A RESOLUTION authorizing an agreement between the City of Yakima,
Yakima County and the Yakima School District for a
summer recreation program for disabled youth.
WHEREAS, the City of Yakima operates a Parks and Recreation
Division; and
WHEREAS, Yakima County and Yakima School District wishes to
encourage the offering of public recreational programs to disabled youth;
and
WHEREAS, the City Council deems such activities to be healthy and
beneficial for the youth of the City; and
WHEREAS, the City Council deems it to be in the best interest of the
City to execute the attached and incorporated agreements, now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager and the City Clerk of the City of Yakima is hereby
authorized and directed to execute the attached and incorporated
agreements between the City of Yakima, Yakima County and the Yakima
School District for a Recreational Program for Disabled Youth.

1991 AGREEMENT
BETWEEN THE CITY OF YAKIMA
AND YAKIMA SCHOOL DISTRICT
This Agreement is made and entered into the ii± -6- day of �y
1991, by and between the City of Yakima, Department of Public Works,
Parks and Recreation Division, herein referred to as the "City" and Yakima
School District, herein referred to as "School District".

WHEREAS, the City finds it mutually convenient to contract with the
School District and Yakima County to provide a summer recreational
program for youth with special needs referred to as Special Adventures in
Leisure (SAIL), in a cooperative venture with the City's Parks and
Recreation program.
WITNESSETH; That for and in consideration of mutual convenants,
promises and agreements, herein contained the parties mutually agree as
follows;
1. To administer an eight week activity program for youth with
special needs refered to as the SAIL program, to be held from
July 8, 1991 through August 30, 1991. Said program shall be
open to all disabled youth between the ages of five and
thirteen years. Enrollment in the program shall be limited to
twenty-five (25) children.
2. The program shall consist of two components:
A. Daytime Youth Activities: which include but are not
limited to arts & crafts, dramatics, music, outdoor
adventures, special activities and organized games. The
purpose of the program is to provide appropriate leisure
activities for disabled youth. This component shall
operate 4 days per week from 10:00 am to 1:00 pm during
the above mentioned program dates.
B. Special Events: which include but are not limited to: a
swimming party, a family picnic, a field trip and a theme
special event. The Special Events allow families to
participate with their child in a fun -filled activity and
allows parents to network together. Four Special Events
will be offered during the above mentioned dates.
3. During the performance of this Agreement, the program
shall not discriminate on the basis of race, color, sex, religion,
national origin, creed, or the presence of any sensory, mental
or physical handicap.
4. Special areas of responsibilities for both the City and the
School District are contained in Attachment "A" which is
attached and incorporated into this Agreement.
5. It is understood that the City does not maintain liability
insurance on the School District and/or its employees, or on
Yakima County personnel or property.
6. The City shall defend, indemnify and hold harmless
the School District its agents, officers, and employees from
any and all liability resulting out of the performance of this
Agreement, including but not limited to, actions or inaction by
City personnel.
7. As consideration for the services specified in this Agreement,
the School District agrees to compensate the City according to
the payment schedule, Attachment "B" which is attached and
incorporated into the Agreement.
8. This Agreement, or any interest therein, can not be assigned in
whole or in part by the School District to any other party
unless mutually agreed upon by both parties.
10. If the School District fails to preform this Agreement in such
a manner that the Parks and Recreation Manager in his sole
discretion deems that the continuation of the Agreement is no
longer in the best interest of the City, the City may terminate
this Agreement by setting forth cause by written notice,
giving the School District ten (10) days notice of termination.
11. If the City fails to comply with the terms and conditions of
this Agreement, the School District may terminate this
Agreement by written notice, giving the City ten (10) days
notice of termination.
12. If for any reason prior to termination of this Agreement as
provided herein the School District fails to provide the
services specified in this Agreement and the City is forced to
secure other such services, the School District shall be held
liable for any and all additional expenses to fulfill their
obligation to the City and program under this Agreement.
13. All notices required by this Agreement shall be deemed
properly served when deposited in the United States Mail three
(3) days prior to any deadline listed herein, postage prepaid,
and addressed to the appropriate party at the addresses listed
below.
14. This Agreement constitutes the entire Agreement between the
parties. There is no other oral or written Agreements between
the parties as to the subjects covered herein.
15. If any portion of this Agreement is changed per mutual
agreement the Agreement shall be amended in writting to
reflect the change.

ATTACHMENT "A"
AREAS OF RESPONSIBILITIES:
1. The City of Yakima Parks and Recreation Division shall:
A. Register all participants for the SAIL program
and answer all questions pertaining to the program for
the public.
B. Print informational flyers for distribution.
C. Reserve a school facility for use.
D. Distribute PSA's, and News Releases to promote the program.
E. Be responsible for the total planning and implementation of
the program, including staffing, equipment, supplies and
promotion.
F. Shall include in all promotional material and information to
the public the statement "Funds for this program are provided
by a grant from Yakima School District". Also listed will be
other funding sources.
G. Shall hire, train and supervised qualified staff to work the
program.
H. At the conclusion of the program, meet with School District
representatives to evaluate the program and make
recommendations for future offerings. In addition, the .City
shall provide a written program report and evaluation to the
School District which shall, at the minimum, contain
attendance figures per day, an analysis of program activities
and an overall program evaluation.
I. At the conclusion of the program, the City shall bill the
School District for services according to attachment "B".
2. Yakima School District shall:
A. Assist the City in recommending the scope of the program.
B. Assist the City with distributing flyers through the Special
Education Department.
C. At the conclusion of the program, meet with the Recreation
Supervisor to evaluate the program and make recommendations
for future offerings.
D. Pay the City within 30 days of receiving the aforementioned
bill. All payments shall be sent to the City of Yakima, Director
of Finance and Budget, 129 No. 2nd Street, Yakima, WA 98901.
ATTACHMENT "B"
PAYMENT SCHEDULE:
The School District shall pay the City for services rendered
according to the attached program budget. The School District shall
pay for 1 day of services per week for a total of eight weeks. The
cost per one program day is $2484.

COMMUNITY SERVICES
This Agreement is made and entered into the day of
1991, by and between the City of Yakima, Department of PubliWorks,

County Community Services, herein referred to as the "County".
WHEREAS, the City finds it mutually convenient to contract with the
County and the Yakima School Dist. to provide a summer recreational

other such services, the County shall be held liable for any

City and program under this Agreement.
