City Council.met in.special: session pursuant to due notice at 12:00 Noon, August 14, 1972,_in•the Conference Room at City Hall:' ' Councilmen present at the meeting Mayor Bert Broad, Wray Brown, Lenore Lambert, Don Schussler and Bill'Whitaker. Also present were City Manager McMicken and City Attorney Andrews, • The City Manager notified the Council of an announcement of a job vacancy to be made for recruiting a replacement for Frank Stein, Director of'Public Utilities, who will retire • at the end of the year; and the City Manager advised the Council of'plans for continuity • in_ transferring those duties to a new department head to be hired. The Council reviewed results of a survey taken by the Chamber of Commerce related to air transportation service for Yakima. No action was :required on this subject. • Community development goals were discussed with the•Council by the City Manager, and the • Council- concurred that a statement of those goals should not include a reference to a new City.Hall or to joint law enforcement facilities for the police and sheriff's departments • as a present goal. • The Council discussed a paper proposed by the City Manager for study to promote regional • planning; and a special joint. meeting of the Council'and City Planning Commission was scheduled to be'called for Thursday, August 17, 1972, at 8:00 P.M. Bill Hutsinpiller, Director of Parks and Recreation, announced plans for a grand opening of the new Miller Bathhouse to occur on Wednesday, August 16, 1972, at 11 :30 A.M. Blossom.Addition and Others.Sewer and Water District, be passed as read. - Public Works Director ,Dave Vargas ' explained .that. there• a-re three sewer lines • and one water line to be covered by-this-local improvement district. He reviewed - the locations of these lines and "explained the methods of payment. Mr. Davis, Browne's Homesites ' .Addition,: stated . that -his assessment <was to bey •much :more than an earlier estimate made in 1971. •Mr. Vargas stated that he would attempt to solve this problem. Mayor Broad asked if Mr. Davis was protesting the sewer at this time on the basis of these estimates, and Mr. Davis replied that .he is not protesting the- sewer as such, just the overpayment. City "Attorney Fred Andrews reviewed the legal procedure for filing aprotest. Mr. Harvey •Smith, Franklund's Pear. Robinson absent. • ORDINANCE ?f0: 1428, ORDINANCE related to traffic 'control; prohibiting 'parking on cer- tain streets;' amending Section 9.- 75.040 the. of Yakima Municipal Code;' :and declaring an emergency. r416 • • AUGUST 14, 1972 An Ordinance loaning the amount of $12,000 to the Fund and appropriating that amount within such fund, having been .read in its entirety at the previous meeting of August 7, 1972, and being read by Title only'at this meeting, it was MOVED by Lambert, seconded by Whitaker that Ordinance No. 1429 authorizing said loan in the amount of $12,000 to the Fund and providing for said appropriation within such fund, be passed as read: carried, Broad, Brown, Lambert, Schussler and Whitaker voting aye on roll call. Lust and Robinson absent. • ORDINANCE NO. 1429, AN ORDINANCE authorizing a temporary loan of $12,000 from 463- Water- Sewer Fund to 171 - Airport Fund, and providing for repayment; and appropriating the amount of $12,000 for expenditure from 171- Airport Fund. City Manager'McMicken reported that in accordance with Council's approval in May, 1972, of a proposal to organize a Department of Services, legislation has been drawn to.amend the Municipal Code regarding organization of City departments and amendments to the Pay. Plan. He further explained that two neW; positions have been added to the classification plan, those of Housing Service Representative and Housing Resource Developer. He indi- cated that legally they would be City employees; but they will work out of the office of Michael Schwab, Emergency Employment Act of 1971. After due discussion, it was: MOVED by Brown, seconded by Whitaker that Ordinance No. 1430 creating a Department of Services and amending the Yakima Municipal Code, be passed as read: carried, Broad, Brown, Lambert, Schussler and Whitaker voting aye on roll call.. Lust and Robinson absent. ORDINANCE NO. 1430, AN ORDINANCE relating to the organization of administrative depart- ments and divisions of of Yakima; creating a Department of Services under the direction of a Director Services /City Clerk and specifying duties•of that office; amending Sections 1.18.030, 1.18.050, ,1.18.052, and 1._18.100, adding new Sections 1.18.054, 1.18.055 and 1.18.056, and repealing Sections 1.18.137, 1.18.170 and 1.18.195, all of the City of Yakima Municipal•Code; and declaring an'emergency. It was MOVED by Lambert, seconded by Brown that Ordinance No. 1431 relating to a classi- fication plan and salary ranges for certain city employees, and amending the Yakima Muni- cipal Code, be passed as read: carried, Broad, Brown, Lambert, Schussler and Whitaker voting aye on roll call. Lust and Robinson absent. ORDINANCE. NO. 1431, AN ORDINANCE relating to a classification plan and salary ranges for certain city employees; amending Subsections (a), (b) and (d) of Section 2.20.100 of the City of Yakima Municipal Code; and declaring 'an emergency. An Ordinance appropriating the amount of $9,610.55 from unappropriated money.in 172- Transit Fund to Account 172.543.33.64 of the 1972 appropriation for 172 - Transit Fund, having been read in its entirety at this meeting, was laid on the table for one week or until August 21, 1972. City Transit Manager Robert Knight explained that this appropriation is re -' quired to pay the cost of purchasing and installing a two -way radio system for the Yakima city buses, He stated that because.of breakdowns, and the problem of transferring, this system would improve the services of the transit operation. An Ordinance appropriating $4,500 within the Contingency Fund and transferring that amount to the General Fund. to purchase video equipment for the Police Department, having been read in its entirety at this - meeting, was laid on the table for one week or, until August 21, 1972. City Manager McMicken explained that this would be a loan, and the State would reimburse the City for the total amount through a Highway Safety Act Grant. An Ordinance appropriating $82,382 within Cumulative Reserve for Capital Improvements Fund and transferring that amount to Urban Arterial Street Fund to provide matching funds for urban arteria1.projedts, having been read in.its entirety at this meeting, was laid on the table for one week' or until August 21, 1972. • City Manager' McMicken reported that he has had a meeting with County Health officers on the matter of Abbott well water service. He stated that the Health District believes service from the'Abbott well is still insufficient to meet desired health standards Mr. McMicken explained that he' has told the Health District that the appropriate-course of action by the City would then be to initiate an' L.I.D. to install the pm per mains in the vicinity of the well for replacement of the service for those on the Abbott distribution system. Mr. McMicken reported that a preliminary'L.I.D. has been prepared for property located close within a potential typhoid area and of the Abbott water users. He indicated that:the estimated cost of that project would be'approximately $31,000. He reported that the State would provide $20,000 to help part of the expenses. He stated that if the Council wishes to initiate proceedings toward an L.I.D., they will have to confer with the County Commissioners regarding permits and franchises. Mayor Broad stated that he favors instigating the proceedings. After further discussion, it was MOVED by Whitaker, . seconded by Lambert that the proper legislation be drawn to instigate an L.I.D., waiving the City's outside utility policy regarding annexation requirements, and that the City • Council contact the County Commissioners.. - Councilman Lambert stated that she feels very strongly that there is a need for this water supply, and that it is imperative to contact the County Commissioners as soon as possible. Councilman Schussler agreed with Councilman Lambert, but added that if the City makes a habit of extending utilities to problem area$, they may be establishing a precedent. Council members agreed that the only thing justifies this action is that it is an emergency health hazard. After due discussion, Mayor Broad called for the voice vote on the Motion made by Whitaker and seconded by Lambert to instigate an. L.I.D. for said area, and it carried, Broad, Brown, Lambert, Schussler and Whitaker voting aye by voice vote. Lust and Robinson absent. • City Manager McMicken reviewed in detail a statement of the City Council re-Community Development Goals. He stated that in the preceding study session, it was decided to delete the last sentence in the second paragraph. After discussion, Council members agreed to delete the word "totally in the first sentence under City'Shop Facilities and to add "estimated costs" beside each of the figures. It was then MOVED by Lambert, seconded by Brown that this statement, as amended,'be adopted as a Statement by the City Council re • Community Development Goals: carried, Broad, Brown, 'Lambert, Schussler and Whitaker voting aye. by voice vote. Lustand• Robinson absent. City Manager McMicken .indicated that he would bring the Council revised copies of the statement. City Manager McMicken reported that the State Department of Highways has proposed that the City participate in an Urban Transit Planning Program. He • indicated that the approximate cost ofTthisrproject will be $43;500. City Manager McMicken explained that this is an open -end agreement,' whereby the City, does not the V & C Bureau to call - for bids. Councilman Lambert asked , if. we 'should include bidding.. .Mr. McMicken 'exp.lained that calling for bids would not give -the V & -C Bureau much .Chance to change their: minds on materi.a'ls: =:.Mr. McMicken stated that in the•agreement,-the - 'V & C a $5,000 limit. D -191, A.RESOLUTION authorizin an6 dllrec thhee r't MM ana er nd Cit lerk of the Ci a ima o execu e a burls romo ion greement wi h tt Y aiama VaT1ey V sitozs a & Conv n on Bureau Iny of c. • City Manager McMicken explained that in September of 1970, the City engaged Cornell, Howland, Hayes-.and Merryfield (CH2M) to perform engineering services for expanding indus- trial waste disposal facilities at an estimated fee range of :,$.9;0©:0.':to $12 ;_0.0.0..: He .stated that since that time, the'Department of Ecology. bast, :imposed additional requirements and additional data had to be gathered, which raised the total fee slightly over $15,000. He indicated that the City 'Attorney, Director of Public Works and himself are with the reasons for which the original fee was exceeded, and that this additional sum should be paid to the engineers for their extra services. • Mr. McMicken stated that in addition to that work, the City has another• need for data to complete an engineering study at the industrial waste' disposal facility. He indicated:that such required additional services are not to exceed $1,200. .It was then MOVED by;Lambert, seconded by Whitaker that Re- solution No. D -1914 authorizing the engagement of Cornell, Howland, Hayes and Merryfield, to perform engineering services in connection with expanding industrial waste treatment facilities, and authorizing payment for previous services, be passed as read. Upon fur- ther inquiry, Public Works Director Dave Vargas explained that the former Public Works Director had authorized more data gathering when it was found that the Department of Ecology's standards'were raised, and he feels the additional payment is justified. .City 'Attorney Andrews explained that the original contract called for work to be done to meet the standards of the Department of Ecology, and the. City could legally pay the additional amount of,money. .Councilman Lambert indicated that in the future, the engineers should bring to the Public Works Department's attention changes in the Department of Ecology's requirements. Mayor Broad then called.for the•roll call vote on the Motion made by Lam - bert, seconded by Whitaker that Resolution No. D -1914 authorizing the, engagement of Cornell, Howland, Hayes. and Merryfield, be. passed as read, andr it carried,_•Broad, Brown, Lambert, Schussler and Whitaker voting aye on roll call. RESOLUTION NO. -D -1914, A RESOLUTION engaging.Cornell, Howland, Hayes &: Merryfield to per- form engineering services to conduct an industrial wastesurvey ;'and authorizing payment to Cornell, Howland, Hayes & Merryfield for engineering services in connection with expanding industrial waste treatment facilities of the City. • Mr. Archie Howard, maintenance man of the Abbott well, asked the Council why the area around this well has been chosen to receive City water. He stated that he didn't think the City would get 60% of the people in that area to go for`an L.I.D. Council members replied that this well was chosen because it is in direct line of flow from a potentially contaminated water supply. City Manager McMicken explaining that an emergency exists so as to authorize the purchase without calling for bids of parts for the repair•of a sludge pump at the sewage treatment plant, it was MOVED by Brown, seconded by Whitaker that Resolution No. D -1915 authorizing the purchase of said parts for pump repair at the Sewage Treatment Plant, without calling for bids, be passed-as read: carried, Broad, Brown, Lambert, Schussler and Whitaker voting aye on roll call. Public Utilities Director Frank reported that bids were received and considered by a bid board on August 10, 1972, for the Naches River Raw Water Intake, as follows: Coast Contractors, Inc., Lake Oswego, Ore. $126,000 R. J. McCarthy Co., Inc., Seattle, Wn. $ 99,750 George A. Grant, Inc., Richland, Wn. $ 77,700 Cornell, Howland, Hayes & Merryfield recommending that the contract be awarded to George A. Grant, Inc., who submitted the lowest and best bid in the amount of $77,700, contingent upon ah extension of completion time that is. mutually satisfactory to the City and to the Contractor, it was MOVED by Whitaker, seconded by that the recommendation of CH2M be accepted and that the contract be awarded to George A.
