4111 A RESOLUTION adopting a regulation governing disinterments at
the Tahoma Cemetery.

WHEREAS, pursuant to Section 7.04.050 of the City of
Yakima Municipal Code, the City Manager may propose for Coun-
cil passage rules and regulations governing the operation of
Tahoma Cemetery; and
WHEREAS, need has arisen to adopt a rule concerning a
procedure to be following in the event of burial of human
remains in the wrong lot; and
WHEREAS, the City Council desires to adopt such a regula-
tion in conformance with RCW 68.50.220 and Section 7.04.050 of
the City of Yakima Municipal. Code, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Upon recommendation of the City Manager, the following
rule is hereby adopted:
"In the event a deceased person is
buried in a cemetery lot or space
belonging to another, the Public
Works Director, or his designee, may
cause such deceased person to be
disintered and reburied in another
lot or space. Prior to such disin-
terment and reburial, the Public
Works Director shall give written
notice of the time, date, and place
of the disinterment and reburial to
the following persons if their
whereabouts are known:
I. The surviving spouse,
2. The surviving children of the
deceased person,
3. The surviving parents of the
deceased person, and
4. The surviving brothers and
sisters of the deceased person.
There shall be no charge for disin-
terment, reburial of the deceased
person, and resetting of a head-
stone.

This .rule shall apply retroactively
as well as prospectively."
