position paper describing the most beneficial relationship
with the County.
4. Review this position paper with staff and elected officials to solidify
the City's Position.
5. Develop a final consensus position regarding the City's desired
relationship with the County Plan and prepare a draft
memorandum of agreement between the City and County
concerning waste reduction and recycling planning.
6. Review the draft agreement with the County staff, modify as
necessary, and secure approval from both the City and the
County.
Deliverables:
A memorandum of agreement between the City of Yakima and Yakima
County, spelling out the relationship between the City's Waste Reduction
and Recycling Plan and the County's Solid Waste Management Plan.
Documentation of specific actions required by the City to comply with the
County's Plan and recommended revisions to the County Plan will also
be provided.
ELEMENT 2: ALTERNATIVE PLANS FOR ACHIEVING RECYCLING
GOALS --SELECTION OF PREFERRED PLAN

Subtasks:
1. Establish City WR/R Goals in Compliance With SHB 1671
The Matrix Management Group team will meet with the City Staff at
the beginning of the project to establish overall goals for waste
reduction and recycling levels in five and ten years.
Subsequently, the consultant team will prepare a set of
recommended five and ten year goals for review by the staff and, if
appropriate, other interest groups.
2. Assess Existing Conditions
Yakima's current disposal and recycling practices will be reviewed
to provide a starting point for the planning effort. This assessment
will involve:
estimating waste stream composition
determining existing recycling activities and levels
identifying existing and potential regional markets
determining the level of interest in recycling and waste
reduction programs
3. Develop Base Case Waste Generation and Recycling Projects
Waste generation, disposal, and recycling levels will be projected
for 10 years to provide a baseline from which to develop and
measure performance.
4. Define and Assess Alternative Waste Reduction and Recycling
Options
Information from waste reduction and recycling programs will be
surveyed, and a basic database of the most widely used options
will be developed.
These options will be screened to eliminate those which clearly do
not fit the situation in Yakima.
5. Develop and Analyze Alternative Plans
The options which apply to Yakima will be combined to form
alternative comprehensive waste reduction and recycling plans.
Diversion levels, cost, degree of program complexity, means of
compliance, market potential, reliability, and "fit" with existing
waste reduction and recycling activities will be documented.

The alternatives will then be ranked according to cost and
effectiveness.
6. Select a Preferred Plan
The consultant team will work with City staff to establish the
process for selecting a preferred plan from among the principal
alternatives.
Alternative plans will be evaluated against a set of criteria
reflecting SHB 1671 requirements and City of Yakima concerns.
These criteria, to be developed by the consultant team with City
officials and other interested parties, including considerations
such as: reliability, market potential, efficiency, ease of
implementation, environmental impacts, cost, and diversion levels.
The final plan will be selected from among the top two or three,
reflecting the consensus of the decision makers and involved
public.
Deliverables:
1. Report summarizing:

alternative plans
analysis of plans
criteria and ranking
2. Recommendations for a preferred comprehensive WR/R plan
ELEMENT 3: ANNUAL ACTIVITY PLANS --COMPLIANCE WITH SHB

Su btasks:
1. Develop five-year activity plans, phasing in the programs and
policies set forth in the preferred comprehensive recycling plan.
Create several alternative schedules reflecting different levels of
effort and expenditure.
2. Using the Matrix Waste Reduction/Recycling Analysis Model,
determine the recycling and waste reduction levels achieved each
year under the different plan schedules.
3
3. Compare the performance of the alternative activity plans to the
goals and guidelines of the City and the State. Evaluate how each
alternatives meets the intentions of State legislation.
4. Select the preferred annual activity plan as the basis for
development of the detailed implementation plan.
Deliverables:
1. A report presenting the activity outlines and the analysis of
compliance with SHB 1671.
2. A recommended activity plan for implementation by the City of
Yakima.
ELEMENT 4: IMPLEMENTATION OF COMMERCIAL WASTE
REDUCTION AND RECYCLING
Su btasks:
1. Review existing contracts, ordinances, and franchises governing
the collection and disposal of commercial waste and the collection
of recyclables from the commercial waste substream.
2. Determine all possible alternatives institutional arrangements for
implementing commercial recycling in Yakima under existing
State laws and UTC regulations.
3. Review the full range of commercial waste reduction and recycling
options which are consistent with commercial recycling strategies
recommended under work Element 2.
4. Evaluate program options.
5. Identify likely private and public sector roles and responsibilities
for planning, design, implementation, ownership, and regulation of
commercial waste reduction, and recycling programs.
6. Meet with the Community Advisory Committee and others who
may be affected by City -sponsored commercial recycling activities
and resolve, through consensus or negotiation, any issues
regarding service delivery responsibilities.
7. Identify the need for service agreements or revisions to existing
ordinances franchises, or contracts between the City, its haulers,
private recyclers, and the County.

8. Develop year -by -year activity outlines and implementation plans
for inclusion in work Elements 3 and 6.
9. Assess: 1) the potential for waste reduction and recovery; 2) costs
incurred by the City; and 3) impacts on private recyclers.
10. Prepare a draft technical memorandum for review by the
Community Advisory Committee, the County, private sector
interest groups, the Chamber of Commerce, and elected officials.
Deliverables:
1. Report documenting:
the commercial program options.
the process for selecting programs
recommendations and rationale for each
private and public sector roles and responsibilities, and
costs and impacts of recommended waste reduction and
recycling programs.
2. Specific recommendations to revise existing or develop new
ordinances, contracts and franchises necessary to implement
recommended commercial recycling programs.
ELEMENT 5: PUBLIC INFORMATION PLAN
Subtasks:
1. Form a Community Advisory Committee
2. Design and Initiate a Program Publicity and Promotion Campaign
3. Develop a Community Outreach and Education Program
Deliveries:
1. A detailed public information plan, and approach to: program
publicity, promotion, and community outreach and education.
2. Assistance with implementation of the public information
3. A Community Advisory Committee and process for their
involvement in the plan formation.

ELEMENT 6: IMPLEMENTATION PLANS
Subtask
1. Prepare performance specifications for each alternative program.
2. Describe the roles of the City, private service providers, other
governmental agencies, and the public for each recycling
program.
. Evaluate an in-house approach versus contracting -out, for
recycling services.
Quantify, where possible, effects upon the private recycling
community.
Identify reporting or regulatory requirements imposed by
other agencies.
Describe the anticipated or required level of public
participation and support.
3. Determine operating parameters such as:
sign-up versus delivery of bins
type of materials to be collected in each bin
program phasing requirements
frequency of collection
equipment requirements and crew size
rates, financial incentives, method of payment, and billing
arrangements
mechanism for sharing risks
4. Identify the necessary implementation activities and organize them
into a work plan for each alternative:
Develop task descriptions.
Determine the interface between the different tasks and
programs.
Identify restrictions or potential problems and develop
strategies to overcome these problems.
Develop a work structure encompassing all tasks.
Define program budgets and schedules.
5. Present plans to City staff for approval.
Deliverables:
1. Implementation plans for each recommended waste reduction and
recycling program.

ELEMENT 7: RESIDENTIAL WASTE COLLECTION PERFORMANCE
EVALUATION
Subtasks:
1. Perform a literature search to determine industry performance
measures and standards for residential waste collection. Sources
will include relevant periodicals, industry associations, the UTC,
and other residential waste collection information resources.
2. Develop a list of proposed industry performance measures and
standards. These measures may include, but not be limited to,
pick ups per day, miles driven per day, tonnage handled per day,
and accounts served per day.
3. Determine the City's criteria for effective residential waste
collection. Develop a list of proposed criteria, e.g. reliable timely
service.
4. Collect data needed to evaluate service effectiveness.
5. Collect data necessary to evaluate service efficiency. Sources of
data will include, but not be limited to, waste collection daily Togs,
financial statements, and management reports.
6. Evaluate City of Yakima service efficiency and effectiveness. In
order to accurately assess the efficiency of the City's residential
waste collection service, the characteristics of the City will be
considered. These may include number and types of residences,
types of waste, and area served.
7. Compare City of Yakima performance results with industry
standards.
8. Conduct a peer analysis. Identify 3-5 cities or service areas with
characteristics resembling the City of Yakima, and develop a
similar set of performance data for these cities.
9. Formulate and review initial findings, conclusions, and
recommendations with the City, including recommendations for
rerouting.
10. Prepare a draft report, review with City staff, make revisions, and
present the final report.

APPENDAGE TO SCOPE OF WORK
ELEMENT 1
The City of Yakima and the consultant will work closely with Yakima
County to insure there is no duplication of the planning efforts in
the development of the Waste Reduction and Recycling Element Plan.
ELEMENT 5
In reference to the Community Advisory Committee, the essential
tasks for the committee will be:
1. ' To review information provided by the consultants and provide
their own viewpoints and comments for staff consideration;
and
2. To assist in involving the broader public in the planning
process, by conveying information to them, bringing public
viewpoints to the consultants and staff, and encouraging
community members to participate in public meetings about
the Waste Reduction and Recycling Plan.

ELEMENT 1: PLAN AND ADMINISTER IMPLEMENTATION
PROCESS
1. Develop specifications for containers needed to implement
program.
2. Locate Markets for the materials to be collected. Determine
how materials will be sorted, stored and transported.
3. Develop specifications for equipment required for collection
and handling of materials.
4. Develop job descriptions for employees needed to provide
service. Retrain current employees or train new employees to
provide them with background and tools to accomplish the
collection tasks properly and without injury.
5. Develop ordinances relating to waste reduction and recycling
within the City of Yakima.
ELEMENT 2: OUTREACH ACTIVITIES
1. Notify the public on proper use of containers, accurate location
and frequency of collection of the containers.
2. Conduct public training to encourage backyard composting and
other ways to reduce waste.
ELEMENT 3: PROMOTIONAL ACTIVITIES
1. Conduct school classroom presentations.
2. Conduct at home demonstrations on use of containers.
at public meetings and places, a door -hanger for distribution
by volunteers, a self -mailer and a bill stuffer.
2. Public service TV and radio spots for airing will be developed.
ELEMENT 4: OUTREACH ACTIVITY MATERIAL
1. Develop bilingual information and outreach activities which
will target Hispanic residents, the growing Hispanic business
community, youth groups, schools and community
organizations.
2. Form Hispanic subcommittee to the Citizen's Advisory
Committee.
